Remember that time Infinity Ward exploded and everyone was super pissed? Well, the legal aspect of that boondoggle is still happening.
The year was 2009. Activision, riding high on the insanely profitable Modern Warfare 2, was looking for ways to keep the profits rolling in and the games rolling out. Infinity Ward, the company behind the massive hit, was looking for ways in which to keep a larger share of those profits. The end result? A massive controversy that resulted in the ousting of two prominent devs.
Vince Zampella and Jason West, co-founders of Infinity Ward and the creative minds behind the Modern Warfare franchise, were either fired from Activision, or they quit. It depends on who you ask. The actions were apparently the result of serious contractual problems, with Activision claiming the devs were up to no good with other studios, while the devs claim Activision was holding back enormous royalty payments to them and the rest of the IW crew.
The whole thing has been rolled up into a lawsuit, which was scheduled to go before a judge on May 7. However, the case is now set for May 29, thanks to a delay request on the part of Activision. The company isn’t yet talking about why it elected to push the trial back, but we’re keeping an eye out for official statements.
There are several big things at stake in this court case. Number one, the enormous royalty payments Zampella and West claim that Activision owes them. Number two, damages ordered by the court. Oh, and number three: Ownership of the Modern Warfare brand.
If West and Zampella win partial ownership of the franchise, they’ll be able to make their own Modern Warfare games. Seriously. Games that would more than likely be published by EA. Activision is naturally fighting hard, so we’ll just have to wait and see where this whole thing goes.

It’s been almost four months since a Call of Duty game came out. Time to start talking about a new one!
Most people agree that the next entry in the Call of Duty franchise will be Black Ops 2. It’s Treyarch’s turn to develop a CoD title, and the original Black Ops broke pretty much every record set by Infinity Ward’s Modern Warfare 2. And since Activision isn’t one for originality or risk-taking, a straight sequel is all but guaranteed.
Of course, Activision still likes to pretend like it can keep a secret. So even though Black Ops 2 was outed by a retailer last month and everyone pretty much knows it’s coming, the company has gone out of its way to pretend that isn’t the case. Well, add another retailer leak to the pile.
Spanish retailer Fnac not only has Black Ops 2 in its currently video game roster, but has a release window for the still-unannounced title as well: November 2012. Once again, this is less than news—a new Call of Duty game has come out in October or November of every year since 2003.
Seriously, Activision, just announce the game (and the accompanying Black Ops ELITE paid service) already.

The success of Epic Games’ iOS slasher shows what can happen if studios spend time creating credible, high quality mobile titles.
We hear a lot of talk about how mobile gaming is the bold future of the industry, but most of the mobile games that actually come out are nothing more than throwaways. Sure, there are a few one-off titles, but mobile developers for the most part aren’t pushing any boundaries.
Epic Games bucked this trend by investing in a top-tier, near-AAA title for iOS devices, one that runs on the Unreal Engine. Infinity Blade is by far the most advanced mobile game we’ve seen developed specifically for the platform, and it looks like Epic’s boldness paid off big.
To date, both games in the franchise have grossed a combined $30 million. Broken down, that’s $23 million from the first game, $5 million for the second, and $2 million for the soundtrack and novel. Epic, in announcing the figures, also stated that they have plans for future iOS games – here’s hoping we’ll continue to see high quality content on our iPhones and iPads.

Gamer scores 144 kills and 4 deaths in one MW3 match, and in the process demonstrates one of the game’s biggest problems.
Look, it’s 2012. Spawn trapping – the act of locking an opposing team into one spawn area and mercilessly camping them – simply shouldn’t be possible in games anymore. Developers, by now, should know how to circumvent this problem. However, the issue seems to have slipped the mind of devs over at Infinity Ward, as evidenced by this video:
In the clip, one MW3 player, with the help of his team, manages to summon a M.O.A.B. in just 48 seconds by peeking over a wall into the enemy spawn and absolutely wrecking the other team as they respawn helplessly. It’s a cheap tactic from any point of view, but the real amazing thing is that it’s even possible in a game that supposed to be one of the best shooters ever made.
This problem is rampant in certain MW3 game modes, and the developers are going to need to find some way to repair it if they want to keep the community happy and engaged. The players in the video aren’t necessarily cheating, so the only recourse is to prevent the problem from happening in the first place.

Infinity Ward is issuing perma-bans that aren’t exactly permanent, but might as well be.
Want to get banned from Modern Warfare 3 for the next 13 years? All you need to do is skirt the rules of the game by hacking, power leveling or performing some other stupid task, then get caught. Infinity Ward is issuing permanent bans to players caught breaking the rules, although the bans may not be as permanent as one might think.
While the message players receive indicates that the suspension is only temporary, the timeframe is pretty amazing – 5,000 days. That means, assuming the suspension isn’t extended, your account won’t come back online until 2024. By then, we’ll be up to Modern Warfare 25.
If you receive this message, it means you’re banned, not suspended. Apparently, Infinity Ward doesn’t have a mechanism in place for applying permanent bans, so they’ve gone with the next best thing – suspending your account until the game has long been made irrelevant.
Robert Bowling, creative strategist for the Modern Warfare brand, confirmed that if you see this message, you did something very, very stupid. So play by the rules, and avoid the perma-ban!

Did you guys know that people like Call of Duty games? Because Activision is reporting huge profits for the latest entry in the series.
Okay, I promise this is the last news post about how much money Modern Warfare is making. Honestly, I wasn’t even going to post it, but it’s just such a big deal there’s really no way to avoid it.
Activision has reported that Modern Warfare 3 has raked in an astonishing $1 billion in its first 16 days of launch. That’s faster than Avatar, which took 17 days to break a billion after it was released in 2010. The published has also reported that there are over 30 million people playing one version of Call of Duty or the other, making it one of the biggest gaming communities in the world.
As the publisher notes, the CoD community is now larger than the populations of New York, Paris, Madrid, Tokyo and London. Beat that, Battlefield! They also boasted that CoD Elite, the barely-functioning online service launched with MW3, has landed six million players. They compared this figure to sign-ups for Hulu, Xbox Live and Netflix, but I’m not sure that’s a fair comparison considering most of those companies were doing something completely new rather than piggybacking a service onto a successful product.
Like I’ve said before, I’m a Battlefield guy. But, any big success should be celebrated, so hats off to the folks at Infinity Ward for making such a popular game. And also to Activision, for an unmatched marketing blitz.

The sequel to one of the best-looking mobile games ever made has some serious problems on the original iPad and iPod Touch.
Infinity Blade II hit digital shelves yesterday, and while the game has earned praise from most fans and critics, some gamers haven’t been able to enjoy the game at all due to a pesky bug with older Apple hardware. Apparently, generation one iPads and older iPod Touches may experience performance problems when running the game, depending on how many apps you currently have installed.
Epic Games, the company behind Infinity Ward, is well aware of the problem and hard at work on a solution. The developer is aiming to patch the game “ASAP,” so keep an eye on your little blue App Store icon for the notification that an update is ready. The basic problem arose because Epic didn’t test the game on fully loaded devices, instead using test devices that had only the game and a couple of other apps.
As we know, iOS is prone to clutter and a large number of apps, combined with the hardware requirements of the game, are causing older devices to run out of system memory. There’s no official timeline on how long a patch will take, but I’d expect one within the next week or so.

If you’ve been busy with holiday preparations or fighting off dragon invasions, here are some things you may have missed.
It’s been a somewhat busy week for the games industry, though most of the news has to do with titles that have already been released rather than things that are about to come out. We’re fast approaching the end of the crazy rush of releases and people seem to be settling down into their gaming habits.
Modern Warfare, Battlefield and Skyrim dominated the news this week, and plenty of commenters stormed our posts to let their voices heard. So without further ado, here’s your:
Infinity Ward Swings the MW3 Banhammer
Modern Warfare 3 has been out since the 8th, and lead creative strategist Robert Bowling has confirmed that Infinity Ward has already banned over 1,600 players for cheating, hacking and glitching. Most people seem pretty happy about Infinity Ward’s commitment to stopping cheating, but some commenters can’t resist another chance to take pot shots at the Call of Duty franchise.
PS3 Battlefield 3 Owners Getting Battlefield 1943
Sony’s Jack Tretton announced that the PS3 version of Battlefield 3 would come packed with Battlefield 1943, but that bonus failed to materialize. Some gamers filed a class action lawsuit against EA (which I still don’t understand), and faced with intense media pressure and the ire of Battlefield fans everywhere, the developer caved. So, free Battlefield 1943 for everyone!
EB Games Canada Dropping Pre-Owned Games
There is a rumor floating around the retail games industry that EB Games, a subsidiary of GameStop, is planning to mix its used and new games together. The familiar yellow “used” tags will be replaced with white “used” tags, so while the games will still be noted as used products, the similar labels may confuse less savvy gamers. We’re still waiting to see how this story plays out.
Skyrim Map Contains all of Tamriel
One gamer’s realization that the entire landmass of Tamriel is built into the map for Elder Scrolls V: Skyrim led us to wonder why exactly the content was included. Some venture it’s intended as a resource for modders, some think it’s just to add realism to the environment, and some think it’s for potential DLC content down the road. What do you think?
Square Enix: We Want a Final Fantasy Every Year
Square Enix was apparently unhappy with the development time of Final Fantasy XIII and is hoping to up their release schedule to something more along the lines of Assassin’s Creed or Call of Duty. There seem to be people on both sides of this particular post, some excited about more frequent Final Fantasy games, others concerned about the quality loss that may occur as the result of such a cramped development schedule.

Despite stiff local competition, Infinity Ward’s FPS juggernaut is doing well in the birthplace of modern gaming.
Japan can be a weird market for American games makers, just as the west can be a weird market for Japanese games makers. Modern Warfare 3’s launch is the most successful launch of all time here in the west, but it was unclear whether the game would experience similar success as it made its way around the world.
Now that sales figures are starting to roll in from Japan, it looks like Modern Warfare 3 is doing just fine. Surprisingly fine, in fact.
Initial sales tallies indicate that MW3 has sold 180,000 someodd copies for PS3 and 30,000 someodd for Xbox 360, bringing the total Japanese sales up to around 210,000 in its first week of release. Not necessarily earth-shattering numbers, but still enough sales to cement the game as the biggest release of the week.
This is especially impressive considering the other big release, Ni No Kuni, is a hotly anticipated Level-5 RPG that most people were expecting to take the top slot.

Most of the big stuff has come out already, but there are still plenty of new games to play in this week’s edition of “On Shelves.”
It looks like the crazy holiday release schedule is finally slowing down, with most of the major releases already on shelves and waiting to be picked up. But the games industry is an ever-moving beast, and there are still quite a few games scheduled for release in the upcoming week.
Who knows, some of them might even be good! But when an iPhone game is the biggest launch of the week, don’t expect any miracles.

Over 1,600 cheating cheaters have been banned from the game since its launch on the 8th.
There’s something uniquely “Call of Duty” about glitching and cheating. I’ve played plenty of online games, but glitchers seem to be more prevalent in the Modern Warfare games than any other. That’s not to say that there aren’t millions of awesome players working hard to build a great community, but the franchise always seems to have a bigger-than-average collection of bad apples.
Luckily for us nice players, Infinity Ward is watching Modern Warfare 3 carefully and staging precision missile strikes on the accounts of sneaky, unscrupulous gamers.
Robert Bowling, the voice of Infinity Ward in most situations, recently announced on Twitter that the account team there has banned over 1,600 accounts and counting. He goes on to state that any attempt to cheat or hack will be met with a zero-tolerance policy.
Infinity Ward is working hard to fix some of the exploits discovered, such as one that allows infinite stealth bomber runs and a number of basic clipping problems. Most games have a few minor issues at launch, and there doesn’t seem to be anything on the scale of Modern Warfare 2’s care package glitch, so MW3 is doing just fine. It needs a bit of help from its players right now, but most multiplayer matches are being executed without any troubles.

Epic Games’ sequel to the best-looking games on mobile devices has an official release date, and it may be sooner than you think.
Infinity Blade was a revelation for the mobile games industry. Using the Unreal Engine, Epic Games was able to create a lush, engaging experience for iPhone and iPad users across the globe. It was a nice change from the simple, gimmicky games that plague the iTunes Store, and went on to be quite a success.
Now, Infinity Blade II lurks just over the horizon, and promises to be even better than the original.
Epic has just announced that Infinity Blade II will hit digital shelves on December 1, 2011. If you have an iPad, iPad 2, iPhone 4, iPhone 4S, iPhone 3GS or iPod Touch, you’ll be able to download and play the game – though only 4S and iPad 2 users will be able to play it at its full capacity.
The game promises to be more of the same in terms of play style, just much, much prettier. Epic has put tons of work into displaying the potential of mobile devices, so expect Infinity Blade II to create a new graphics benchmark on release. If you liked the original game, which you can still buy for $5.99, you’ll probably enjoy the sequel.

New details about the game’s “Creation Engine” reveal that it will generate new quests into infinity.
Skyrim is a huge game. We knew that already, what with the predictions of a 300-hour gameplay experience. But what we didn’t know is that the game actually continues into infinity, automatically generating content for as long as you feel like playing it.
Sound confusing? Well it is – a little bit. Game director for Skyrim, Todd Howard, has talked a bit about how the games’ new Radiant storytelling system never stops spitting out content, even after you finish the scripted stuff.
Howard says that the game’s engine will randomly create new quests for players that are engineered to send people into areas they haven’t previously visited. Quests can include assassinations, stealing things and, more than likely, slaying dragons. Oh, and don’t worry about running out of dragons – they’re infinite too.
Frankly, I find the idea of an infinite game somewhat terrifying. I downloaded Minecraft last night and even that was enough to overwhelm me, so I’m not really looking forward to trying to sort out everything Skyrim has to offer. I just don’t have 300 hours to put into one title, especially not in the face of the 2011 holiday barrage.

The biggest launch of the year is officially in full swing. Did you already pick up your copy?
Modern Warfare 3 is officially on shelves, with thousands of gamers lining up the night to pick up their copies before anyone else. I know for a fact that my neighbor picked up a midnight copy – the explosions started right around 12:45. Launch events across the country were packed with gamers eagerly awaiting their first chance to play the game through in-store tournaments and other special events.
The launch seems to have gone fairly smoothly, with Call of Duty Elite experiencing only minor issues due to the large rush of people joining up. Elite is only available on Xbox 360 at the moment, with the PS3 version being pushed live on a PlayStation Store update later on and the PC version still delayed indefinitely due to concerns over stat rigging. We’ll have to see how the service holds up once everyone is able to access it before passing judgment.
Review scores are starting to trickle in, with the game (at least the 360 version) holding down a high 90 score on Metacritic. Most reviewers seem to note that the game isn’t reinventing the wheel, but delivers so strongly on the promises of the franchise that it’s still quite a success for the fractured Infinity Ward team. Of course, there are very few reviews posted so that’s another thing we’ll have to wait on.

Activision and the remnants of Infinity Ward drop the latest trailer for what they’re calling the “most anticipated game of all time.” But is it enough to top Battlefield 3?
The next three weeks are shaping up to be an incredible battle of the titans. With Battlefield 3 launching October 24th and Modern Warfare 3 launching on November 8th, the attention of the industry is focued entirely on these two behemoth franchises. EA dropped their final launch trailer for Battlefield 3 earlier in the week; not to be outdone, Activision has done the same, perhaps hoping to block some of BF3’s enthusiasm.

After watching both trailers, I do have to say that Battlefield has the clear edge in terms of polish and graphics. The game looks much better than MW3, and the trailer for MW3 didn’t really get me excited for the game. Frankly, it looks exactly like the last Modern Warfare, which is the primary complaint most gamers have levied at the franchise. I’ve yet to see a screen capture in which the game looks any different.
That being said, the Call of Duty brand has an insane amount of customer loyalty and Activision would really have to screw something up to send players from one camp to the other. As a gamer who plays both titles off and on, I would say that if MW3 is the same as MW2, I’m probably going to skip it.
Modern Warfare 3 is still pretty far ahead in terms of pre-order sales, with about 1.7 million to Battlefield’s 1.07 million. I vaguely remember the head of EA saying that he believed Battlefield would be the winner in terms of lifetime sales, and if Activision continues on the path of releasing the same game every year I wouldn’t be surprised if he were right.
So now that you’ve seen both launch trailers, which game looks like the better buy to you?

Next week may be all about Battlefield 3, but let’s not forget about that other small first-person-shooter that comes out later this year.
Modern Warfare 3 is coming. You may have forgotten, what with the immense media push from EA regarding next week’s release of Battlefield 3, but that doesn’t mean the game doesn’t exist anymore. MW3 is headed to your living room very, very soon, and by all accounts, it’s still demolishing every other game in terms of pre-sales.
Activision and Infinity Ward are naturally going to poke their heads in on BF3’s publicity a bit over the next few days, and the first such announcement comes in the form of an enhanced description of the game’s newest addition - point streaks. What were originally kill streaks in the last couple of games have been modified to point streaks, which was done to help players (like myself) that don’t necessarily play Modern Warfare with the sole intent of stacking up a body count.
Essentially, you’ll be able to select one of three Strike Packages for your character, based on your individual play style. Each Strike Package has different perks; for example, the Assault package has UAVs, Predator missiles and other aggressive bonuses, while the Support package has defensive items like airdrops, EMPs and turrets.
This trailer/commercial goes in-depth regarding what players can expect from the different Strike Packages:
I may be biased since I’ve long since given up on Modern Warfare in favor of Battlefield, but I just don’t think we’re going to see many of those alternative Strike Packages in use during regular play. Established teams might make them work, but it wouldn’t surprise me to see everyone locking into the one Strike Package that seems best geared at generating kills.

The beautiful iOS RPG was a smash hit, but will its visuals hold up when displayed on a screen larger than a few inches?
Infinity Blade, built on the Unreal Engine, was an incredible example of the possibilities of mobile gaming. Its rich colors, complex storyline and hours of gameplay led it to become an addition to millions of iPhone home screens, as gamers flocked to what many considered the first true gaming experience for iOS gamers.
Thanks to the huge success the game has experience on iOS platforms, it looks like a whole new group of gamers are getting a chance to explore its fantasy world. Epic Games has just announced that Infinity Blade FX will start showing up in arcade form at Dave and Busters locations around the world on October 28th.
The game boasts many of the same features seen in the original iOS version, with a single player mode and multiplayer challenges. There’s no word on whether you’ll be able to use your iOS device in sync with the arcade game to create a sort of augmented iPhone experience, but either way you’ll be able to jump directly into the story via the in-house arcade machine.
In other Epic Games news, Infinity Blade 2 is coming exclusively to the iPhone 4S later this year, with the launch tentatively scheduled for December 31st. We’re keeping a close eye on Epic’s news feed, so we’ll let you know if anything changes.
