The company is waiting for “the right” handheld. Hint: Vita isn’t it.
Naughty Dog, the company behind Uncharted, Crash Bandicoot and the upcoming, ridiculously over-hyped The Last of Us, is probably one of the most well-respected developers in the industry at the moment. The Uncharted series has received mountains of praise, and has served as one of the most purchase-motivating PlayStation exclusives since the days of Final Fantasy.
Now that the PlayStation Vita is officially on shelves (well, almost), people want to know who will be making games for the device, and who won’t. As of this week, you can file Naughty Dog under the “won’t” category. Community manager Arne Meyer has confirmed that the company has no Vita titles in the works, and won’t be entering the portable market until “the right handheld” comes along.
Meyer noted that console development is really Naughty Dog’s wheelhouse, playing to their strengths in pushing the limits of both hardware and the company’s game engines. He also stated that he couldn’t rule out a Vita game completely, but that at the moment, there are no plans for Naughty Dog to bring a game to the system.
Uncharted: Golden Abyss is expected to be one of the biggest Vita launch titles at release, but it was developed by Sony Bend borrowing the license from Naughty Dog.
Naughty Dog is one of Sony’s biggest and most successful developers. Seeing them out of the race on the Vita is certainly strange, especially when you consider that Sony just announced that all of its studios were working on something Vita-related.
Do you think more developers will follow Naughty Dog in passing on Vita development?

CEO Mark Pincus disagrees with allegations of concept copying, instead preferring the term “evolution.”
Last week, we talked a bit about Zynga’s latest game, Dream Heights. More specifically, we talked about the fact that Dream Heights is a pretty blatant copy of 2011’s official iPhone Game of the Year, Tiny Tower. At least, that’s how Tiny Tower’s developer, NimbleBit, feels.
Zynga CEO Mark Pincus disagrees with NimbleBit’s assertions, and instead believes that Dream Heights is just the next evolutionary step in a long line of tower games. His response, issued in an internal memo, referenced games like SimTower and Yoot Tower as other games that laid the framework for Tiny Tower, which in turn served as the basis for Dream Heights.
For the sake of fairness, here’s a direct quote:
“With regard to Dream Heights and the tower genre, it’s important to note that this category has existed since 1994 with games like Sim Tower and was more recently popularized in China with Tower of Babel in 2009 which achieved 15 million DAUs. On iOS there has been Yoot Tower, Tower Up, Tower Town, Tower Blocks and Tiny Tower. Just as our games, mechanics and social innovations have inspired and accelerated the game industry, its 30 year body of work has inspired us too.”
Of course, SimTower and Tiny Tower are very different games, a point made by NimbleBit’s Ian Marsh in the company’s rebuttal:
“It is a smart idea for Mark Pincus and Zynga to try and lump all games with the name Tower together as an actual genre whose games borrow from each other. Unfortunately sharing a name or setting does not a genre make. The games Pincus mentions couldn't be more different.”
He continued:
“If you take a quick look before "pulling the lens back" as Pincus suggests, you'll find an innumerable number of details in the game that were painstakingly crafted to be identical to Tiny Tower. These are core gameplay mechanics and rules, not similar settings or themes that games in the same genre might share.”
Pincus also took time to address allegations by yet another developer, Buffalo Studios, that the company had ripped off their design for Bingo Blitz to make the upcoming Zynga Bingo. Pincus wrote a missive similar to the original NimbleBit post, complete with picture-by-picture comparisons of how Buffalo actually ripped off Poker Blitz, an earlier Zynga title.
The whole thing is devolving into a running joke where one company says the other copied, and the accused company goes farther back in the books to claim the same about the accuser. One thing’s for sure, Zynga obviously doesn’t feel like what it is doing is wrong.
What do you think? Where is the line between being inspired by someone’s work, and copying it?
Also, you should absolutely read the full interview at GamesBeat.

Exclusive PlayStation 3 content promised at Sony’s E3 media briefing seems to have vanished into the wind, all for the sake of early DLC access.
If you were paying close attention to Jack Tretton (head of SCEA) when he took the stage at E3 this year, you may remember him talking about some pretty cool PlayStation 3 exclusives. One such exclusive, according to Jack, was the inclusion of DICE’s classic shooter, Battlefield 1943 on every Blu-Ray copy of Battlefield 3.
Essentially, PS3 owners were told that when they bought Battlefield 3, they’d be getting an entire second game for free. It makes sense for the title to be a PS3 exclusive; Battlefield 3 barely fits on two Xbox 360 discs and there probably isn’t much room to cram an entire other game in there. However, astute players that picked up BF3 yesterday noticed that Battlefield 1943 doesn’t seem to be on their disc, and took to Twitter and support forums to figure out exactly what happened.
If you’re one of the many PS3 owners trying to sort out where your Battlefield 1943 went, you can stop looking – it’s not on the disc. DICE worked out a different deal with Sony, trading the inclusion of the game for early DLC access for PS3 owners.
Here’s an official tweet from DICE that sums it up:
“In lieu of 1943 being available on disk for PS3 customers, EA has made all BF3 expansions available early to PS3 customers.”
I’m not really sure if this is an equitable bonus – as an Xbox 360 owner I didn’t really feel like I got much value in being allowed to give Activision more money for CoD expansions before PS3 owners had the same opportunity. If I did own a PS3, and was excited to see 1943 on my disc, I doubt that getting BF3 DLC one week early would really make up for the loss.
What about you, PS3 owners? Should Sony live up to its original announcement or does this whole thing fall in the “do not care” category? Also, sorry if you’re experiencing Battlefield overkill; the rush is almost over! If you’re not, I’ll see you playing online!

And here we have more news on the PlayStation Pass. This time, is Mass Effect 3 going to be joining in on the bandwagon, too?
According to a South African retailer, the answer to that would be yes. Their advertisement on the game, so they say, claim that BioWare's space shooter will indeed be carrying the "online multplayer pass" requirement. More specifically said PSN Pass will be included in the Collector's Edition of Mass Effect 3.
Despite this "confirmation" from the retailer, however, we're going to have to tag this under the Rumor category, simply because we still have no official word from the authority that is BioWare.
Earlier this weekend, we also received word that Uncharted 3 will be featuring the PSN Pass. A lot of players are sure to be pissed about this, for sure, but as with any other "required" features for the PS3, we doubt they'll boycott the game totally because of it.
We might have to wait till later, though, before we get any confirmation from them, since the game won't be out till March of next year, anyway.

Did you know that there's going to be a People's Edition for WWE 12? No? Well then, there will be one, and it's actually now up for pre-order over at the THQ store.
You can catch it from other retailers later on, but for now, it will remain exclusively distributed by the publisher's official store. Now, what will be in store for you in this special edition?
According to the THQ store's product page for WWE 12, both PS3 and Xbox 360 versions of the People's Edition will carry the following treats:
Exclusive WWE Blu-Ray/ DVD featuring The Rock
The Rock playable character for WWE 12
Free Shipping and More
As to what that "More" entails, we're not entirely sure yet as they didn't disclose it. Nonetheless, those items should make it a better buy over the regular standalone copy, considering that it's just for an additional ten bucks. The regular copy is shipping out for US$ 59.99, while the People's Edition is tagged at US$ 69.9..
I guess The Rock's inclusion in the game should make up for Goldberg's absence. Plus, there are still those mystery superstars to watch out for so it's surely going to be a wrestling bonanza like no other.

Digital distribution is undoubtedly set to overtake physical game copies. However, that is not to say that the two cannot share a spot under the same sky.
EA's CFO Eric Brown pretty much shares the same observation, expressing that he believes traditional retail outlets will remain to play an integral play in the market, at least for the "foreseeable future."
His statement was made during a presentation to investors and analysts alike, which took place earlier this week at the Goldman Sachs Communacopia Conference.
Said Brown, "You need a retail partner to stock the consoles. I don't see all consoles being ordered via mail. There's going to be people that go in and want to see the display, the form factors, etc."
He then went on to cite the example of Sony and how they went wrong with the PSPgo. Sony's much-hyped handheld basically went stale, simply because it went all digital, totally foregoing the option of a physical media.
"If you were toc ompletely eliminate physical distribution of the disc," explained Brown, "the margin opportunity is lost in the entire category. To the retailer, holistically it radically alters their view of the cateogry. So it's for that reason that I just don't see in the foreseeable future a complete shift to digital gaming delivery."
Much discussion has been made on this particular evolution in the gaming industry, but at this point, I would have to agree with Brown. Despite people being all digitally attached, there still remains that compulsion, that desire, to have a product in physical form. Not to make it too philosophical, but I guess it has something to do with physical possession that re-affirms ownership of an item.
It should be a good while before people fully divest themselves of their need to obtain physical copies of their games or movies, even music. They may be at a downturn, but I don't think media in its physical form will ever disappear.
Electronic Arts themselves recently went full throttle in their digital campaign, opening up their EA Origins. They even got involved in this "mild" tussle with leading online distributor, Steam, over distribution of their games.

It's still not confirmed yet, but it should be a spot of bright sunshine for awaiting PlayStation Vita fans all over.
As rumors would have it, Sony is actually going to send out their downloadable titles for a cheaper price than those being sold at retail. That's certainly good news, particularly because the handheld won't be including a memory card when it ships out to retail.
Much complaining has been made once this bit of news was  confirmed by Sony, and really, it does beg clarification as to why Sony would require it to be a separate purchase, considering that it's an integral part of the system.

It must have been a make or break release for them. News has it that Bodycount developer, Codemasters Guildford, is now set to close shop, just a month after they released the game.
According to reports, the Guildford studio has only 30 days left to operate, finish up whatever it is they have to do, usher the 66 staff affected out the door, and then finally, lock their gates for good.
Said Codemasters in an official statement made to GamesIndustry, "As Codemasters looks to take greater leadership in the racing category, the company is proposing a studio structure that adds resource and strengthens our best-in-class racing teams. The output from the studios on the Warwickshire campus and Birmingham is on the increase with multiple continuing.
Both the Warwickshire and Birmingham studios have won BAFTAs for their critically acclaimed, multi-million selling titles and the company is adding resource to enusre they constantly over achieve in this competitive sector.
Ouch. Suffice to say, the lackluster performance of Bodycount at retail dealt the final blow. Of course, it makes good sense for a company like Codemasters to put their investment where the returns are guaranteed. Unfortunately for the Guildford studio, their performance just wasn't up to par with their mother studio's standards.
Meanwhile, as stated in Codemasters' position, they will be focusing more on the studios working on the racing titles (as this is where the money is, so they say), such as Dirt, Grid, and F1 Online.
Bodycount released in North America just a couple of weeks back to bad reviews, and barely-there presence in the UK charts. To cushion the effect of the shutdown on the staff, Codemasters is encouraging them to instead try their luck in the other studios.

Grasshopper Manufacture is coming out with a soundtrack for Shadows of the Damned, this despite the game not actually selling all too well on shelves.
It seems that the publishers are still hoping to hit gold with this new venture, banking on the reputation of the game's musical composer, Akira Yamaoka. The price, however, leaves a lot to be desired, with the price being tagged at a pretty hefty US$ 30.
From the looks of it, though, there is quite the interest in the soundtrack as the limited first 100 copies, donning the autograph of Yamaoka himself, have already been sold out.
Said Yamaoka, "I wanted to craft a soundtrack that was more than just a collection of the most popular songs from Damned. I set out to create an experience that would take players back to the game, as if they were 'watching' a movie."
If you want one for yourself, then you better hurry, because Grasshopper is only coming out with a very limited 1,000 copies. Yamaoka is also famed for his work on the Silent Hill series.
Shadows of the Damned launched just last June, so there should still be time for them to spark up interest for it. Suda 51 was also quoted as saying that their version of hell in Damned is definitely more fun than the one depicted in Dante's Inferno.

And then we have Saints Row going forwards, and we're expecting to stick with that; Darksiders II is coming next June; the new Metro's coming next summer, which, I think, is terrific; and everything I'm talking about has the potential to be in that category of event entertainment."

The long contest over the legality of former Governor Schwarzennegger's 2005 bill disallowing those under 18 years of age to purchase video games with violent content have now been put to rest.
The US Supreme Court ruled it unconstitutional yesterday, on a vote of 7-2, based on the grounds that it defies the "basic principles of freedom of speech" as well as the First Amendment."
So said the ruling: "Video games qualify for First Amendment protection. Like protected books, plays and movies, they communicate ideas through familiar literary devices and features distinctive to the medium. And 'the basic principles of freedom of speech... do not vary' with a new and different communication medium."
"The most basic principle - that government lacks the power to restrict expression because of its message, ideas, subject matter, or content... is subject to a few limited exceptions for historically unprotected speech, such as obscenity, incitement, and fighting words. But legislature cannot create new categories of unprotected speech simply by weighing the value of a particular category against its social costs and then punishing it if it fails the test."
Apart from that, the Supreme Court also dealt with the issue of connecting video games and violent behavior. According to them, they did not find any conclusive link that will put video games responsible for a person's violent act.
"Any demonstrated effects are both small and indistinguishable from effects produced by other media. Since California has declined to restrict those other media, e.g., Saturday morning cartoons, its video-game regulation is wildly underinclusive, raising serious doubts about whether the State is pursuing the interest it invokes or is instead disfavoring a particular speaker or viewpoint."
This ruling of the Supreme Court definitely is a win for gamers everywhere. But inasmuch as it proves that it does fall under the protection of the First Amendment, it also reiterates the need for parents to make sure they give proper guidance to their underaged children, especially when it comes to the content that they are given access to.
It is true, after all, that violence is not necessarily confined only to video games. Open the TV or the Internet and you see it automatically. Even the most classic literary books may contain violence. In fact, just step out of the house and odds are anyone are potentially exposed to violence. This is the reality that our society today faces. For a government to restrict freedom of speech on the sole probability that someone might get bad ideas is to be a step back.
Again, though, no right is fully absconsced of responsibility. So if you choose to let your kids play with games containing violence - no matter the degree - then at the very least, instill in them the clear delineation that video game is fiction, and not everything they will see in media should be adhered to or emulated.

Publisher EA has set their eyes on the competition, and they've named it to be Activision.
Since they're coming out with Battlefield 3, they've thereby proclaimed Modern Warfare 3 as the obvious competition for it. EA president Frank Gibeau proclaimed that it's "going into a heavyweight fight" with MW3, that Battlefield 3 is, definitely.
And although MW3 may have a "25 million head start", Gibeau remains confident that their game will be able to offer "a generational breakthrough in terms of technology."
Another thing they're looking forward to is the alternation of their franchises so that they can go head to head with the annual CoD franchise. "Battlefield and Medal of Honor will be a part of a rotation that we go after the shooter category with... the Medal of Honor and Battlefield teams are now operating in the same group together so they can share tools, technologies, innovations, without feeling like the same games."
"We have a [Battlefield 3] team that's been together for ten years. The Medal of Honor team was fairly new, they were using middleware and software that had already been out there, so... They're a great team, and we're going to continue to invest in them, but we're going to approach it slightly different than we did before."
