Remember that time Infinity Ward exploded and everyone was super pissed? Well, the legal aspect of that boondoggle is still happening.
The year was 2009. Activision, riding high on the insanely profitable Modern Warfare 2, was looking for ways to keep the profits rolling in and the games rolling out. Infinity Ward, the company behind the massive hit, was looking for ways in which to keep a larger share of those profits. The end result? A massive controversy that resulted in the ousting of two prominent devs.
Vince Zampella and Jason West, co-founders of Infinity Ward and the creative minds behind the Modern Warfare franchise, were either fired from Activision, or they quit. It depends on who you ask. The actions were apparently the result of serious contractual problems, with Activision claiming the devs were up to no good with other studios, while the devs claim Activision was holding back enormous royalty payments to them and the rest of the IW crew.
The whole thing has been rolled up into a lawsuit, which was scheduled to go before a judge on May 7. However, the case is now set for May 29, thanks to a delay request on the part of Activision. The company isn’t yet talking about why it elected to push the trial back, but we’re keeping an eye out for official statements.
There are several big things at stake in this court case. Number one, the enormous royalty payments Zampella and West claim that Activision owes them. Number two, damages ordered by the court. Oh, and number three: Ownership of the Modern Warfare brand.
If West and Zampella win partial ownership of the franchise, they’ll be able to make their own Modern Warfare games. Seriously. Games that would more than likely be published by EA. Activision is naturally fighting hard, so we’ll just have to wait and see where this whole thing goes.

Despite an ongoing rivalry, EA has nothing but positive remarks for the “games as services” philosophy Activision has adapted.
Call of Duty Elite is a premium subscription service that launched with Modern Warfare 3. The service comes with a few perks, such as future DLC packs and advanced clan support. And while many gamers lamented CoD Elite as yet another cash grab, Electronic Arts sees it as an opportunity in the making.
In an earnings call with investors this morning, EA CEO John Riccitiello fired off a quick compliment to Activision, EA’s primary competition in the FPS market. He noted that adding a subscription to an FPS game (MW3) was a “best-in-class performance,” and that EA would be looking for similar ways to further monetize its franchises. Battlefield Elite, anyone?
The “games as services” movement is picking up steam, with companies like Activision leading the charge. Publishers are on the hunt for any method of expanding revenue, and the massive success of CoD Elite has gone a long way towards proving that the subscription model works.

Why Microsoft’s plan to block used games may not be such a bad idea.
Rumors surfaced yesterday, thanks to an insider source, that the next-gen Xbox system currently in development might contain some sort of anti-used game technology. We’re not exactly sure what that means, or how it would be implemented, but the basic gist is that the new Xbox may not play used games at all.
News of this function fired off a massive Internet backlash, with countless commenters railing about how they’d never buy an Xbox 720 (or whatever) if they can’t play used games. And while I certainly agree that limiting your customers’ choices is a very dangerous way to move forward in business, I think that Microsoft may actually be doing the right thing here.
Put aside, for the moment, the arguments against publishers getting cash for used sales. We all know it doesn’t make sense for used games to be treated differently than used cars. The bottom line, however, is that publishers want a slice of that pie, and they’re going to do anything they can to get it. The current solution is the Online Pass, which most gamers would agree is a complete disaster.
Online Passes are engineered to ensure that publishers get a taste of any after-market sale of their games, but mostly serve as enormous headaches to the people that bought the game new. Anyone that had to suffer through Battlefield 3’s ridiculous registration process will know what I mean. And as we move forward, more and more publishers are going to slap Online Passes on their games.
The way I see it, we have two potential used game futures: In the first, every game we buy will have an Online Pass from whatever publisher owns the game, requiring an obnoxious registration code and all the trappings we’ve already encountered. In the second, used games are blocked at the console level, and you purchase your Online Pass directly through Xbox Live or PSN.
Having the console deal with used game access eliminates the need for cumbersome Online Passes, and ensures you have access to Xbox’s support network instead of some random person at whatever publisher happened to make your game. It’s not ideal, but it’s certainly better than what we have at the moment.
I don’t agree with the concept of preventing players from accessing used games, but it’s not like Online Passes are going to fade away. One way or another, we’re paying that money to the publisher – would you rather do it through Xbox Live or a dozen different registration websites?

The maker of World of Warcraft is concerned over the potential security risks posed by the recent hacking of another popular MMO.
We reported last week that Rift, a very popular MMORPG published by Trion Worlds, had suffered a major security breach. The hackers assumedly didn’t get any credit card information, but user passwords may have been compromised. This led Trion to reset the Rift passwords for all users, just to be safe. They also awarded players a special item that awards players 10% more gold when looting, in case they had to take the realms down.
Today, Blizzard fired a message out to World of Warcraft subscribers via its official Twitter account, stating that if you use the same password for more than one game, it may be a good idea to change it. Since Rift password information has potentially been compromised, it’s safe to assume that clever hackers may try that information to access accounts in different games.
Blizzard didn’t call Rift out by name, referring only to “one of the more popular MMOs,” but the message is clear – if you play Rift, make sure your password is safe. If your Rift account and WoW account share similar information, both are at risk regardless of which developer is compromised.
This is an interesting moment for the world of gaming. No matter how amazing Blizzard’s internal security may be, they’re only as strong as their users and the other games those users play. Seems frustrating, from a security perspective.

Tomorrow’s 2GB Battlefield patch brings bug fixes, balance changes, and a few other goodies.
We knew that a Battlefield 3 patch was on the way, and we knew that it resolved a few glaring issues (like the tactical light – get it!? Glaring?!), but the full extent of the patch wasn’t really clear until the full patch notes went public. After a quick glance through, it’s obvious DICE is serious about keeping their game as balanced and fun as possible.
The bulk of the 2GB patch is content for the upcoming Back to Karkand DLC pack, but the rest is all adjustments to existing game mechanics. Among the fixes? A big nerf to mortars, a buff to jet cannons, spawn point adjustment and a ton of tiny tweaks to weapons. Here’s the full list of changes, courtesy of Battlelog:
Bugfixes
• Fixed a problem with spawn timer now showing blue border on startup and lost spawn point
• Fixed a problem where player who joined queuing on End of round got spawn screen stuck on screen, but unable to do anything with it until next round loaded
• Fixed a problem where camera would change to 3rd person on killcam when killcam was turned off in server settings
• Fixed stat references on several dogtags
• Fixed for surveillance ribbon not counting TUGS
• Fixed a missing combat area lines on the minimap for Grand Bazaar conquest small
• Moved a tank spawn in US base on Caspian Border so it would not be destroyed by a falling tree
• Fixed a problem where placing C4 with the russians soldier was playing US faction VO
• Fixed a problem where TV guided missiles could be shot into its own helicopter and destroy it
• Fixed a problem when attempting to fire lock on weapons without a target
• Tweaked the chat, it should now be a bit easier to read
• Fixed several vehicles that did not properly shoot rockets and guns towards their predictive sights
• Fixed the G17 Supressed Laser not working properly
• Added alternate HUD colors to help colorblinds
• Added a network interpolation setting. This allows users with good bandwidth reduce latency, but might increase some stuttering. The user can find what works best for his connection by tweaking the slider.
• Increased the Spawn protection radius on TDM
• Fixed a problem with smoke on land vehicles, Missiles should now miss more often
• Fixed a problem where users could end up with IRNV scope in any vehicle
• Fixed a problem where player dies if vaulting over a ledge and into water while sprinting
• Fixed several crashes and increased general stability
• Fixed a problem where the user was unable to revive two players that have the bodies one over the other
• Fixed so you can assign an axis and use as a digital input. This makes it possible for the player (on pc) to assign one of the sticks on a gameped to be used for throttle/brake.
• Fixed a problem with the Kill camera acting up when suiciding from parachute
• Fixed air radar was showing to much. now lasertagged, heatsignature above threshold, enemy missiles and capture points are only visible on air radar
• Fixed a problem where the game would enter a technical hang if the user pressed pause menu and tilde at the same time
• Fixed a problem where you could get green flashes on screen
• You can now reassign cycle weapons
• Fixed so the weapon zooms automatically after bipod deploy is gone when using zoom toggle
• Fixed a problem where the parachute would stay stuck in air if the owner was killed
Balance Tweaks
• Fixed several weapons so they are properly suppressed and hide the player on the minimap when fired.
• Tweaked Tactical Light so it is not as blinding over longer ranges.
• Tweaked the IRNV scope so it is limited to usage only at close range.
• Reduced heat masking effectiveness of Spec Ops Camo.
• Fixed a bug where Ammo spec would give additional 40mm grenades instead of Frag spec.
• Increased the number of additional 40mm grenades from Frag spec.
• Fixed so AT mines only live for 20 seconds after a player dies to prevent infinite mines.
• Increased the Time to Live on sniper caliber rounds to allow extreme distance shots.
• Fixed several weapon descriptions, calibers, and fire rates. The weapons themselves have not changed.
• Fixed so the M9 and MP443 pistol can be equipped by the opposing faction when it is unlocked at 100 kills.
• Fixed Laser Guided Missiles missing their targets if the target is moving too fast.
• Reduced the effectiveness of Stealth on Air Vehicles.
• Reduced the effectiveness of Beam Scanning for Jets.
• Reduced the damage done to Armored Vehicles and Infantry from AA guns.
• Increased the damage RPGs and Tank shells do to AA vehicles.
• Slightly decreased the accuracy for all weapons on fully automatic, burst fire is now preferable at mid to long range.
• Increased the effective accuracy of long bursts for LMGs when using a bipod.
• Slightly increased the range of the 44magnum bullets.
• Increased the close range damage of 4.6x30mm and 5.7x28mm bullets.
• Increased the reload time of the Mortar from 3.5sec to 4.8sec and increased the time it takes before a shell hits the ground.
• Reduced the aimed accuracy bonus given by a Suppressor for the MP7, P90, PP2000, PP-19, and UMP45.
• Increased the range and FOV for designating targets with the SOFLAM and vehicle Laser Designators.
• Decreased the effectiveness of 12g FRAG ammo when equipped on semi-automatic and automatic shotguns.
• Slightly Increased the power of Fighter Jet Cannons against all vehicle targets, especially Helicopters.
• Decreased the power of Miniguns against Jets and Helicopters.
• Increased the power of Stingers against Jets.
• Flares reload times for Jets and Helicopter Gunners have been increased.
• Tweaked the AN94 so its burst fire better conveys the real world advantage offered by this weapon.
• Added Single Shot to the AN94 as an available fire mode.
• Slightly increased the recoil on the M416 and removed the Burst Fire mode (this weapon incorrectly had burst fire, which was not authentic).
• Tweaked the spawns for TDM on Kharg Island, Grand Bazaar, Caspian Border, Seine Crossing, Operation Firestorm, Damavand Peak and Noshahar Canals
• Moved a tank spawn in US base on Caspian Border so it would not be destroyed by a falling tree
• Tweaked the Gas station Capture area on Conquest on Caspian Border
• Tweaked the max vehicle height on Noshahar Canals

Valve continues their legacy of awesome and free downloadable content by giving Portal fans a way to make their own levels right in the game engine.
The Portal 2 authoring tools have been available for some time, but if you’re like me you probably downloaded them, installed them, fired them up and then immediately shut them off once you realized how overwhelming it would actually be to build a level in the editor. I’ve always loved Halo’s Forge mode, but the authoring tools for Team Fortress and Portal have remained a little out of my league.
It looks like Valve is hoping to change all that, recently announcing that their next bit of downloadable Portal 2 content would include an in-game editor. Valve also indicated that you’ll be able to design levels for both single player and co-op, opening up the depth of design pretty far for amateur level builders. The thought of building a co-op Portal level is absolutely insane to me, but perhaps there are some passionate gamers out the
If you’re not into creating your own levels but still want to get some new challenges for your Portal gun, you’ll be able to play any levels created by users, as well as vote on them based on how much you enjoyed your experience. With a robust player community, this is sure to lengthen the shelf life of the Portal series dramatically – as long as there are new puzzles to solve, you’ll always have something to look forward to.

Here's a surefire way to get Griffin fired up on Gears of War 3. All you have to do is click on one button on Facebook.
Need we give you a hard time to find out what that button is? Of course it's the Like button. Click on that if you want to get the code for Griffin to show up as your multiplayer character via the XBL. Get the code, and you're all set.
Of course, they're not exactly going to be exclusive about it as he will be showing up for free to all Facebook community members anyway come the 20th of September. Still, this opportunity is for those who want to be an early bird, as always.
Rod Fergusson of Epic Games has made it known that they are definitely feeling the pressure of finally ending the Gears of War trilogy. They're definitely working hard at it especially when they've recognized even the App Store as a potential threat to Gears of War 3.

As promised, the long awaited patch for Fallout: New Vegas has been released, updating Obsidian's action/RPG title to version 1.3 with optimizations and stability improvements as well as balance changes.

The layoffs just keep coming. Despite the impressive performance of THQ's Homefront in the market, it has now been confirmed that developers Kaos Studios, as well as Volition (Red Faction, Saints Row), have fired 33 members of their staff.
Said THQ in an official statement, "We have had to let go 16 employees at Volition, our studio in Champaign, Illinois. We must adjust our workforce to fit the studio's current needs, which is a relatively common occurrence in the game development industry."
The layoffs happened a couple of days back, March 29th, with THQ confirming that "both new and long-term employees" were affected by it.
For their part, however, they reassure that "Steps are being taken to ensure team members affected by the transition are treated with appropriate concern. The changes are not expected to affect any current or future titles in development with Volition."
Meanwhile, 17 employees were sacked from Kaos Studios, home of Homefront, leaving the studio with about 70 on staff.
"Kaos has dedicated team in place that will continue to suport Homefront with an ongoing, robust DLC and content plan, as well s working on pre-production for future games."
"We have made changes to ensure that the team sze aligns to the current stages of internal product development."
THQ will also be extending outplacement assistance to help out those who have been laid off.
