Remember that time Infinity Ward exploded and everyone was super pissed? Well, the legal aspect of that boondoggle is still happening.
The year was 2009. Activision, riding high on the insanely profitable Modern Warfare 2, was looking for ways to keep the profits rolling in and the games rolling out. Infinity Ward, the company behind the massive hit, was looking for ways in which to keep a larger share of those profits. The end result? A massive controversy that resulted in the ousting of two prominent devs.
Vince Zampella and Jason West, co-founders of Infinity Ward and the creative minds behind the Modern Warfare franchise, were either fired from Activision, or they quit. It depends on who you ask. The actions were apparently the result of serious contractual problems, with Activision claiming the devs were up to no good with other studios, while the devs claim Activision was holding back enormous royalty payments to them and the rest of the IW crew.
The whole thing has been rolled up into a lawsuit, which was scheduled to go before a judge on May 7. However, the case is now set for May 29, thanks to a delay request on the part of Activision. The company isn’t yet talking about why it elected to push the trial back, but we’re keeping an eye out for official statements.
There are several big things at stake in this court case. Number one, the enormous royalty payments Zampella and West claim that Activision owes them. Number two, damages ordered by the court. Oh, and number three: Ownership of the Modern Warfare brand.
If West and Zampella win partial ownership of the franchise, they’ll be able to make their own Modern Warfare games. Seriously. Games that would more than likely be published by EA. Activision is naturally fighting hard, so we’ll just have to wait and see where this whole thing goes.

It’s been three years since we last visited the NBA Live franchise. NBA Live 10, released in 2009, was the last chance fans of the Live franchise had to get their LeBron James on. While a new basketball title under the name NBA Elite had been planned, it was scrapped back in 2010 after it turned out to be terrible. Since then, players have had to rely on updates to NBA Live 2012 to keep their NBA fantasies alive.
Well, update no more, basketball lovers. EA has announced that it’s bringing the NBA Live brand back this year, with NBA Live 13. According to EA Sports, Live 13 will be a brand new experience that “captures the future” of basketball. Whatever that may mean. Space Jam, maybe?
Details are relatively scant at the moment, but EA has promised an update on the game’s official Facebook page sometime next week. So stay tuned for more information.
In the meantime, you can keep an eye on the EA Sports NBA Twitter for a steady stream of NBA players playing early builds of the new title.

Changes galore await players in Lord of the Rings Online’s Riders of Rohan expansion.
It’s been a few months since Turbine released Rise of Isengard, the latest expansion for Lord of the Rings Online and the most popular add-on ever released for the popular MMORPG. With players chomping at the bit for even more content, Turbine has officially detailed some of what players can expect from its next release, slated for release in fall of 2012.
The new expansion, titled Riders of Rohan, brings several big changes to the Lord of the Rings Online universe. Turbine claims that RoR contains twice as much new content as Rise of Isengard, and while there’s no price detailed, we do have a quick sampling of some of the new features:
Mounted combat
Level cap increased to 85
New zones
New quests
New foes (mounted!)
Lord of the Rings Online has been free-to-play since 2010 and has seen strong performance since making the switch. Turbine doesn’t share its subscription numbers, but it its estimated that over a million players have entered the world of Middle Earth since the game’s launch back in 2007.

The long-delayed sequel to ArenaNet’s popular MMORPG gets another release window and a public beta.
Guild Wars is one of the most popular MMORPGs on the market, selling over six million copies and standing as a shining example of how to run a successful online game without charging a subscription fee. Its sequel, Guild Wars 2, was announced way back in 2007, but has yet to see the light of day.
Fans of the franchise got their first look at Guild Wars 2 back in 2009, and ArenaNet announced that the game would be ready for a 2011 release. Later that year, NCsoft CEO Jaeho Lee pushed the game back to 2011, with a public beta aimed for some time in 2010. Neither came to fruition.
2012 appears, in the words of ArenaNet, to be the year of Guild Wars. Company president Mike O’Brien posted a quick statement on the official ArenaNet blog outlining details of Guild Wars’ development schedule – look for a full release sometime this year, and a public beta starting in March. This beta will expand through the month of April, and fans are encouraged to check in on the official site for further information.

Back in October of 2010, Doom was removed from the Xbox Live Arcade lineup due to expiring rights. When Zenimax expired Id Software, it sort of threw all of the latter company’s franchises into the air. Of course, Zenimax did note that the games would return soon – which apparently means “In about a year.”
If you’ve been patiently waiting for Doom to show up on XBLA again, today is your day. You can download it right this very minute, for the low, low price of $5. It’s sort of amazing when you think of it – with all this innovation and all these million-dollar games, we’re still spending money on the game that basically invented the FPS genre.

Two excellent platformers hit the Nintendo 3DS, just in time for your New Year’s hangover.
The week between Christmas and New Year’s is a sort of gaming dead zone, with very few new titles hitting shelves and most gamers busy working on the titles they received over the holiday. But Nintendo is committed to keeping its weekly eShop release schedule, and actually dropped a pretty decent update here at the end of 2011.
Available now for your Nintendo 3DS are two excellent platformers: VVVVVV and Bionic Commando. The first game, released in 2010, is an incredibly challenging and fun platformer steeped in classic tradition, and the 3DS release marks the first time you can play it anywhere beyond your PC. The second game is actually a port of the original Game Boy version of Bionic Commando, in which you take the role of a super-soldier with a mechanical arm.
Bionic Commando will run you $3.99, while VVVVVV is priced at $7.99. Both are worth a look if you have a 3DS and are looking for an old-school game to play, but it’s worth noting that VVVVVV is only $1.24 on Steam – pick it up for PC if you aren’t worried about keeping it in your pocket.

Limbo has won a zillion awards and was easily one of the biggest XBLA games of 2010. Since its initial success, PlayDead has done everything they can to expand their stranglehold on the indie market, releasing the game on every system to which they can get access.
Limbo is your basic platformer, where your primary goal is to run from one end of a level to another without being killed. But the vague nature of your location and purpose help to create an intriguing experience, not to mention the monochrome visuals and eerie environment. Limbo is one of the most successful games ever released on XBLA, selling over four million copies to date.
Since its initial release, Limbo has been brought to PC and PS3 – it managed to sell more copies than any other PSN game in 2011. As for the iTunes Store, Limbo is priced at a mere £6.99 – more than worth the cost considering the escape it can potentially provide you during this upcoming holiday crush.
Limbo is set for release on Steam in January, officially putting it on almost every popular distribution platform. It’s nice to see an indie developer do so well.

Sony has gotten rid of a lot of features with the PS3. One of the first thing's to go was the backwards compatible feature which would allow users to play PS2 games, which struck a blow for almost all gamers who wanted to continue playing PS2 games. It was a strange move as every other next gen console had BC except Sony. However, this was sorely followed up with the removal of having another operating system on the PS3.
After the removal a class action lawsuit was started and
A judge dismissed all counts except one of the class-action suit protesting the Other OS removal.
Many people bought the PlayStation 3 believing they had the ability to use it however they wished. The option to install a different operating system on the computer - known as the "Other OS" option - enabled users to put Linux or some other open source OS on their PS 3 and basically have a cheap but powerful CPU and GPU combo. Even the U.S. military realized that stringing together PS3s could make you a cheap-ass super-computer. But in March 2010, Sony permanently removed the "Other OS" feature from all PS3s with a firmware update needed to access the PlayStation Network. California resident Anthony Ventura filed a class-action lawsuit stating that the removal was an "intentional disablement of the valuable functionalities originally advertised as available." Today, U.S. District Judge Richard Seeborg dismissed all but one of Ventura's claims.
Judge Seeborg upheld Sony's right to enforce the End User License Agreement or EULA all customers agreed to upon purchasing the PlayStation 3. "These contracts specifically provide PS3 purchasers with a license, not an ownership interest, in the software and in the use of the PSN, and provide that SCEA has the right to disable or alter software features or terminate or limit access to the PSN, including by issuing firmware updates," Sony said in its motion to dismiss the suit.
But the sticking point seems to be the access to the PlayStation Network, and other features. Judge Seebold made it clear that customers who bought the PS3 with the Other OS option enabled could still use the console as is, they just wouldn't be able to access Sony's network as well as play new games or Blu-Rays.
"All of the counts are based on plaintiffs' fundamental contention that it was wrongful for Sony to disable the Other OS feature, or, more precisely, [to force PS3 owners to decide between] permitting the Other OS feature to be disabled or forgoing their access to the PSN and any other benefits available through installing," wrote Seebold in the dismissal. "The flaw in plaintiffs' [argument] is that they are claiming rights not only with respect to the features of the PS3 product, but also to have ongoing access to an internet service offered by Sony, the PSN."
The plaintiffs maintain that firmware update 3.21 doesn't just forbid access to the PSN, but that the main functions of the console are no longer viable. To wit, if you didn't update, you could no longer play new games, play games online, play new Blu-Rays, or even play some older Blu-Rays. So choosing not to update and keep the "Other OS" option alive means that no new purchases are possible and the usefulness of the product is seriously restricted.
At least the judge wasn't completely heartless. "The dismay and frustration at least some PS3 owners likely experienced when Sony made the decision to limit access to the PSN service to those who were willing to disable the Other OS feature on their machines was no doubt genuine and understandable," he said, but unfortunately those emotions have no impact on the legal scope of things.
"As a matter of providing customer satisfaction and building loyalty, it may have been questionable. As a legal matter, however, plaintiffs have failed to allege facts or to articulate a theory on which Sony may be held liable."
Sorry, people. It looks like console manufacturers can change their products' capabilities after you purchase them with no penalty whatsoever.

Did you guys know that people like Call of Duty games? Because Activision is reporting huge profits for the latest entry in the series.
Okay, I promise this is the last news post about how much money Modern Warfare is making. Honestly, I wasn’t even going to post it, but it’s just such a big deal there’s really no way to avoid it.
Activision has reported that Modern Warfare 3 has raked in an astonishing $1 billion in its first 16 days of launch. That’s faster than Avatar, which took 17 days to break a billion after it was released in 2010. The published has also reported that there are over 30 million people playing one version of Call of Duty or the other, making it one of the biggest gaming communities in the world.
As the publisher notes, the CoD community is now larger than the populations of New York, Paris, Madrid, Tokyo and London. Beat that, Battlefield! They also boasted that CoD Elite, the barely-functioning online service launched with MW3, has landed six million players. They compared this figure to sign-ups for Hulu, Xbox Live and Netflix, but I’m not sure that’s a fair comparison considering most of those companies were doing something completely new rather than piggybacking a service onto a successful product.
Like I’ve said before, I’m a Battlefield guy. But, any big success should be celebrated, so hats off to the folks at Infinity Ward for making such a popular game. And also to Activision, for an unmatched marketing blitz.

Sega’s decision to push the game out of its normal schedule results in a big win for players.
The Yakuza series, at first, was updated like clockwork. Sega’s initial design for the franchise was a new sequel almost every year, with Yakuza landing in 2006, Yakuza 2 hitting 2008, 3 released in 2009 and 4 in 2010. It’s a release schedule that shouldn’t be unfamiliar to gamers, especially in 2011, the year of thirds.
But Sega elected to push Yakuza 5 out of its release schedule, which at the time had some gamers concerned about the project’s viability. But Sega’s intent with the extra development time is becoming more clear now that some details on the game have been released to the public.
The producer of Yakuza 5, Masayoshi Yokoyama, has indicated that this game is intended to be the San Andreas of its franchise, i.e. a game that dramatically expands on the precedents set in previous games and creates an entirely new experience in the process. Some things remain, like the core gameplay and the fact that the game is a PS3 exclusive, but almost everything else is being rebuilt from the ground up.
The intent of the developers is to include five complete cities in Yakuza 5 – if you’ve played any of the previous titles, Yokoyama indicated that each city will be similar in scale to Sotenbori or Ryuku. He likens the development process to creating five games at the same time, and I wouldn’t doubt him for a second – cities are very hard to build.
There’s still not much info regarding when Yakuza 5 will actually hit shelves, but for now you can assume it’s quite a ways away. Late 2012 or early 2013 are probably the best-case scenarios.
But, it looks like the game that does land will be a more powerful, more interesting and more impressive version of the franchise.

The first-person shooter juggernaut simply can’t be stopped, earning almost a billion dollars in its first few days of launch.
We knew that Modern Warfare was big. Activision confirmed last week that the Call of Duty franchise has now made more money than Star Wars or Lord of the Rings, and the first-day totals for MW3 were nothing but staggering. And the game just keeps on going.
In a press release issued by Activision early this morning, the company confirmed that the game has made a ridiculous $775 million since launching on November 8th. The game is simply rocketing into the stratosphere.
The game absolutely demolished the week one record for 2010’s Black Ops, which still amassed an impressive $550 million. Call of Duty is enormous, taking up the number one, number two, and number four slots on the Xbox Live play charts (Battlefield 3 is number three).
The game set two new records on Xbox Live, in fact:
• 7 million hours of playtime logged by players over the weekend.
• 2.2 unique accounts logged in to play
• 3.3 players on at the same time
Congratulations to Activision on their success. I’m a Battlefield guy, but when you make a game people love there’s nothing more to do than say “Nice work” and move along.

Two teenage killers are sentenced to life in prison after one of the pair confesses the crime to a World of Warcraft guildmate.
Kruse Wellwood and Cameron Moffat were arrested in 2010 for the rape and murder of one of their teenage classmates. The crime, and young age of the suspects, shocked the Victoria suburbs, as each bit of evidence released to the public has painted a horrifying picture of sadistic teens without remorse.
What’s strange, however, is where that evidence came from.
Once news of the girl’s began to take the focus in local media, the boys became increasingly aware of their online presence. Kruse wanted to share his story and thought that World of Warcraft would be the safest place, since he assumed Blizzard didn’t keep a backlog of chats. He confessed using in-game chat, but unfortunately for him Blizz is more than serious about helping local law enforcement and the confession was quickly entered into evidence.
Using the chat and other online evidence, the prosecution had little more to do than present it to a jury. The case is an interesting tale of the way in which digital media affects our lives – by compiling WoW chat logs, search histories and visited web pages the prosecution was able to come up with 1.4 billion sheets of paper’s worth of evidence.

Despite a hugely successful launch, the game can’t top Black Ops or Modern Warfare 2 for weekly online play. At least, not this week.
Battlefield 3 sold over five million copies in its first week of launch. That’s a pretty successful release from the perspective of EA and DICE, but certainly not anything for Activision to lose sleep over. Now we have a bit more evidence that BF3 may not be quite the CoD killer EA hoped, in the form of the last week’s Xbox Live stats.
Battlefield 3 landed squarely in third place, behind 2010’s Call of Duty: Black Ops and 2009’s Modern Warfare 2. While it’s a bit unfair to compare the numbers for the release week, considering that Battlefield 3 launched on Tuesday and counting starts on Monday, it’s still stark reminder that as far as the imagined battle of the titan goes, Call of Duty is still the king of the roost.
Heres’ the top ten:
Call of Duty: Black Ops
Modern Warfare 2
Battlefield 3
Gears of War 3
FIFA 12
Halo: Reach
Batman: Arkham City
Madden NFL 12
Forza Motorsport 4

Naturally, these numbers are about to take a big hit with Modern Warfare 3 launching on the 8th, so it’s unclear what exactly will happen. My guess is that we’ll see MW3 take the top slot and BF3 take number two, with the other two titles falling considerably as more players pick up either of the new releases.
As for who is going to win the war between juggernauts? Who cares? Just get the game you like and play it. After all, this “competition” is really nothing more than a sharp marketing effort to send droves of people to either of the games – Activision and EA are very much in this together.

As if Bethesda didn’t have enough to do this week, they’ve gone an announced a brand new edition of their 2010 hit.
You’d think Bethesda would be focused entirely on the upcoming launch of Skryim, but naturally they’re a big studio and they can do more than one thing at a time. We’ve just got word that Fallout: New Vegas will have an Ultimate Edition package, set to hit shelves on February 7, 2012. So fellas, if you’re looking for that perfect Valentine’s gift for your imaginary girlfriend, you’re in luck.
New Vegas Ultimate Edition will come with the original Fallout: New Vegas content as well as every downloadable content pack released since the game hit shelves. This includes Lonesome Road, Dead Money, Honest Hearts, Old World Blues, Gun Runner’s Arsenal and Courier’s Stash. The level cap will bounce up to 50 thanks to the new content, and the game will have four new areas: the Divide, Sierra Madre Casino, Big MT research crater and Zion National Park.
Based on what we’ve seen in the past, it sure seems like waiting to buy games is the most financially responsible thing you can do. Why pay $60 for a game, plus $10 per DLC when you can wait a couple of years and get the entire thing for less?
I guess it’s the curse of being an early adopter. Still, I never got a chance to play New Vegas, so maybe now’s the time. Or, well, February.

Dino Patti, head of Playdead Games, says that the current method for marketing and selling games is broken, and has been for quite some time.
Limbo was one of the bigger hits for Xbox’s Live Arcade, PC and PSN in 2010. If you played it at all, you probably still remember some of its haunting imagery – it was just that effective at creating a mood. Now the guy in charge of Limbo’s development company, Playdead Games, is offering his opinion on why direct downloads work, and why the current retail model doesn’t.
Patti’s main thrust appears to be that delivering games via disc just doesn’t make much sense in a world where most gamers can simply download whatever they want from the web. It’s a familiar argument, though Patti does have a bit more experience with digital downloads than most.
Here’s what he had to say:
“"Driving discs in a big van all over the world is really inefficient. I don't understand how anyone can make money out of this. Driving a truck to Japan just to get it delivered to people when they can get it from the net? Hopefully the new consoles will embrace the download space even more."”
Of course, it’s worth noting that Limbo is a tiny, tiny game compared to AAA titles like Skyrim or Battlefield 3. Downloading a 117 MB game is a lot different than downloading a 6 GB game, especially when you consider that here in the states, out of 307 million people, only around 67 million have access to broadband services.
Sony Computer Entertainment’s Kaz Hirai summed up this counterpoint nicely:
“"We do business in parts of the world where network infrastructure isn't as robust as one would hope. There's always going to be requirement for a business of our size and scope to have a physical medium. To think everything will be downloaded in two years, three years or even ten years from now is taking it a little bit to the extreme."
I think we’re headed towards an all-digital world, but it can’t happen until global broadband coverage improves and the cost of console hard drives goes way, way down. Hell, I still have a 20gig drive on my Xbox – just try getting me to download a game.

A tough global economy, falling console sales and a less-than-stellar start for the 3DS lead Nintendo to post its first annual loss since 1981.
Industry analysts have long predicted that Nintendo was going to post some sort of negative financial report in the next few weeks, but it looks like the actual results are even grimmer than experts expected. Over the last six months, Nintendo’s sales revenue has experienced a 40.6 percent decline, or roughly ¥147.4 billion.
The company’s net loss, which landed about ¥2.01 billion in 2010, has rocketed to a staggering ¥70.3 billion, most of which came in the last measured quarter. This sudden boost in losses is likely fueled by the lowered cost of the 3DS, which Nintendo is essentially selling for less than it costs to produce.
Most other costs associated with the brand have stayed steady, indicating that falling sales are the primary factor in the major financial trouble the company is currently experiencing. Revenue in the United States has dropped by around ¥85.9 billion, which amounts to around 58 percent of the total drop in income. Nintendo’s game offerings have certainly been slim in the last few months; gamers would be more likely to purchase Nintendo titles if they had some from which to choose.
On the plus side, the Nintendo 3DS is finally gaining some traction, with a large rush in purchases after the big price drop. 3DS sales are up to a lifetime 6.68 million, compared to the 6.65 million units the original Nintendo DS sold in its first seven months of launch.
As for the future of Nintendo, they’re going to need to come up with a better way to sell 3DS handhelds (namely, games) and to hit a home run with the Wii U or they could be in serious trouble. They’re naturally hoping for a holiday rush on 3DS systems as well as big title games like Skyward Sword and Mario Kart 7, but it’s unclear if this rush will be enough to push them back into safe territory.

Nintendo has been on a roll with announcements for the 3DS and is likely hoping to recoup some of the big losses they’re expecting to post this quarter. Could yet another 3DS color variation be in the works?
A couple of weeks ago, we received confirmation from Nintendo that there were two new 3DS units heading to shelves in the next few months. Both Ice White and Misty Pink are slated for North American release, and fan reaction seems to have been mostly positive. But a leaked flyer from a Japanese games retailer hints at one more possible color variation that remains unannounced: Leaf Green.
The flyer, which included the now-confirmed 3DS Monster Hunter bundle, seems to indicate that the 2012 release of Luigi’s Mansion 2 will be marked with a brand new 3DS color, bringing the total color variations up to five – Cosmos Black, Aqua Blue, Misty Pink, Ice White and Leafy Green.
We know that there are plenty of colors in the works, as Nintendo showcased gold, purple and orange versions of the handheld back at E3 2010. While no official release dates have been provided and updates on new colors have been rare, it’s safe to assume that some of those colors will eventually make it to the States. Nintendo is expected to post large losses for this financial quarter and it wouldn’t be surprising if they chose to scale back their 3DS production until the numbers lined up a little better.
Luigi’s Mansion 2 hasn’t been given an official date of release, so we’re just going to have to wait and see what Nintendo chooses to do. This new 3DS is still in rumor-only status, and could turn out to be one game shop’s strategy for earning a little attention and driving some business to their shop.
Would you be interested in a green 3DS? Personally, I’m waiting for 3DS Lite, or whatever the next iteration is.

Nvidia has just released a set of brand new drivers for their graphics cards that promise a marked increase in performance for today’s Battlefield 3 release.
If you’re one of the many PC gamers that picked up Battlefield 3 today (or last night), it’s fitting to assume you updated your graphics card drivers before you started the install. After all, with the insane problems we saw during the Rage launch, it’s always better to be safe than sorry. If you didn’t, now is the time to get those drivers updated and ensure your system is running at peak performance.
Nvidia card owners are getting a little help from the manufacturer, who has released a brand new set of drivers specifically for the launch of Battlefield 3. The new drivers offer what Nvidia claims to be an 11% improvement in performance, which is more than enough to make or break a heated multiplayer match. With Battlefield 3 being hailed as one of the best-looking PC games ever, it’s only fitting that you’d need to upgrade or update something in order to experience it in its full glory.
Here’s some technical jargon from the Nvidia website:
For Battlefield 3 we’ve improved performance by up to 11% since the release of the GeForce 285.38 beta drivers, have included several compatibility enhancements, a new and improved SLI profile, and a 3D Vision profile. Similarly, Rage has received enhancements since the release of the same drivers, and Batman: Arkham City compatibility has been implemented.
As mentioned, updates contained within the earlier beta drivers have been carried over, such as the many performance improvements made to games --between the release of the 280.26 WHQL drivers and today’s 285.62 WHQL drivers-- when running on our entire range of 500-Series graphics cards.
On the GeForce GTX 580, for example, SLI users can expect to receive frame rate boosts of up to:
• 13% in Metro 2033,
• 8% in STALKER: Call of Pripyat,
• 7% in Civilization V,
• 7% in F1 2010,
• 5% in Crysis 2 with the DirectX 11 Ultra Upgrade enabled,
• 5% in Lost Planet 2,
• And 5% in Mafia 2.

One of the biggest shooter franchises in the world gives a subtle shout-out to another blockbuster franchise.
It’s been about a year since the release of 2010’s Medal of Honor, and fans of the franchise have been patiently waiting for some sort of official update on the newest iteration of the franchise. It’s no secret that a new game is in development, but up until now, details have been relatively limited, with no clear move from developers to announce or showcase anything that may be in the works.
If you happen to pick up a copy of Battlefield 3 tomorrow, you may be able to get a sneak peak at the newest entry in the Medal of Honor series, tentatively titled Medal of Honor 2. The online pass printout included with Battlefield 3 has the Medal of Honor logo emblazoned on the back, complete with the official website. EA can’t release a Battlefield game every year, so they’ll need something up their sleeves when the next Call of Duty game comes out this time next year.
I’m guessing Medal of Honor is the best they can do, but based on what happened the last time around, it’s nowhere near as big of a deal as a new Battlefield. This link to the site is one of the more interesting puzzles of the day, as the Medal of Honor website doesn’t actually have any information regarding Medal of Honor 2 and still seems to be set up the way it was a year ago, so perhaps EA is waiting until the official launch of BF3 to update the site.
We’ll keep you posted as details roll in or if there’s any major update to the website – it doesn’t make much sense to send players to a year-old website with no new information to offer them. I’m curious to see what development team is working on the game; I figured DICE was all locked up with BF3 content.
Can a new Medal of Honor turn the inevitable CoD follow-up into cannon fodder, or will it be too little too late?
