CEO Mark Pincus disagrees with allegations of concept copying, instead preferring the term “evolution.”
Last week, we talked a bit about Zynga’s latest game, Dream Heights. More specifically, we talked about the fact that Dream Heights is a pretty blatant copy of 2011’s official iPhone Game of the Year, Tiny Tower. At least, that’s how Tiny Tower’s developer, NimbleBit, feels.
Zynga CEO Mark Pincus disagrees with NimbleBit’s assertions, and instead believes that Dream Heights is just the next evolutionary step in a long line of tower games. His response, issued in an internal memo, referenced games like SimTower and Yoot Tower as other games that laid the framework for Tiny Tower, which in turn served as the basis for Dream Heights.
For the sake of fairness, here’s a direct quote:
“With regard to Dream Heights and the tower genre, it’s important to note that this category has existed since 1994 with games like Sim Tower and was more recently popularized in China with Tower of Babel in 2009 which achieved 15 million DAUs. On iOS there has been Yoot Tower, Tower Up, Tower Town, Tower Blocks and Tiny Tower. Just as our games, mechanics and social innovations have inspired and accelerated the game industry, its 30 year body of work has inspired us too.”
Of course, SimTower and Tiny Tower are very different games, a point made by NimbleBit’s Ian Marsh in the company’s rebuttal:
“It is a smart idea for Mark Pincus and Zynga to try and lump all games with the name Tower together as an actual genre whose games borrow from each other. Unfortunately sharing a name or setting does not a genre make. The games Pincus mentions couldn't be more different.”
He continued:
“If you take a quick look before "pulling the lens back" as Pincus suggests, you'll find an innumerable number of details in the game that were painstakingly crafted to be identical to Tiny Tower. These are core gameplay mechanics and rules, not similar settings or themes that games in the same genre might share.”
Pincus also took time to address allegations by yet another developer, Buffalo Studios, that the company had ripped off their design for Bingo Blitz to make the upcoming Zynga Bingo. Pincus wrote a missive similar to the original NimbleBit post, complete with picture-by-picture comparisons of how Buffalo actually ripped off Poker Blitz, an earlier Zynga title.
The whole thing is devolving into a running joke where one company says the other copied, and the accused company goes farther back in the books to claim the same about the accuser. One thing’s for sure, Zynga obviously doesn’t feel like what it is doing is wrong.

Restrictive copy protection may make it difficult for you to improve your gaming PC without losing access to your games.
Nearly every games publisher builds an install limit into their games. Put simply, when you buy a game, you are authorized to install it on a certain number of machines before you hit the limit and have to buy a new copy. It’s a relatively fair way to ensure you’re not sharing the game with all your friends or up to some other nefarious purpose, and most gamers rarely encounter the install limits on their software.
Ubisoft, however, seems to have taken a different approach to the situation. It seems that their DRM is tuned to detect hardware changes in the system, which means if you upgrade the graphics card in your computer, the game you’re playing will consider the new card to be a second install. Once you’ve made a few upgrades to your computer, you’ll find your Ubisoft games unplayable as you will have “used” all of your available installs.
The issue was discovered by Guru3D, who was attempting to do graphics card comparisons on the new game Anno 2070. Once the game had been activated on three PCs (the install limit), it refused to boot up if the graphics cards in any of the PCs were switched, instead telling Guru3D that his install limit had been reached.
Thinking this block to be nothing more than an error, Guru3D contacted Ubisoft to let them know what was going on. Their response was not encouraging:
“Sorry to disappoint you - the game is indeed restricted to three hardware changes and there simply is no way to bypass that. We also do not have seven copies of the game for you."
So that’s that - if you want to play Ubisoft games, you are limited to three installs. Changing anything about your hardware setup could potentially count as an entirely separate install, and Ubisoft seems completely content to leave it that way.

Some retailers indicate they’d be willing to share the cash from second-hand game sales, if developers can meet them halfway.
The second-hand games market is booming. Companies like GameStop have made billions simply by buying used games and re-selling them at a markup. And while this strategy is great for the company engaged in the practice, it doesn’t do much for the people that developed the game. When you buy a used copy of Battlefield 3, that profit goes to the retailer – not to EA/DICE.
The issue has caused tension between developers and retailers, with game creators recently starting to include mechanisms like online passes to ensure they get a piece of the second-hand market. The battle has been raging for a while, but it looks like a solution may be on the horizon.
In an interview with MCV, some retailers indicated that they would be more than happy to share the profits from second-hand sales with developers, assuming those developers were willing to offer something up in return. Compensation mentioned included the removal of online passes or lower initial costs for brand new games, both of which make it a bit harder for retailers to churn a profit.
The retailer statements are somewhat hilarious when you think about them – for years, retailers have re-sold products with a devil-may-care attitude, and they’re only willing to negotiate now that their bottom line is hurting. The idea that developers would make some sort of conciliatory gesture towards used game retailers after years of being ignored is pretty out there, but perhaps developers would rather have some used profits than online pass sales.

Icon Games reports that Nintendo forced them to remove Wii-related sales data from their company blog.
It’s not uncommon for indie studios to post sales numbers for their games. Sales figures demonstrate how their game is moving, and help generate a little extra press. But one developer is claiming that Nintendo didn’t take kindly to their efforts to publish WiiWare sales figures.
Icon Games, the London studio behind barroom games like Arcade Pool and Arcade Darts, had listed its cross-platform sales on a public blog – including data for Nintendo’s WiiWare store. Unfortunately for Icon, Nintendo apparently contacted them and requested that the information be removed.
The claims were made in another official company blog, in which Icon questions Nintendo’s reasoning for removing the numbers and claims that disallowing public sales data makes it harder for them to run an effective business. While this may be a stretch, it is a bit puzzling as to why Nintendo wouldn’t want developers sharing sales numbers.
As for Icon’s posts, it’s a rambling mess that manages to posit that Nintendo’s refusal to allow the publication of sales figures would somehow prevent a developer from securing a small business loan, or stop them from being able to accurately plan their financial future.
Honestly, both sides of this argument look ridiculous. Nintendo should allow people to publicly share sales figures, and Icon should stop pretending like the inability to publish numbers on a blog is the same thing as not being able to see them. Surely they don’t bring screencaps of their blog to the bank to convince the bank of Icon’s financial solvency.

The gaming giant looks to enter the streaming business with a unique revenue model. But will it work?
There have been buzzings regarding GameStop’s intention to enter the video game streaming market, but no concrete details. Some analyst expected them to launch a cloud-gaming service similar to OnLive, while others expected them to develop a device that takes customer’s wallets right out of their pockets as they enter the store.
The service they’ve actually announced works a little differently than either of those ideas, though, and seems to be a completely new idea in terms of streaming service.
The basic gist of the service is this: you purchase a game at GameStop, and if you subscribe to their streaming service, you’ll be able to access that game from other computers or devices. Basically, you pay a small stipend on every game your purchase in order to preserve access to it if you don’t happen to be near your Xbox or PlayStation. It’s a different way to approach the idea of game sharing, for sure.
The service is currently in beta and aimed at a 2012 release, but honestly it sounds a bit strange. How, exactly, is GameStop going to stream Battlefield 3, Modern Warfare 3 or Skyrim to me if I’m not by my Xbox? I’m interested to see what they have up their sleeve, but I can’t say I’ll be taking part.
What do you think of the GameStop streaming service as it’s laid out? Would you sign up for it, or are you GameStop-averse like me?

Microsoft’s slick new Xbox dashboard has an official release date, and it’s very, very soon.
The original Xbox 360 dashboard left a lot to be desired, but it had a certain charm. Over the years, Microsoft has tuned and re-tuned the dashboard to make it easier to use and, more importantly, easier to sell you things like movies, apps and downloadable content.
The latest version of the dashboard, now titled “Metro,” is scheduled for launch December 6th and brings with it a whole slew of new features and options.
The dashboard boasts full Kinect support, Bing voice search, Beacon-marking, sharing of achievements to Facebook and plenty of other new features. Additionally, expect to see the early versions of Xbox TV or whatever they’re calling it, with a variety of service providers bringing their programming directly to the dashboard (for a small fee, of course). Microsoft updates the providers based on contractual obligations and regions, so look around for specific info regarding what you’ll actually be able to access.
One major point in the update notes: the addition of cloud saving for all Xbox Live Gold members. The benefit here is that you can back up your game saves to the Microsoft cloud, allowing you to share them across consoles – a much-needed feature, especially as our poor little HDDs get filled up.

Today is your last day to buy games at the old five-system share rate. New Game limits are in place when the service comes back online.
We discussed Sony’s recent decision to change the game sharing limit from five games to two a few weeks back, and (judging from the comments) people didn’t seem too happy about the new policy. Regardless of booming customer complaints, Sony is moving forward with the plan and will take PSN down from 8am to 10pm (PST) tomorrow to implement the update.
This means if you want to buy games that still fall under the old five-game limit, you need to buy them before the service goes down tomorrow morning.
Sony is calling the 14-hour downtime “routine maintenance,” but it certainly seems like a long time for their online service to be off-limits. I don’t own a PS3 so I’m unfamiliar with their maintenance routine – please let me know in the comments if this is something they do frequently.
During the downtime, you won’t be able to access the PlayStation Store, Account Management or create new accounts, and you won’t be able to access your account via the web. Here’s one strange thing though, Sony indicates in their official blog that “some users” may still be able to play online. Some?
There’s also a PS3 firmware update included in the maintenance, but details are scant. We’ll keep you posted as we get more information.

If you’re looking forward to transferring your UMDs from one device to the other, you’d better make sure your accounts are in order.
Last week, Sony announced that PSP owners would be able to move UMD content from their PSP devices directly to their Vitas (for a small fee, of course) through a service they’re calling “Passport.” The announcement was welcome in the PSP community, since it means replacing your massive UMD collection wouldn’t mean re-purchasing everything you already have.
However, there’s one important catch that’s worth noting before you start jumping for joy: transfers are tied to one PSN account.
Here’s the basic gist of what’s going on: if your UMDS are registered to a different account than your PS Vita, you won’t be able to move any of that data to the device. Everything, including the PSP, Vita, and UMD content, must be registered to a singular PSN account to be eligible for transfer. This probably won’t hurt a majority of gamers, but a few more hardcore folks, or people that have gone through more than one account, may find their content library split between devices.
Sony has been on an anti-sharing tear lately; we’ll just have to see how the player community reacts. What do you think about the Passport program?

PlayStation 3 owners are about to lose one of the system’s best features – the ability to share PSN games with up to five other devices.
Sony just announced that the PSN share limit is changing from five devices to two as of November 18th. Any content purchased on or after that date will only be available for sharing across two devices, a stark change from the previous policy. You’ll still be able to play two PSPs and two PS3’s, bringing the potential total to four, but that’s only for games that can operate on both systems. Otherwise, you’re stuck with just the two.
To clarify: PSN games downloaded after November 18th can be shared to two PS3 systems and two PSPs, down from the original number of five. Sony is also adding a web tool that finally allows you to deactivate your account from old systems, saving you the hassle of a long customer support call in the event that your PS3 fails and you need to recover your games on a new console.
Game sharing was always one of the more interesting things that PSN brought to the table, allowing you to “bring” games to your friend’s house or share them with a family member’s account when you were home for the holidays. While reports of abuse certainly came up, most gamers probably used the system exactly as intended.
Paring down the total number of systems probably won’t impact too many people, but it’s still a strange thing to do so far into the development cycle. The comments section of the PlayStation blog shows a pretty clear resistance to the idea, so we’ll just have to see how it plays out.

Backlash over the insertion of class-action prevention clauses leads a group of gamers to build a site that helps other people opt-out of these rights-limiting agreements.
In a recent software update, PSN inserted a clause that prevents gamers from participating in a class-action lawsuit against Sony into the EULA. Many gamers saw it as a shady response to the recent lawsuits filed over the PSN privacy breach, and if you accepted the new EULA agreement when you updated your PS3, you’ve already waived your right to participate in a similar lawsuit if your information is compromised again.
In order to opt-out of the clause while still accepting the EULA (and thus, being allowed to use PSN), you have to mail a physical letter to the Sony legal department. Obviously, Sony is banking on the idea that most people are going to accept the EULA without reading it, and won’t find out about the rights they’ve waived until something goes wrong. However, a group of Redditors incensed over the change has created GamersOptOut.com, a site designed to help gamers opt out of these rights-hampering clauses.
The site currently allows you to choose which EULA you have an issue with, either Sony/PSN or EA/Origin. You’ll have to enter your account name and a few personal details, and the site will generate and send your opt-out letter on your behalf. You can donate money to the cause if you want, but all letters are free of charge.

Yes, European PS3 gamers can now look forward to getting classic PS2 titles on their consoles.
This exciting news was confirmed by SCEE earlier this weekend, saying, "The Only On PlayStation Network programme is for the SCEA region only."
"However, we will be bringing the majority of the content to the SCEE audience, including Classic PS2 titles." We don't know as of yet if "Classic PS2" will be the official term coined for it, but if that's the case, then it's plain, simple, easy to understand, and rather succinct, so there should be no problem with that.
On top of that, however, SCEE furthers, "We have numerous exciting offers that we will be introducing to PSN users throughout our region in the lead up to Christmas and look forward to sharing these with you."
As to what these offers could be,  price cuts in the games woudn't hurt, although it might be quite the stretch in the wish list already. Now just keep it posted here, we'll be sure to update you on what are the titles enlisted under the Classic PS2 programme as soon as SCEE sends out official word on it.

The developer shares that this brew was originally designed as a joke to a friend, but eventually, it became a full-fledged project, sporting an MP3 player, an image viewer, as well as two games: 3D Pong and Tetris.
All in all, not bad for a joke!
Here are the important things to know about this brew:
Applications and Games:
Music Player: Great application in which we can hear the songs that comes by default WiXP.
Viewer gifs: One of the applications that make it a great homebrew, since we can see several gifs that brings aplicacón default.
3D Pong: One of two games. Is in 3D and have a single player mode for two players and one (sharing the same console), what more could we ask?

WWE '12's roster is still pretty much tight under wraps for the most part, with a "mystery superstar" still being a mystery. Fans are quick to surmise Goldberg's going to be it, but now it's been confirmed by THQ that it's not going to happen.
Creative Director Corey Ledesma had earlier teased that the said wrestler will be the one to add to the list, but now it seems that Goldberg's just been ticked off the list, if his bashing comments on Twitter towards WWE is any indication.
Said Goldberg, "It ain't WWE, they can kiss my ass." Fans would know that talks were supposed to be warming up getting Goldberg back into the ring. With that tweet, it's obviously not even a consideration at this point.
To this, THQ's Community Manager finally stepped up to the plate and offered an official statement in behalf of the publisher: "He will not be in the game, let's move past this, apologies, not this year."
Although Goldberg will no longer be sharing the action in WWE 12 for the PS3, Wii and Xbox 360, THQ is reassuring that there will be better crowd sounds in the game. They've also previously sent out this trailer for the game.

Xbox 360 fans will have to wait till next year before they can get their hands on The Witcher 2.
CD Projekt confirmed that they have decided to push back the release date from the originally intended late-2011 window, purportedly to have more time to polish the game.
Explained CDP boxx Adam Kicinski, "The extra time will allow us to polish the title to perfection, so that the game offers an ideally balanced, fantastic experience to gamers. As the launch of the game approaches, we will be sharing more details how it will be released on Xbox 360. I trust that despite the release date shift, players will be satisfied with what we are planning for them."
But of course, we all know that another issue affecting the release of The Witcher 2 on the Xbox 360 is their ongoing legal tussle with Namco Bandai over the game's publishing rights on Microsoft's console. In the meantime, the PC version has been enjoying its run for a while now, and has in fact recently received a shiny new patch to beef up the experience for it.
