PS3 "Other OS" case thrown out of court.
Judge musn't be a Linux user.
Sony has gotten rid of a lot of features with the PS3. One of the first thing's to go was the backwards compatible feature which would allow users to play PS2 games, which struck a blow for almost all gamers who wanted to continue playing PS2 games. It was a strange move as every other next gen console had BC except Sony. However, this was sorely followed up with the removal of having another operating system on the PS3.
After the removal a class action lawsuit was started and
A judge dismissed all counts except one of the class-action suit protesting the Other OS removal.
Many people bought the PlayStation 3 believing they had the ability to use it however they wished. The option to install a different operating system on the computer - known as the "Other OS" option - enabled users to put Linux or some other open source OS on their PS 3 and basically have a cheap but powerful CPU and GPU combo. Even the U.S. military realized that stringing together PS3s could make you a cheap-ass super-computer. But in March 2010, Sony permanently removed the "Other OS" feature from all PS3s with a firmware update needed to access the PlayStation Network. California resident Anthony Ventura filed a class-action lawsuit stating that the removal was an "intentional disablement of the valuable functionalities originally advertised as available." Today, U.S. District Judge Richard Seeborg dismissed all but one of Ventura's claims.
Judge Seeborg upheld Sony's right to enforce the End User License Agreement or EULA all customers agreed to upon purchasing the PlayStation 3. "These contracts specifically provide PS3 purchasers with a license, not an ownership interest, in the software and in the use of the PSN, and provide that SCEA has the right to disable or alter software features or terminate or limit access to the PSN, including by issuing firmware updates," Sony said in its motion to dismiss the suit.
But the sticking point seems to be the access to the PlayStation Network, and other features. Judge Seebold made it clear that customers who bought the PS3 with the Other OS option enabled could still use the console as is, they just wouldn't be able to access Sony's network as well as play new games or Blu-Rays.
"All of the counts are based on plaintiffs' fundamental contention that it was wrongful for Sony to disable the Other OS feature, or, more precisely, [to force PS3 owners to decide between] permitting the Other OS feature to be disabled or forgoing their access to the PSN and any other benefits available through installing," wrote Seebold in the dismissal. "The flaw in plaintiffs' [argument] is that they are claiming rights not only with respect to the features of the PS3 product, but also to have ongoing access to an internet service offered by Sony, the PSN."
The plaintiffs maintain that firmware update 3.21 doesn't just forbid access to the PSN, but that the main functions of the console are no longer viable. To wit, if you didn't update, you could no longer play new games, play games online, play new Blu-Rays, or even play some older Blu-Rays. So choosing not to update and keep the "Other OS" option alive means that no new purchases are possible and the usefulness of the product is seriously restricted.
At least the judge wasn't completely heartless. "The dismay and frustration at least some PS3 owners likely experienced when Sony made the decision to limit access to the PSN service to those who were willing to disable the Other OS feature on their machines was no doubt genuine and understandable," he said, but unfortunately those emotions have no impact on the legal scope of things.
"As a matter of providing customer satisfaction and building loyalty, it may have been questionable. As a legal matter, however, plaintiffs have failed to allege facts or to articulate a theory on which Sony may be held liable."
Sorry, people. It looks like console manufacturers can change their products' capabilities after you purchase them with no penalty whatsoever.

Portal’s memorable villain makes a cameo in the tower defense title’s upcoming expansion.
If you haven’t played Defense Grid, you should stop reading this now and go download it. Seriously, I’ll wait. Defense Grid is the perfect example of tower defense done right – just enough features to make puzzles challenging, but not so many to feel over-complicated. Trying to earn medals on the final levels of the game can be incredibly frustrating, but the game is brilliantly done and well worth the price.
Hidden Path, the company behind Defense Grid, has another reason for you to buy their game: The You Monster expansion, released to Xbox Live Arcade and Steam earlier today. This new story expansion comes complete with 35 new challenge missions and 8 new maps, plus a visit from a very special guest.
The company says that in addition to battling the familiar hordes of alien invaders from the original Defense Grid release, players will also have to face off with GLaDOS as she works to make your job all the more difficult. The game is available for 800 MS points, or $9.99 on Steam.
I’m not exactly sure how GLaDOS fits into the Defense Grid story, but I really hope they got Ellen McLain to record her voice. The voice acting in Defense Grid is pretty good, considering it’s just a little tower defense game, and GLaDOS just isn’t the same without the voice.
How do you feel about cross-game mash-ups like this one?

The PC version of this quirky strategy game is getting an expansion, titled “Lost Adventures.”
Orcs Must Die! is the perfect story of what a small developer can do with a fun idea and the right game mechanics. The game, which takes the concept of tower defense and combines with with a third-person action game, has been a remarkable success in every market it enters, and critical praise has been as high as player enthusiasm.
If you’re a fan of Orcs Must Die! but haven’t had your fill of killing monsters, you’re in luck – the Lost Adventures DLC pack is on its way November 8th. Sadly, this update will only be available to PC players for the time being, so if you downloaded the game on Live Arcade or PSN you’re going to have to wait.
This is the second such DLC for Orcs Must Die! and includes five new fortresses, to new enemy types, the implementation of a leaderboard and a few other bonuses as well. The DLC will be priced at $2.99.
Have you played Orcs Must Die!? Are you excited to see the game getting steady content?

Miami holds the top slot despite losing the NBA championship to the Mavericks – who are somehow ranked #5.
Team rankings in sports video games have rarely been 100% accurate, and it looks like this trend is continuing in 2K Sports’ newest iteration of the “NBA 2K” franchise. While the Mavericks managed to crush the Heat in the finals earlier this year, 2K Sports has them ranked in fifth place overall in “NBA 2K12.” Taking the top spot is the Miami Heat, who also has the best player in the league – LeBron James.
I know the rankings in “2K12” are aimed more at a team’s potential in the upcoming season, but it seems like a pretty big leap to drop Dallas from the best team in the league to number five. Then again, I’m not great with basketball, so maybe 2K Sport knows something that I don’t.
Here’s a full list of the teams and their respective rankings, courtesy of JustPushStart:
Miami Heat (1st Defense, 3rd Offense, 1st Overall)

Magic Dream Games brings their quirky tower defense game to the iPad and iPhone, and in honor of the games they have planned for next month, it’s completely free of charge.
The iPhone and iPad seem uniquely suited for tower defense games. Maybe it’s the touch interface, or maybe it’s the way you can jump into a tower defense game for small chunks of time, but it’s safe to say the genre is doing well on the platform. “Monster Trouble” has been out since February of 2011 and has seen glowing reviews and a fair sales volume, and now you can try it for yourself without risking any of your hard-earned coin.
The events of Monster Trouble revolve around you and your townsfolk working to protect your humble hamlet from the encroaching forces of evil and destruction. The invading army is comprised of goblins, ogres, and other monsters you’d recognize from games with a fantasy setting. “Monster Trouble” is a bit different from other tower defense games in that you first build defensible buildings, and then work on placing towers.
There are ten unique types of tower, but players only have access to three during any particular game. As with other tower defense games, the placement of your towers is often as important as the type of tower you use, since lines of towers can work as traffic blocks against angry invaders.
When you start the game you’ll have access to nine separate maps, but over time you’ll unlock new maps featuring new challenges. If you’re looking for a new game for your iOS device but you’re on a tight budget, it’s worth downloading “Monster Trouble” and giving it a test drive. The worst-case scenario is you burn some time you would have spent checking Facebook or ignoring work you should actually be doing.
Be sure to let us know what you think of the game in the comments!

Randy Pitchford is selling Aliens: Colonial Marines to the hilt, even comparing it to the blockbuster zombie game of Valve, Left 4 Dead, saying that their game is definitely "more crafted" than that one.
Said Pitchford, "I think parts of it feel a little like [that], but Left 4 Dead was very dependent upon the game system. There wasn't any real story telling or character development or anything at all to do in Left 4 Dead other than to run to the exit and not die along the way.
Aliens: Colonial Marines is a much more crafted and cinematic experience. It also has a deeper meta-game where there is some value to gaining experience and growing the capability of your character overtime. Left 4 Dead is a great thing to think about when considering how it works as both a single player and co-operative game where you're playing against hordes of fearless, death-dealing enemies. But it's not really a good example when you think about a crafted, narrative experience or when you think about how meta-growth game can make playing your favourite missions again really fun and compelling."
In defense of Left 4 Dead (I am a huge fan, obviously), I don't think it ever promised a meta-experience of gaming. As far as its basic plot is concerned, I think it delivered on what it set out to do: put you in the position of someone out to survive at all costs. And really, when you have a horde of zombies after you, you don't have much time to philosophize about character growth. You just shoot away. It's the basic tenet of survival, and one that L4D unfrivolously delivers.
But anyway, if Aliens: Colonial Marines is "more crafty", then it should be a fun game to look out for.
The game is also promising to answer questions about the movie, so if you're looking forward to that, then it really should be a must-buy/ must-play title. Gearbox also takes much pride in the fact that they've provided gamers with a lot of freedom in the game.

"The slaying hour is nigh upon us!" This was the battlecry of Robot Entertainment CEO Patrick Hudson upon announcing the release dates of Orcs Must Die! for both the PC and Xbox 360.
"We can no longer restrain the enemy at the game. We will soon turn the rift defense over to Xbox and PC gamers to beat back the mob and save the Order!"
That is quite the mission right there. Orcs are coming in droves, and, well, we must keep them at all costs from getting past our defenses. You all are therefore called to duty beginning October 5th, 2011, at least if your fort is on the Xbox 360. Those on the PC, however, will have to wait it out a bit longer, until October 12th, before the fighting begins.
It was originally thought to be coming out to retail by July, but that obviously didn't happen. Instead, it spent the last couple of months going from the Comic-Con to Gamescom, and then now, it's headed for retail stores for real.

Rock of Ages started rocking out on the PSN and XBL last week, but ACE is not done teasing for all those who have yet to get their hands on their brand new Tower Defense game.
Rock of Ages features the Greek mythological figure, Sisyphus, who was punished with an eternal curse that has him rolling up a giant boulder up a hill, only to have it roll back down upon reaching the top. In the game, you're pretty much tasked to do the same thing, except that your challenge is doubled with obstacles such as facing off against historical commanders and engineers. Oh and instead of rolling up the boulder, you're supposed to roll it down towards your enemies, because, hey, it is a tower defense game, and you have to defend your tower.
Steam players still have to wait a couple more days before it gets out for the PC, on September 7th. Europeans, too, will have to wait until further notice before they can find out when it will be coming to their PSN, XBL and PC platforms.
In the meantime, do watch this launch trailer for Rock of Ages.

These images were probably meant to come out to Gamescom, happening next week, but apparently, some people just can't wait. Anyhow, there's more to look forward to at Gamescome for DotA 2, what with "The International" tournament also taking place in Cologne.
16 DotA teams, known to be the best in the world, will in competition for the grand prize of a cool US$ 1 million cash.

You weren't expecting this, for sure, but you were definitely hoping for it at the back of your mind.

Contrary to the previously reported July 20th release of Candygun's zombie title, Dead Block, it's instead coming out a day sooner.
That gets you a day closer to having your fill of knocking them undeads dead. For those of you still not familiar with Dead Bloc, it's "a 1950's Horror B-Movies inspired action defense game."
Obviously, it's going to be set in the 1950s, and there will be loads of zombies for you to aim those weapons at. One thing that will separate Dead Block from other zombie titles is that it "doesn't take itself too seriously; humor is a big part of the game's presentation."
Apart from the game itself coming on the PSN, Candygun Games will also be releasing a spcecial Dead Block theme for the PS3 owners, as well as a demo for it.
Game should be out in but a few hours, so keep your eyes peeled for it on your PSN. In the meantime, do enjoy this video of the game to give you a better idea of how it will play out.
