Why the innovative games company is headed for failure.
Nintendo is, by most accounts, one of the most innovative forces in the world of gaming. The company lays claim to breakthroughs like force-feedback technology, motion control, z-targeting and a whole host of other now-standard gaming mechanics. Unfortunately, Nintendo’s days of leading the pack are quickly coming to a close.
Nintendo has always performed well in the games marketplace because of its exclusive titles and accessible technologies. However, games aren’t really the future of the games industry. In 2012 and beyond, it’s not games that sell devices, but their multimedia capabilities. One of the fastest-growing groups of console owners is made up of people who primarily use their devices to watch Netflix, listen to music or rent movies.
Nintendo has failed to keep pace with its competitors in the realm of multimedia. And it has also failed to keep pace when it comes to online gaming (friend codes, seriously?). If the Wii U can’t make some major improvements to the way Nintendo delivers multimedia content and online gameplay, it’s simply not going to be the console of choice.
Consumers always flock to the device that provides them the most value. A large number of PS3 sales can be chalked up to Blu-Ray support, just as a large number of Wii sales can be chalked up to the initial hype concerning motion control. In the next console generation, the device with the most utility wins.
If Nintendo fails to recognize this trend, it’s going to find itself toppled from the throne faster than it can say “3DS Lite.”

Blu-Ray, used games and Kinect, oh my!
We talked earlier about the rumors regarding the next Xbox and its processing power, but interesting tidbits continue to slip out over the course of the news day. Thanks to a few anonymous sources, we now have some more information regarding the Xbox 720, or whatever they’re choosing to call it. One note, before we begin: This information has been in no way substantiated by Microsoft, and should be taken with a grain of salt.
With the disclaimer out of the way, here’s the scoop on the next Xbox console. According to information retrieved by Kotaku, the next Microsoft console will boast full Blu-Ray support – a major selling point for the PlayStation 3 over the last few years. Additionally, the new Xbox may be shipped with the second iteration of the Kinect hardware, currently referred to as Kinect 2. The hardware is already being manufactured, and will see release in 2013.
The most interesting bit of news, however, has to do with used games. One industry source has noted that Microsoft is considering building an anti-used system into the new Xbox, one that would make playing used games effectively impossible. There are no details on how exactly this would be implemented, but it’s sure to be a hydrogen bomb of controversy if the rumor is true.
Regardless of speculation, it looks like we’ll be seeing the new Xbox and its Sony competitor sooner rather than later. Microsoft has, of course, refused to comment on any of the stories breaking this week and certainly hasn’t confirmed any leaked details.

Today has been an interesting day for Vita news. First, we got an idea of how expensive the device’s memory cards were actually going to be (read: not very). Now, we have a confirmed and official list of every game that will be available at launch. And the list is pretty long, especially when compared to some other launches.
Some of the games are likely not going to be great, but the presence of Uncharted and Hot Shots Golf are enough to ensure Sony sells at least a few thousand devices. And hey, who doesn’t love Katamari?

Sony has gotten rid of a lot of features with the PS3. One of the first thing's to go was the backwards compatible feature which would allow users to play PS2 games, which struck a blow for almost all gamers who wanted to continue playing PS2 games. It was a strange move as every other next gen console had BC except Sony. However, this was sorely followed up with the removal of having another operating system on the PS3.
After the removal a class action lawsuit was started and
A judge dismissed all counts except one of the class-action suit protesting the Other OS removal.
Many people bought the PlayStation 3 believing they had the ability to use it however they wished. The option to install a different operating system on the computer - known as the "Other OS" option - enabled users to put Linux or some other open source OS on their PS 3 and basically have a cheap but powerful CPU and GPU combo. Even the U.S. military realized that stringing together PS3s could make you a cheap-ass super-computer. But in March 2010, Sony permanently removed the "Other OS" feature from all PS3s with a firmware update needed to access the PlayStation Network. California resident Anthony Ventura filed a class-action lawsuit stating that the removal was an "intentional disablement of the valuable functionalities originally advertised as available." Today, U.S. District Judge Richard Seeborg dismissed all but one of Ventura's claims.
Judge Seeborg upheld Sony's right to enforce the End User License Agreement or EULA all customers agreed to upon purchasing the PlayStation 3. "These contracts specifically provide PS3 purchasers with a license, not an ownership interest, in the software and in the use of the PSN, and provide that SCEA has the right to disable or alter software features or terminate or limit access to the PSN, including by issuing firmware updates," Sony said in its motion to dismiss the suit.
But the sticking point seems to be the access to the PlayStation Network, and other features. Judge Seebold made it clear that customers who bought the PS3 with the Other OS option enabled could still use the console as is, they just wouldn't be able to access Sony's network as well as play new games or Blu-Rays.
"All of the counts are based on plaintiffs' fundamental contention that it was wrongful for Sony to disable the Other OS feature, or, more precisely, [to force PS3 owners to decide between] permitting the Other OS feature to be disabled or forgoing their access to the PSN and any other benefits available through installing," wrote Seebold in the dismissal. "The flaw in plaintiffs' [argument] is that they are claiming rights not only with respect to the features of the PS3 product, but also to have ongoing access to an internet service offered by Sony, the PSN."
The plaintiffs maintain that firmware update 3.21 doesn't just forbid access to the PSN, but that the main functions of the console are no longer viable. To wit, if you didn't update, you could no longer play new games, play games online, play new Blu-Rays, or even play some older Blu-Rays. So choosing not to update and keep the "Other OS" option alive means that no new purchases are possible and the usefulness of the product is seriously restricted.
At least the judge wasn't completely heartless. "The dismay and frustration at least some PS3 owners likely experienced when Sony made the decision to limit access to the PSN service to those who were willing to disable the Other OS feature on their machines was no doubt genuine and understandable," he said, but unfortunately those emotions have no impact on the legal scope of things.
"As a matter of providing customer satisfaction and building loyalty, it may have been questionable. As a legal matter, however, plaintiffs have failed to allege facts or to articulate a theory on which Sony may be held liable."
Sorry, people. It looks like console manufacturers can change their products' capabilities after you purchase them with no penalty whatsoever.

The days of three-point something something have come and gone – it’s time for the fours.
It seems like we just got a PS3 firmware update, but time flies in the world of games. As of today, you and your fellow PS3 owners can pick up the latest and greatest version of the PS3’s firmware, titled v.4.00. It’s been a long time coming, but it’s finally here – assuming firmware is a thing you eagerly anticipate and not a thing that renders your PS3 useless.
The PlayStation blog offers a few details on what you can expect from this new and improved firmware. Vita compatibility has been included, allowing you to share content from the device to your PS3. Here’s one cool thing: if you have a PlayStation Plus membership, you’ll be able to disable or enable automatic updates for patches, system software and trophy information syncs. Pretty handy, eh?
There are a number of other things being added, including privacy features, cinema conversion for Blu-ray and a couple of localized language options. All in all, this seems like a pretty straightforward software update without too many bells and whistles.
There’s no word on whether the new firmware breaks any of the existing (or leaked) hacks for the 3.73 firmware, so it’s probably a roll of the dice for those of you with modded consoles.

The PS3 launched in 2006 and we’ve seen plenty of great titles in the last five years, but is it time to retire the current console generation?
When the original PlayStation 3 console launched in 2006, it represented the bold future of gaming hardware. Slightly more advanced than the Xbox 360 and boasting a built-in Blu Ray player, the PS3 floundered for a bit early on due to its high price point, but eventually became a sharp competitor to the Microsoft brand with exclusive titles like Uncharted and Grand Turismo.
But now it’s 2011 – isn’t it about time Sony started talking about the PlayStation 4? Nintendo has already announced its next console in the form of the Wii U, and there can be no doubt that Microsoft and Sony are both hard at work on the hardware that will eventually become their new system – but where are the details?
Analysts have predicted that the PS3 could stay strong until at least 2015, so it stands to reason the Xbox could likely make it that far as well. But the question here is whether gamers will want to play a nine-year-old console in the face of PC innovation. Already, games like Arkham City and Battlefield 3 are absolutely eclipsing their console competitors – Sony and Microsoft need to do something if they want to stay up to speed.
Developers already have to “dumb down” their content for consoles; as the hardware ages this process will be have an increasingly negative impact on the development process. Eventually we’ll hit a point where a virtual chasm exists between PS3s and PCs, if we’re not there already. A new console may not make perfect sense for companies with two decent performers, but it’s in the best interest of the industry that consoles move forward every few years.

Exclusive PlayStation 3 content promised at Sony’s E3 media briefing seems to have vanished into the wind, all for the sake of early DLC access.
If you were paying close attention to Jack Tretton (head of SCEA) when he took the stage at E3 this year, you may remember him talking about some pretty cool PlayStation 3 exclusives. One such exclusive, according to Jack, was the inclusion of DICE’s classic shooter, Battlefield 1943 on every Blu-Ray copy of Battlefield 3.
Essentially, PS3 owners were told that when they bought Battlefield 3, they’d be getting an entire second game for free. It makes sense for the title to be a PS3 exclusive; Battlefield 3 barely fits on two Xbox 360 discs and there probably isn’t much room to cram an entire other game in there. However, astute players that picked up BF3 yesterday noticed that Battlefield 1943 doesn’t seem to be on their disc, and took to Twitter and support forums to figure out exactly what happened.
If you’re one of the many PS3 owners trying to sort out where your Battlefield 1943 went, you can stop looking – it’s not on the disc. DICE worked out a different deal with Sony, trading the inclusion of the game for early DLC access for PS3 owners.
Here’s an official tweet from DICE that sums it up:
“In lieu of 1943 being available on disk for PS3 customers, EA has made all BF3 expansions available early to PS3 customers.”
I’m not really sure if this is an equitable bonus – as an Xbox 360 owner I didn’t really feel like I got much value in being allowed to give Activision more money for CoD expansions before PS3 owners had the same opportunity. If I did own a PS3, and was excited to see 1943 on my disc, I doubt that getting BF3 DLC one week early would really make up for the loss.
What about you, PS3 owners? Should Sony live up to its original announcement or does this whole thing fall in the “do not care” category? Also, sorry if you’re experiencing Battlefield overkill; the rush is almost over! If you’re not, I’ll see you playing online!

Rage is going to be one heck of a massive game, and quite literally at that too.
Digital Foundry's latest console offering is reportedly coming at an 8GB install size for the PS3, while Xbox 360 gamers will have to contend with three discs for their version of the game. You might be wondering why it's taking this much space on your console, and fortunately, id Software's Tom Willits has got the answer for us.
Explained Willits on why the PS3 will take up 8GB on your hard drive, "Sony was great. Kudos to Sony for letting us do that. They don't allow every game to do that. So definitely, hats off. What we were able to do is install all the textures to the highest level. What is nice about the PS3 paltform is that it's just one platform. Everyone has a Blu-ray drive, one hard drive, it's all the same. Some of the other systems you have... should I install it on my 360? Should I not install it? So yes, it's very nice."
As for the Xbox 360, "We recommend installing the game to the hard drive, but you don't need to install at three discs. If you don't have the space available on your hard drive, don't stress. Install the first disc, the first chapter, the first half of the game, then when you're done, uninstall and install disc two."
Besides, they're pretty aware that this is a common dilemma among Xbox 360 users, and that's why they didn't require a particular cut-off for when you can swap discs. "you can go back if you want to but there's really no reason to," he reassures.
We do appreciate this accommodation, but truth be told, disc-swapping is just so old already. Then again, it's not the game developers' faults. They are, after all, only making do with the systemt that they're given to work with.
Late last month, id also clarified that gamers will not have to be obliged to participate in the racing modes of the game, as it is going to be non-mandatory for the most part. They're also guaranteeing that the DLC that will be coming our way post-launch would be something that we would really want to get.
Rage comes out in a few short weeks for the PC, PS3 and Xbox 360.

The long-standing dispute between Sony and Korean electronics company, LG, has finally wound down to a close.
Reuters reports that the two companies have now signed a cross-licensing deal following the settlement. "LG and Sony recently agreed to drop patent infringement lawsuits against each other," said an LG Electronics spokeswoman.
The electronic giants have been involved in a tussle over the Blu-ray technology, which, upon the two parties' failure to renew their technology sharing agreement, sent LG praying for a preliminary injunction on all European shipments of the PS3s and Blu-ray hardware from Sony in Europe. This resulted in the Netherlands customs authorities confiscating PlayStation 3 units.
On the other hand, Sony also sought to block LG's shipment of their Rumor Touch as well other smartphones to the United States by lodging a complaint with the U.S. International Trade Commission.
That's all now in the past, though, as they have now settled their differences. Sony also confirmed this announcement from LG, although they did not anymore give out specifics as to the settlement.
