The head of Valve speaks on the dangers of treating customers like enemies.
It’s hard to find a company with a better reputation than Valve. Thanks to the company’s transparency, ownership and ease of communication with players, most gamers would consider Valve and its Steam service a strong model for how a gaming company should operate.
One of the big reasons that Valve is so well regarded is its accessible and honest leader, Gabe Newell. When Newell spots a problem, he owns up to it, as he did last week over the Steam hacking debacle. And when he’s not apologizing for mistakes, he’s busy being the one sane voice in a crowd of crazies.
Speaking with Penny Arcade, Newell had a few interesting things to say on the subject of DRM. For starters, he believes that if customers aren’t happy with a service, the company that owns it is doing something wrong. He also dismisses the idea of DRM, stating, “It’s a really bad idea to start off on the assumption that your customers are on the other side of some sort of battle with you.”
Newell claimed that many developers are actually losing sales by bundling restrictive DRM packages with their products, and that the sales lost to piracy would be far lower than the sales lost due to annoying DRM. It all comes down to value for the player—Newell notes that creating value is more important that stopping players from moving their games from device to device.
Now, if only the rest of the industry would follow along. Ubisoft, I’m looking at you.

Retailers can’t keep the 3DS on shelves, but Nintendo is still doing worse now than in years before.
Nintendo released its official numbers today, and things don’t look too good. Despite the fact that the Nintendo 3DS outsold all other systems combined last week (in Japan, of course), Nintendo is still reporting major losses for the last quarter. According to earnings reports released by the company, Nintendo lost $623 million between the months of April and December 2011.
The company doesn’t seem confident in the near future, revising its original forecast of $580 million in losses through March 2012 to $838. Nintendo noted that while Nintendo 3DS hardware is moving at a much higher rate, the massive price cut they dropped on the system is contributing to their financial ails.
In one last bit of bad news, Nintendo revised its original sales predictions for the 3DS, Wii, and DS dropping expected 3DS and Wii sales by two million each, and DS sales by about 500,000. The decreased sales projections have been taken into account for the new loss predictions for 2012.
It’s worth noting that while Nintendo reports these numbers as a “loss,” all it means is that the company made less money in a particular quarter than they did in the same quarter of the previous year. Nintendo is still churning out massive profits, and the company is far from being financially unstable. It’s just the way companies go about reporting their finances.
We’ll keep you posted as other companies release their sales numbers and financial forecasts. 2011 was likely a tough year for everyone, with console hardware aging and rumors of the next-gen on the horizon.

THQ hasn’t been doing great over the last few months, and this nasty letter from a former employee doesn’t make things look any better.
THQ, the company behind Saints Row: The Third, had a tough 2011. The company was in such dire straits that rumors floated around about it canceling its entire 2014 lineup, rumors the company vehemently denied. This morning we received word that THQ was shifting its strategies yet again, this time focusing more on its core franchises over third party licensing.
It’s hard to get a bead on exactly what’s happening with THQ. Rumors and sales indicate the company is in serious trouble despite the success of Saints Row, but the company refuses to admit that they have any sort of problem. Only one person seems to be willing to comment on the state of the company – an alleged former employee with an obvious bone to pick.
In a letter written to THQ’s Board of Directors, CEO Brian Farrell as well as the general public and a collection of gaming news sites, this “Formerly Mismanaged” employee rattles off a laundry lists of complaints about the company.
The letter essentially claims that THQ’s problems stem from mismanagement and a Board of Directors that has no clue how to strategically run a gaming company. It gives examples like acquiring game studios with no plan on how to utilize their talents (then later shutting them down), investing money into shrinking niche markets, the company’s refusal to dump a CEO that has tanked its stock price and high-paid executives making enormous mistakes that call their competency into question. The disastrous uDraw tablet also makes an appearance.
These allegations of management incompetency surface just a few days before THQ announces its current financial standing on February 2, and things certainly don’t look good. One analyst has gone on the record by stating that THQ, without some sort of financial windfall, with run out of cash near the middle of this year.

Dear THQ Board,
I am an ex-employee at THQ. I saw the tweet-started headlines over the past week from an "industry expert." This expert is one who I and my friends and co-workers in the industry have never heard of after a long time in the field. I had been reading the various following articles and accounts and it generated sympathy for friends both recently laid off and currently still there. I thought it would be a good idea to send a note with their input. This note has honest facts and thoughts about THQ and the current problems there. Most of these facts are public knowledge and they have been confirmed by public records or can be confirmed by current and former THQ staff there both before and after my and their time.
I have long felt the need to explain to outsiders how this beaten-down company has wound up in this position. It is to the point where having it on your resume is not a point in your favor. And that shouldn't be the case. I'm/We're sending this note anonymously because some of us are still awaiting final checks and others know how little corporations like employees who air their dirty laundry. We feel the need to say something to combat the partial misinformation being written.
THQ had been known through the years for having a formula. They find a hot license, make a cheap game, barely advertise it, and make money. This formula worked during the Playstation and Xbox and Gameboy days and made the company a lot of cash. Unfortunately, THQ's old guard executives seem to be stuck trying to manage the company the same way they did back then and haven't realized the industry has changed.
The beginning of the end came years ago as Brian Farrell lead an executive team to acquire a large number of studios. A large amount of cash was used in the acquisition or setup of game developers with different degrees of talent. The problem was they were bought without strategic reasoning or specific plan on to use them. So after awhile another large amount of money was spent as those studios failed and were sold off and shut down. The executive team at the time were an entirely different group of people with one key exception in the CEO. The CEO/the then executive team wasted the cash that the company had built up with these massive investments and selloffs.
The studio purchase errors were not helped by the mistakes in the licensing deals that were signed by the same CEO. Millions and millions of dollars were wasted on acquiring licenses at the same time the kids, family, casual business was declining at a rapid rate. Instead of slowing those acquisitions he overpaid for more of them until again cash was wasted in paying for brands that didn't sell well anymore.
The mistakes in decisions and cash losses triggered wave after wave of layoffs. In the most recent wave, about 40 people lost their jobs this past December through no fault of their own. The reason why is the chronic and constant mismanagement of their company. The fact is that the CEO and executive committee were so focused on trying to hit an unrealistic financial goal that they bet everything on an extremely risky proposition in the uDraw tablet. When they lost, they further displayed their lack of management skills by not having a contingency plan. Three weeks after the game launched, an entire business unit was wiped out when it didn't meet its goal due to relying on that one product to hit an unrealistic target.
After the layoffs many ex-employees walked around shell-shocked and trying to figure out who was responsible. They came to the understanding that most of us do after leaving the company. The issue with THQ has never been one of lack of staff creativity, intellect or business intelligence. It all rests of the failure of its management team and you the Board of Directors.
This Board has allowed the Brian Farrell, the CEO, the ongoing ability to take a cash-rich profitable company and drive it from a $30 share price down to around $.70 without acting despite numerous mistakes that even for those lacking business training, could see were errors. Even without glaring mistakes how can the same CEO stay in charge after a 99% share price loss? Aside from the board, who is responsible for the current situation and who is accountable for the current and future job losses at the company? When you ask the recently departed who are a good source of information, you get the same answers. This uDraw failure is the largest and most recent one in a string of them that were hushed over and hidden. The answer aside from the Board is the current executive team that allowed this uDraw implosion to happen.
Brian Farrell, CEO with a 2011 salary of $1,289,558, for a lack of business intelligence or fiscal accountability. A vocal inside group pointed out the mistake of trying to launch a year-old product that received almost no software support in the last 12 months. Instead of listening and having a back-up plan, he went ahead and invested a ridiculous amount of money in the manufacturing and advertising of the product and failed miserably. It is passed time for him to go. We are wondering what is taking so long for you to act. We have been wondering this same question for a long time.
Martin Good, EVP and head of Kids, Family, Casual with a 2011 salary of $1,198,023, for bringing no strategic thought or business sense to the role. He was brought out from Australia sales to replace an outgoing head of the business unit and rapidly displayed a complete lack of leadership skills, vision, and any sort of analytical sense. Looking at his compensation package, he is an excellent negotiator as his salary is higher than anyone's except for the CEO. On the plus side he lost his job with the rest of those laid off. On the minus side, he will be floating down on a golden parachute while the rest of the former employees scramble to look for jobs in this challenging environment. Most of those jobs will be at studios in other parts of the country, so they will be forced to relocate their families in the middle of their childrens school years. It is incredible that he made this level of income while doing such a poor job, but it serves as a reflection of the lack of Brian Farrell's ability to staff well and manage.
Paul Pucino, CFO with a 2011 salary of $674,855, for not planning for this possibility and having a safety net or a plan to cover THQ just in case of failure. We have a line of credit that we likely used to buy the plastic that is not selling to customers. It is like taking a cash advance to buy THQ stock and just as worthless of an investment. Paul is known as an absentee executive who is missing when business situations gets complicated. While he was in the loop at the point of the risk, with the following failure he has been clearly unavailable. It is another example of Brian Farrell's inability to staff.
Ian Curran, EVP and head of global publishing with a 2011 salary of $1,037,047, for not flagging an unrealistic sales goal to the CEO or the Board when a big part of the corporation felt the numbers were unrealistic. He blindly held up an unachievable target and didn't act when multiple people told him he was aiming to high and out of step with the marketplace. If a sales executive's job is to anticipate the market, he has done a poor job of it. Another example of Brian Farrell not being able to find the right people for the right job.
Ed Kauffman, EVP of Legal and Business Affairs who clearly was signing bad deals on licensed products, not factoring in the changes in the business and being more critical with financial terms with partners. uDraw by itself cannot possibly explain the companies poor financial health. It is a combination of that product and a string of bad licensed deals that the company took on against better judgement. While Brain Farrell would logically be the final decisionmaker for deals, Kauffman is either unpersuasive in his arguments to not do them or supported them. Either situation equates to another example of poor staffing choices by the CEO.
uDraw was failure and the only people to blame are the people listed above. THQ and its current financial situation is also their responsibility. And they were paid around $4.5 million dollars for their poor decisions. If there is any doubt we would recommend talking to current and former staff to get the straight story. Don't read this note as bitterness on their part, but more as long overdue truth.
So, Board, it is time. Passed time for you to act and passed time for you to do something about the mismanagement that has gone on for too many years. We've watched the stock from the outside and read the comments and the reason why the company is valued so low despite its sales is because of this underqualified management team.
Board it is time for you to act before your names are added to the list above of things that must change.

EA announces partnerships with brand new developers for its expanding download hub.
EA’s Origin service is still relatively young when compared with other digital download services, but it is also powered by enormous AAA games like Battlefield 3 and Star Wars: The Old Republic. These massively popular hits have helped to launch Origin high into the competitive stratosphere, even as continuous customer complaints roll out about the service and its support network.
EA is looking to expand their hold over the digital distribution market, and is now bringing on a few third-party developers. These developers will make some of their most popular games available through Origin, further increasing the flexibility of the software and its appeal to gamers (in theory).
Here’s a quick list of who you can expect to see on Origin in the near future:

Workers threaten suicide over conditions at Microsoft and Apple factories.
If you’ve never heard of Foxconn, here’s a quick primer: The company, based out of Wuhan, China, is the primary manufacturer of some of the most popular digital devices in the world. Foxconn employees piece together Apple devices and Microsoft game consoles, and they do so in terrible working conditions and for very low wages.
Things are so bad at Foxconn that the company installed safety nets around its on-campus housing structures to help limit the suicide rate of employees. And this week, news broke that indicates things aren’t getting much better over in Wuhan.
According to a Chinese news website, workers at Foxconn demanded an increase in salary. Instead, they were given two options: quit with severance pay, or continue to work at the current rate. The workers that quit never received their promised compensation, and over 300 of them took to the roof of a building and threatened a mass suicide.
Over the next 24 hours, the workers were eventually talked down – by the mayor of Wuhan. The incident was such a big deal that, according to one Chinese news source, it caused Xbox 360 production to be temporarily shut down. Everything seems to be under control now, but there’s no word on whether those employees received their promised pay.
This is just the latest incident involving Foxconn, and one of hundreds of examples of people being put through the ringer simply so we can enjoy our digital toys. Of course, companies like Microsoft depend on cheap labor to keep their price points low, and we depend on low price points to purchase all of the cool things we want. The question is whether there’s a safe balancing point – one that allows goods to remain relatively cheap, but doesn’t depend entirely on exploited labor.

Sony is rebuffing media claims that Kaz Hirai will  be moving into the president’s office.
Late last week, a Japanese business newspaper noted that Kaz Hirai, the Executive Deputy President of Sony, would be taking the position of president of the company. The paper noted that current company president Howard Stringer would remain chairman and CEO of Sony Corporation, but hand the responsibilities of president over to Hirai in April.
Sony isn’t necessarily denying the claim, but they’re definitely not confirming it. A release issued by the company states only that “nothing has been determined,” and that the company has made no official announcement. It’s unlikely that we’ll hear anything official until next month, when the Sony board of directors gathers to vote on a new president.
However, it’s also unlikely that the rumors are unfounded – the Japanese media may just have gotten a bit ahead of Sony in terms of announcements. There’s really no way to tell what’s happening over at Sony HQ, but Hirai isn’t a bad bet for future president. He’s already shown himself to be a competent leader and has served Sony in several prominent roles.

Capcom wants you to know that they don’t support SOPA. But they don’t NOT support it, either.
SOPA is a big deal for gamers and the digital public right now. The bill is seen as very much a threat to the freedom of the internet, and countless online protests have come together as the bill gets closer to an official vote. Games journalists are reaching out to various developers to find out where they stand on the bill; Capcom responded with a very vague statement sometime yesterday that sort of set off a news bomb.
For the sake of clarity, here’s what Capcom had to say when asked about SOPA:
“The ESA represents us on these matters.”
While this statement does not explicitly endorse SOPA, it definitely doesn’t denounce it. Instead, Capcom passed the buck over to the ESA without taking any stand at all. Most gaming news outlets took this as a sign that Capcom supports SOPA; however, the company has taken issue with this “sloppy journalism.”
In a scathing statement released today, Capcom had this to say:
“We are members of the ESA (along side pretty much every other major publisher in our industry). We've only ever stated that the ESA represents us in legislative matters (again, like every other publisher). We have not stated any stance on our support (or not) for SOPA. Inferring more than that is bad journalism (which seems to be rampant based upon the rereporting of a six word response to inquiry).”
Capcom’s response is quite brilliant. They’ve avoided taking a stance on SOPA while still supporting the bill through the ESA, all the while shouting, “Everyone else is doing it!” Of course, if Capcom didn’t support SOPA, they could have taken this opportunity to say so instead of ducking out of the issue and putting it all on the ESA. It’s a slippery move from a company that’s clearly trying to avoid sticking its neck out in one direction or another, and frankly, it’s cowardly.
You either support SOPA or you don’t, and you should have the balls to admit it either way. For example, check out what Epic Games thinks of SOPA:
“Epic Games supports efforts that would stop overseas websites profiting from pirating our games, but we have to do that in a way that’s compatible with freedom of speech and due process of law. Thus, we do not support the current version of SOPA.”
Easy, right? Succinct and clear – there’s no room to interpret Epic’s stance on SOPA, because they weren’t afraid to actually lay it out.
Capcom is apparently too scared to come out and say that they support the bill, so they’re hiding behind the ESA instead of taking responsibility for themselves. And as long as they don’t publicly denounce the bill, it’s safe to assume they’re supporting it through the ESA while trying not to get their hands too dirty in public.

The first round of Battlefield 3 DLC is now available on all platforms. Take that, PS3 owners.
PlayStation 3 owners have been enjoying Battlefield 3’s Back to Karkand expansion for the last week or so, but we Xbox 360 and PC players are getting our first taste of the new maps today. As of my writing this post, Back to Karkand is now available for purchase through the Xbox marketplace and Origin – it’s also free for anyone that owns a Limited Edition copy of the game.
Back to Karkand includes four maps from Battlefield 2, each one painstakingly rebuilt in the new Frostbite 2 engine. Destruction runs rampant and there are even a few new vehicles to check out. DICE has also added a new feature called “Assignments,” a series of challenges you can complete to unlock brand new weapons. This is by far the most interesting addition, though the maps are nice.
As for whether a bunch of old maps and a few new weapons are worth your valuable dollars, that’s up to you. I somehow ended up with a Limited Edition despite not pre-ordering, so I’ll be enjoying a bit of Back to Karkand later this evening.
Pick up Back to Karkand here for Xbox and Here for PC, for either 1200 MS Points or $14.99 (steep!).

American Nintendo President sees console for every demographic.
What about the Western Rabble Rouser console, how's that coming along?
Nintendo have had the family market cornered for years. Cornered and had a bright ribbon attached around it's neck which pulls so tight that money falls out of their pocket in droves, and whilst, other video game consoles have tired to put their bucket under their pockets, it seems that Nintendo's American President Reggie Fils-Aime, has plans to make sure the momentum keeps going when it comes to Nintendo's continued success.
Despite the postiing of a the company's first Japanese loss in over two decades, the American head says that with having four systems on the market, Wii, U, the DS and 3DS, isn't too bad and that they can have a share of the same market space for some time, as long as they appeal to the right markets. The right markets according to Fils-Aime, is the core gamers, lower-income homes and the classic, small children.
Of course, with Christmas coming up, all of those are taken care of on Nintendo's consoles,  Fils-Aime says that Nintendo thinks the "DS is going to sell well" this holiday and that it's going to "appeal to a different consumer," adding that the christmas memory of buying the first console for your kid might be an idea this christmas.
Reggie talked with Time Magazine adding that the Wii has really gone for a core market but also trying to hit a lower income bracket with the Wii being less than $150 for the first time, this year. He notes that the console being $200 or even $250, may have been "out of their reach" but now it looks like it might be at the right price.
Regarding the Wii U and the 3DS, Reggie talked mainly about the core gamer audience and how the people who buy the "Wii hardware today" may be different from the people who buy the "Wii U in the future." He also noted he was aware the lack of pricing for the Wii U had been a concern for some people, but that you would be expecting different things from the Wii U and therefore would need different pricing.
That being said the Wii U would be a dedicated experience, but regarding this holiday season's spending, we already know that Microsoft slaughtered the competition over black friday and other than my girlfriend's family of non-gamers, I don't know anyone who doesn't own a Wii...Reggie might be hopeful but not stupid, I think it might be high-time for the Wii U to be rolled out and let Nintendo rest the Wii's flag for now.
It was a great console, some memorable games and experiences. Remember the first time you played Wii Sports with friends and family and how amazing it was, till someone said that the swinging in Tennis wasn't matching up...yeah good times.

The Stalker Developers may be closing down, was this what they were working on?
The Stalker series is known for having some of the most realistic style of gameplay this side of Minecraft. The game drops you in a nuclear ravaged wasteland and shakes you till you cry in the middle of a country side surrounded by nuclear powered dogs. The game's subsequent releases such as Clear Sky opened up the game even further to what was going on in the radioactive landscape, but a sequel is what most people were hankering for.
Now with rumours of GSC closing down it may be that those holding out for Stalker 2, may be holding out forever. The news so sudden, most people think that may be just a downsizing of the company, but it may be the final notice for GSC Game World. I feel bad because the Stalker series was so fantastically detailed and difficult, more games should have learnt from STALKER rather than move away from it.
Anyway, the original game is still fairly cheap on Steam and here are some leaked art for the game thanks to the guys at Rock Paper Shotgun...
If this is the end of GSC Game World, it's gonna be a damn shame that a game that could have looked like this will never be made.

The director of one of Sony’s most beloved franchises isn’t a huge fan of where online play is headed.
Did you play Battlefield 3? Did you have a good time setting up your Origin account, logging into Battlelog, registering your online pass and joining the gun club or whatever? My guess is no. At best, it was an inconvenience, and at worst, it was a game-breaking problem. Yet online passes are quickly becoming the norm, showing up in games like Uncharted 3, Dead Space 2 and Need for Speed.
Online passes protect the industry from used game sales – if you buy a used game and the online code has already been registered, the only option is buying a new code directly from the publisher. This relatively recent development has plenty of gamers up in arms, and it looks like it’s not just gamers that think online passes are a bad idea – some developers are getting on the train as well.
David Jaffe, director of the newest installment of the Twisted Metal franchise, definitely doesn’t support the online pass model. His theory is simple: The online pass may protect first-round sales, but it’s not worth losing potential fans that don’t want to take a chance on buying the game new.
By letting gamers pick a used copy of the game up at a lower price, Jaffe figures that more people will get a chance to experience the game and become fans, which in turn translates to bigger sales next time around. Note that Jaffe isn’t against the idea of the online pass because he thinks it’s stupid or inconvenient, but because he believes it can negatively affect the franchise’s bottom line.
Jaffe also noted that the final decision is up to Sony, so there’s no real indication on whether the new Twisted Metal will have an online pass or not. Based on the company’s recent actions, I’d say the most likely answer is “yes, totally.”

American Arcade Business is back in High Score
Remember when you didn't play games at home? No not outside, I mean arcade games.
The old arcade. The smell of the old machines, the sounds with each beckon and call that will hopefully get you to pop a few dollars into it. Why? Just for your amusement. Well with movies like King of Kong and the rise in Arcade machines as trophy items for game collectors, TNT Amusements has struck a deal with production company PBR Productions to produce a reality show.
It's currently called High Score, but will be subject to change depending on who might pick it up. The show is about the "American Restoration" of the arcade machine and pinball world, with Todd Tuckey, the proprietor of TNT Amusements, leads a crew to hunt all over the country to find much-loved amusement machines of the past and restores them back to their working beauty.
The show is ripe for the picking as I actually know a mate of mine who's Dad has a hobby of restoring pinball machines and hiring them out for birthday parties. It's oddly a lucrative market and the show doesn't sound too bad. It'd follow Todd and his crew from acquisition to sale. The sales include going to a large clientell which include celebrities
“This show will help all the collecting world I think as it will get people re-interested in pinball machines and arcade video games! It's a win win for all” said Todd Tuckey of TNT Amuesments.
The crew at TNT Amusements is a lovable cast of characters that walk you through the restorations from start to finish. Tuckey is no stranger to screen as his success in the industry has led him to speaking engagements, for his own 30-minute television special, and being featured on the reality TV show “Kendra” (one of his clients). High Score is currently courting cable networks and other reality television distribution partners. A 22 minute pilot episode has already been created and you can view bits of the show above.
The series is produced and created by Nate Hall and Corey Armideo of Pioneers Beyond Reality. About TNT Amuesments TNT Amuesments is the worlds largest used game show room with over 120 pieces on display in a 4,000 square foot area, which if you think about it that will grow more and more as the show goes on.
Tuckey began a Video Game route in 1979, installing games in stores in the Philadelphia area, unfortunately by 1984, the boom had dried up and arcade parlours began to dry up. They now sit in the back of pizza places, basements and in the home's of video game generation adults, but Tuckey is on the hunt to find, fix and fully restore these machines back to their working glory, I'm pretty excited to see the show air.
