Insert basketball-related pun here.
It’s been three years since we last visited the NBA Live franchise. NBA Live 10, released in 2009, was the last chance fans of the Live franchise had to get their LeBron James on. While a new basketball title under the name NBA Elite had been planned, it was scrapped back in 2010 after it turned out to be terrible. Since then, players have had to rely on updates to NBA Live 2012 to keep their NBA fantasies alive.
Well, update no more, basketball lovers. EA has announced that it’s bringing the NBA Live brand back this year, with NBA Live 13. According to EA Sports, Live 13 will be a brand new experience that “captures the future” of basketball. Whatever that may mean. Space Jam, maybe?
Details are relatively scant at the moment, but EA has promised an update on the game’s official Facebook page sometime next week. So stay tuned for more information.
In the meantime, you can keep an eye on the EA Sports NBA Twitter for a steady stream of NBA players playing early builds of the new title.

PS3 "Other OS" case thrown out of court.
Judge musn't be a Linux user.
Sony has gotten rid of a lot of features with the PS3. One of the first thing's to go was the backwards compatible feature which would allow users to play PS2 games, which struck a blow for almost all gamers who wanted to continue playing PS2 games. It was a strange move as every other next gen console had BC except Sony. However, this was sorely followed up with the removal of having another operating system on the PS3.
After the removal a class action lawsuit was started and
A judge dismissed all counts except one of the class-action suit protesting the Other OS removal.
Many people bought the PlayStation 3 believing they had the ability to use it however they wished. The option to install a different operating system on the computer - known as the "Other OS" option - enabled users to put Linux or some other open source OS on their PS 3 and basically have a cheap but powerful CPU and GPU combo. Even the U.S. military realized that stringing together PS3s could make you a cheap-ass super-computer. But in March 2010, Sony permanently removed the "Other OS" feature from all PS3s with a firmware update needed to access the PlayStation Network. California resident Anthony Ventura filed a class-action lawsuit stating that the removal was an "intentional disablement of the valuable functionalities originally advertised as available." Today, U.S. District Judge Richard Seeborg dismissed all but one of Ventura's claims.
Judge Seeborg upheld Sony's right to enforce the End User License Agreement or EULA all customers agreed to upon purchasing the PlayStation 3. "These contracts specifically provide PS3 purchasers with a license, not an ownership interest, in the software and in the use of the PSN, and provide that SCEA has the right to disable or alter software features or terminate or limit access to the PSN, including by issuing firmware updates," Sony said in its motion to dismiss the suit.
But the sticking point seems to be the access to the PlayStation Network, and other features. Judge Seebold made it clear that customers who bought the PS3 with the Other OS option enabled could still use the console as is, they just wouldn't be able to access Sony's network as well as play new games or Blu-Rays.
"All of the counts are based on plaintiffs' fundamental contention that it was wrongful for Sony to disable the Other OS feature, or, more precisely, [to force PS3 owners to decide between] permitting the Other OS feature to be disabled or forgoing their access to the PSN and any other benefits available through installing," wrote Seebold in the dismissal. "The flaw in plaintiffs' [argument] is that they are claiming rights not only with respect to the features of the PS3 product, but also to have ongoing access to an internet service offered by Sony, the PSN."
The plaintiffs maintain that firmware update 3.21 doesn't just forbid access to the PSN, but that the main functions of the console are no longer viable. To wit, if you didn't update, you could no longer play new games, play games online, play new Blu-Rays, or even play some older Blu-Rays. So choosing not to update and keep the "Other OS" option alive means that no new purchases are possible and the usefulness of the product is seriously restricted.
At least the judge wasn't completely heartless. "The dismay and frustration at least some PS3 owners likely experienced when Sony made the decision to limit access to the PSN service to those who were willing to disable the Other OS feature on their machines was no doubt genuine and understandable," he said, but unfortunately those emotions have no impact on the legal scope of things.
"As a matter of providing customer satisfaction and building loyalty, it may have been questionable. As a legal matter, however, plaintiffs have failed to allege facts or to articulate a theory on which Sony may be held liable."
Sorry, people. It looks like console manufacturers can change their products' capabilities after you purchase them with no penalty whatsoever.

Need to know how to survive in a post-apocalyptic wasteland? Watch this new trailer for I Am Alive and you’ll be well on your way.
I Am Alive’s official release is drawing ever closer, and to celebrate Ubisoft has released a brief trailer that shows off some of the stuff gamers can expect when they finally fire up the game. You’ll see a bit of wandering, a touch of climbing and a whole lot of dust, but that’s about it. The whole thing is presented as a sort of video blog from the game’s protagonist as he explains the basic rules of survival.
Check it out here:
While the trailer does establish some gameplay elements, combat and enemies are noticeably lacking. Ubisoft may want to keep that stuff on the down low until the game is closer to release; I Am Alive is currently slated for an early 2012 launch. The title has been in development for over three years now, and has gone through a couple of developers during its lifespan.
In the meantime, all we know is that the game was rebuilt from the ground up when the new development team took over, and that the story revolves around one young man’s efforts to stay alive in a dangerous, disintegrating world. You’ll meet other survivors, gather goods, and do whatever you can to stay out of the toxic clouds that coat the ground.
What do you think of this latest trailer?

The bloody hack and slash game gets an official release date, and a few in-box goodies.
Are you ready for a brand-new Ninja Gaiden game? If you’re not, don’t worry – you have about four months to get your shurikens sharpened and your bandanas tightened. Tecmo Koei’s Ninja Gaiden 3, the first original in the series since the series’ developer left Team Ninja, is officially dated for March 20, 2012.
But that’s not all. If you pre-order Ninja Gaiden 3, through Amazon or GameStop, you’ll receive a two-character demo for Dead or Alive 5. The GameStop version features Hitomi and Ryu, while the Amazon version boasts Hyate and Ayane. If you purchase the game’s $100 collector’s edition, you’ll land a demo disc with all four characters unlocked.
The CE is pretty standard – art book, action figure, soundtrack – but the inclusion of a demo is a nice touch. I wish more developers would include demos with their products; a demo disc is the only reason I even knew Dead or Alive existed (this was back in the Dreamcast days).
Whatever version you buy, Ninja Gaiden 3 promises the same wall-running, sword swinging and beautiful graphics seen in other iterations of the franchise, as well as a competitive multiplayer mode. It’s unclear how multiplayer will end up playing out, but it certainly seems like it has potential.
Are you looking forward to Ninja Gaiden 3? What about multiplayer?

I’m Commander Shepard, and this is my favorite news post on the Citadel.
If you played the original Mass Effect, you likely spend countless hours wandering around the Citadel and interacting with the NPCs that lived there. The Citadel seemed like a huge part of the game, even (spoiler alert) serving as the backdrop to the final showdown between Shepard’s crew and the game’s villain.
But between Mass Effect and Mass Effect 2, something seemed to change with the Citadel. Beyond giving a casual endorsement to every store in the Citadel and a few minor quests, there just didn’t seem to be much to do there. It certainly wasn’t the fully realized, interactive environment it had been before. Apparently, this wasn’t Bioware’s original intention.
In an interview with OXM, Mass Effect’s lead writer Mac Walters indicated that one of the biggest storylines involving Mass Effect 2’s Citadel actually ended up being cut from the game. The plot apparently had something to do with the events of the first game, and the Citadel’s involvement. This content has been stapled into Mass Effect 3, so hopefully the Citadel will be a touch more interesting this time around.
Walters also made comments regarding how hard it is to write a game in which several, or all previous characters can be dead, alive, or spurned. I certainly don’t envy the task. You can see the full interview right here.

After explicitly stating that he wouldn’t be releasing the game to PC, I Am Alive director Stanislas Mettra is backpedaling as fast as he can.
Earlier in the week, we reported on I Am Alive director Stanislas Mettra’s comments regarding the PC version of the game. Citing piracy concerns and taking a few minutes to bash fans of his game for “bitching,” he definitely indicated that a PC version of the game would not be making its way to shelves.
A few days later, of course, and Mettra is singing a different tune.
According to an email he sent out to the gaming press, he’s blaming the statement on English being his second language. What he actually meant, apparently, was that he’d love to see a PC version of the game go live, but he’s just not sure of the feasibility of the project quite yet. He noted that there was no PC version of the game so far, but it’s not off the table forever.
This definitely sounds like an example of a developer’s mouth getting ahead of his brain, and trying to pass off somewhat rude comments to players as “miscommunication” is laughable at best. But, perhaps all of this drama can end in a net gain for PC gamers. Or maybe not. Either way, Mettra should watch what he says if he doesn’t want to anger his fans, especially considering that by his own admission a PC version of the game “is not in [his] hands.”
What do you think of this whole debacle? Should developers be nice to players, or is brutal honesty a necessity in the world of coddled gamers?

Ten years ago, Microsoft took a chance by stepping into a market with zero credibility. It seems to have worked out.
On November 15, 2001, Microsoft’s Xbox console launched into a market dominated by the PlayStation 2 and captivated by the brand new GameCube. It’s easy to forget this now, but when Microsoft first started talking about developing a console, many industry insiders simply believed it couldn’t be done. There were plenty of people that predicted the Xbox would flop, and that Microsoft would end up taking heavy losses on the experiment.
Ten years later and we all know the story. Fueled by a selection of excellent launch titles (including the now-legendary Halo: Combat Evolved), the Xbox quickly raised its market share until it became a true force to be reckoned with. Xbox also brought us the first true connectivity for consoles through Xbox Live, which has matured into by far the best online service consoles currently have to offer.
The original Xbox was a monstrosity with controllers that felt like bricks, but there was something special about sitting down in front of the new system and catching a few rounds of Halo or Dead or Alive 3. With Microsoft’s powerful media engine behind it, Xbox has become synonymous with gaming and now sits among the three primary competitors for sales superiority.
There have been a few hits and misses along the way, but I think we as gamers can acknowledge the incredible impact the Xbox had on the industry, mostly for the positive. So happy birthday, Xbox. Thanks for all the great games.

Hey, remember that game Battlefield 3 that still totally exists? It’s getting a few changes in an upcoming patch.
The tactical light in Battlefield 3 is by far one of the worst ideas in the history of first-person shooters. At least, it is in its current incarnation, which blinds every player within a ten-mile distance regardless of whether they’re indoors or standing in broad daylight.
Still, the tactical light could be something special with just a little bit of love, and DICE seem to be well aware of the problem. Developer Alan Kertz posted these images on his Twitter feed, noting the before and after-patch intensity of the light’s now-familiar glow:
Those of you that are fans of the flashlight shouldn’t throw a hissy fit quite yet, because it’s still retaining its sun-like intensity. It will just be effective at a much shorter range than previously, which makes perfect sense when you think about how a flashlight works in real life. Frankly, I’m surprised they didn’t dumb this thing down after the beta.
DICE is also working on balance adjustments for anti-air guns, noting the impact they have on airborne vehicles may be a bit too touchy at the moment. They’re also reportedly working on making jets a bit more useful to the ground game and improving players’ ability to stay alive while flying, but we’ll have to wait and see how that plays out.
Are you happy to see the tactical light being toned down, or are you too busy playing Skyrim and Modern Warfare 3 to care?
