The manufacturer of the helicopters showcased in Battlefield 3 never gave permission for them to be used in the game, and EA feels they shouldn’t have to ask.
If you’ve played Battlefield 3, chances are probably good that you’ve either A. been mowed down by a helicopter or B. tried to fly one and ended up hitting a building instead (me). As it turns out, those helicopters you’re so intent on crashing are based on very real vehicles - the UH-1Y, V-22 Osprey and AH-1Z Viper.
Also, it turns out that the manufacturer of those helicopters, Textron, didn’t exactly give EA permission to use their vehicles in the game. The two companies have been back and forth trying to work out a solution, but it looks like talks have broken down. EA has filed a lawsuit against Textron, in an effort to use the first amendment to protect their in-game design.
Essentially, EA feels that the presence of the disputed vehicles in Battlefield 3 is protected by the first amendment, since they’re not featured more prominently than other vehicles and they come without any sort of endorsement. Naturally, Textron feels they should be compensated for their intellectual property showing up in a game that’s making millions of dollars.
Video games are protected by the first amendment, but it’s going to be interesting to see how far that protection goes. This lawsuit is especially hilarious considering EA is known for its over-zealous approach to copyright protection, yanking YouTube videos and filing cease and desists what seems like every other day.

The system is off to a strong start with excellent digital and retail game sales.
PlayStation Vita has had a solid launch over in Japan, selling well over 320,000 units and moving 300,000 launch games off shelves. While some news outlets are reporting the software totals as below par, what they don’t take into account are the digital downloads offered by Sony.
The Nintendo 3DS, for example, had a first-week attachment rate of 0.95, meaning almost everyone that bought a system bought a game. PSP’s was 1.06. Vita’s looks low, but without numbers on digital downloads, it’s hard to get a bead on exactly how well things are going.
Sony has confirmed that their in-store game sales are about what they were hoping for, but also that download versions are “exceeding expectations.” They didn’t drop an official number, though one will almost certainly be released in the coming weeks.
For now, it looks like Vita is having a relatively successful launch. First-week numbers are strong and the unit has fair momentum heading into the winter doldrums of entertainment properties.
Do you think these sales figures indicate a willingness on the part of gamers to shift to digital distribution? Steam and other services are already wildly successful, but what about for consoles and handhelds?

Dante comes crashing back to consoles in a remastered collection featuring his greatest adventures.
Love Devil May Cry? Well, do we ever have good news for you. The good folks over at Capcom have just confirmed that Devil May Cry: HD Collection is heading your way in April of 2012, and is jam-packed with all of the demon-slaying goodness you’ve come to love and expect in the franchise.
The collection will include improved versions of the original Devil May Cry, Devil May Cry 2 and Devil May Cry 3: Dante’s Awakening. The games will support trophies and achievements, and will include what Capcom is calling “a wealth” of additional content. Details are sparse, but we can only assume that means costumes and other interesting add-ons.
Devil May Cry HD Collection will be available on both PS3 and Xbox 360 – a cool moment for Xbox owners that never had a chance to get in on the series. HD collections seem to be the way of the future, with more and more studios revisiting old classics and slightly improving them for a quick buck.
Of course, if the end result is getting to play a game you love, there’s probably nothing wrong with the move. As long as the games remain reasonably priced – Devil May Cry HD Collection will launch at $39.99. Not too shabby.

American Nintendo President sees console for every demographic.
What about the Western Rabble Rouser console, how's that coming along?
Nintendo have had the family market cornered for years. Cornered and had a bright ribbon attached around it's neck which pulls so tight that money falls out of their pocket in droves, and whilst, other video game consoles have tired to put their bucket under their pockets, it seems that Nintendo's American President Reggie Fils-Aime, has plans to make sure the momentum keeps going when it comes to Nintendo's continued success.
Despite the postiing of a the company's first Japanese loss in over two decades, the American head says that with having four systems on the market, Wii, U, the DS and 3DS, isn't too bad and that they can have a share of the same market space for some time, as long as they appeal to the right markets. The right markets according to Fils-Aime, is the core gamers, lower-income homes and the classic, small children.
Of course, with Christmas coming up, all of those are taken care of on Nintendo's consoles,  Fils-Aime says that Nintendo thinks the "DS is going to sell well" this holiday and that it's going to "appeal to a different consumer," adding that the christmas memory of buying the first console for your kid might be an idea this christmas.
Reggie talked with Time Magazine adding that the Wii has really gone for a core market but also trying to hit a lower income bracket with the Wii being less than $150 for the first time, this year. He notes that the console being $200 or even $250, may have been "out of their reach" but now it looks like it might be at the right price.
Regarding the Wii U and the 3DS, Reggie talked mainly about the core gamer audience and how the people who buy the "Wii hardware today" may be different from the people who buy the "Wii U in the future." He also noted he was aware the lack of pricing for the Wii U had been a concern for some people, but that you would be expecting different things from the Wii U and therefore would need different pricing.
That being said the Wii U would be a dedicated experience, but regarding this holiday season's spending, we already know that Microsoft slaughtered the competition over black friday and other than my girlfriend's family of non-gamers, I don't know anyone who doesn't own a Wii...Reggie might be hopeful but not stupid, I think it might be high-time for the Wii U to be rolled out and let Nintendo rest the Wii's flag for now.
It was a great console, some memorable games and experiences. Remember the first time you played Wii Sports with friends and family and how amazing it was, till someone said that the swinging in Tennis wasn't matching up...yeah good times.

Nintendo updates the 3D handheld with 3D video recording and a few other new features.
Nintendo has finally updated their 3DS handheld with all new firmware in an update pushed live across the globe early this morning. So what’s in store for gamers that download the update? For starters, 3D video recording. But the list of changes certainly doesn’t end there.
The 3DS’s new video-recording software allows you to take up to 10 minutes of footage – Nintendo has even included settings that allow you to make stop-motion or time-lapsed 3D films. You’ll also find a new quest for StreetPass, new panels for Puzzle Swap, and a special geographical map that unlocks as you run into new Miis around your neighborhood and the world.
They’ve even added achievements, though they’re calling them “Accomplishments.” Plus, the eShop now allows for continued downloads in sleep mode, and features support for the addition of demos. All in all, it’s a pretty meaty update for the 3DS. The 3D video thing is cool, but all of the other features are handy as well.

A recent dev diary drops a ton of information regarding the next installment in the “chop down trees, plant flowers” franchise.
Animal Crossing is a strange game. On the surface, you wouldn’t think it would be that interesting – get a mortgage, run errands, talk to neighbors and do a ton of landscaping. But something about the game’s cute design and free-roaming nature make it appealing, and Animal Crossing has become one of Nintendo’s biggest exclusive franchises.
Animal Crossing fans are waiting for Animal Crossing 3DS, but details were scant regarding what to expect. However, the developers have just posted a very long, very boring diary that has a few interesting tidbits scattered through it.
Here’s the important stuff:
In Animal Crossing 3DS, you play as the mayor of your city
You can choose what to put in your town, or what not to put in your town
You can paint your house and re-upholster your furniture with custom designs
Pants and shirts confirmed!
There are a few other small details in the video, if you have the time to sit through it and you’re an Animal Crossing fan. For example, Tom Nook will return, but this time as a respectable real estate dealer instead of the man to which you are an indentured servant.

One indie game developer seems to think the companies would have more success in the mobile market.
Sony and Nintendo are two of the biggest names in the world of console gaming, taking up a large portion of market share. With only three serious contenders available in stores, it stands to reason that two of those contenders would have a major influence on the future of games development. And while both Nintendo and Sony have seen success in their forays into console gaming, the ever-changing games market calls into question the long-term viability of consoles.
Andy Payne, managing director of Mastertronic and indie game developer, believes that it would make more sense for Nintendo and Sony to stop worrying so much about console development and focus instead on mobile devices and tablets. Speaking at a round table event for the Develop in Liverpool game conference, he offered some thoughts on how the two companies can evolve into pure software providers.
The general argument is that holding your biggest names (Mario, Nathan Drake) to one specific console severely limits your market share to people that own that specific console. If Mario games were release on the Android Market, for example, Nintendo could dramatically increase the number of people with access to the titles. Of course, they’d lose the performance guarantees that come with developing a game for one system, and they’d lose a major motivating factor in console purchases.
Payne’s main thrust is that it would be exciting to see Zelda, Uncharted, and all of the other Sony/Nintendo-specific franchises cropping up on a number of devices. Plus, the lack of need for a console would free up developmental and financial resources for both companies. I’m not exactly sure why he left Microsoft out of the loop in these statements, but I assume he feels the same way about Halo and Gears of War.
The big problem that I see with this theory is control – Nintendo and Sony’s games are designed around specific control schemes and require them for ease of play. How deep could the Uncharted experience really be if Sony had to ensure it worked across a number of devices? What about Skyward Sword?

The games company is banking on the teen heartthrob to encourage new 3DS sales.
Black Friday treated Nintendo well, and the Nintendo 3DS has officially out-performed the original DS in terms of first year sales. But Nintendo isn’t one to rest on its laurels, and has a full-on media blitz planned to carry its products through the holiday season. One part of this blitz apparently includes spending what must have been a huge pile of money to have the 3DS prominently featured in a Justin Bieber/Mariah Carey video, which you can watch below.
Fair warning – Bieber is auto-tuned into oblivion and the video is absolutely obnoxious, so you can skip to the incredibly obvious product placement at 1:58 if you don’t want to sit through this whole thing.
Bieber is a big factor for parents with young teens, especially of the female variety. I’m not sure whether seeing young Justin load up on Nintendo 3DSs will encourage his fans to buy a few for themselves, but Nintendo certainly seems to think it’s a gamble worth taking. I can’t imagine they earned such a prominent position in the video without a sizeable investment.
One thing’s for sure – putting Justin Bieber on the same track as someone that can actually sing wasn’t the best idea. I’m sure his fans won’t care, but hearing that auto-tuned robot voice next to Mariah Carey makes it all the more obvious that this kid’s days in the industry are numbered.
Oh, and shame on whoever made that for ruining one of the few Christmas songs I actually (and embarrassingly) like.

It’s been an interesting week in the world of games, with everything from a stupid PETA scandal to swirling rumors regarding the next console generation. If you haven’t had time to check in on QJ over the last few days, don’t worry – we’ve compiled five of the most commented/jumped/contested posts from the last week for your viewing pleasure. Oh! And we have a new Comment of the Week. Party!

PETA Upset Again, This Time Over Mario
This post addresses PETA’s most recent video game complaint, regarding Super Mario 3D Land’s Tanooki suit. The organization argues that this furry Mario accessory sends the message that it’s okay to wear fur, and they’ve even gone so far as to make their own game where you play as a bloody Tanooki trying to save your skin. Predictably, commenters found this to be a very, very dumb thing.
Next-Gen Consoles On the Way
With Microsoft expected to announce the Loop/720 next year and the Wii U already on the way, next-gen rumors are flying all over the place. Most recently, we learned that a major Sony studio is already developing games with PS4 specs. Comments are a mixed bag here, with some readers excited, some dubious, and some very angry with me for even mentioning the phrase “PlayStation 4.”
Final Fantasy XV May Not Be Turn-Based
One of the producers of the Final Fantasy franchise has gone on record regarding the game shifting away from its turn-based roots, prompting a mix of comments from dismayed to excited. The post also discusses the future of the Final Fantasy franchise. The franchise has hit some rocky times as of late, so the next game (FFXIII-2) has a lot to fix.
PSN Shutting Down at Night for Young Korean Gamers
In Korea, games are serious business. They have a full-fledged professional gaming scene and thousands of people line up to watch the pros go at it. With intense gaming schedules being a part of many young Koreans, the government has instituted a law that forces gamers to log off for six hours a night. Sony is obliging by shutting their service down, and most commenters seem to agree that the law has potential. Weird.
Saints Row the Third Breaks Promise of PS3 Exclusive Content
THQ stated that the PS3 version of Saints Row the Third would have exclusive content, but unfortunately no on in the gaming community seems to have tracked it down. All versions of the game are essentially identical, and THQ didn’t have much to say on the subject. Commenters mostly agree that when a company says it’s going to do something, it should follow through.
So there’s your mash-up. Read ‘em and get to commenting. And, before I forget, it’s time to hand out the very serious and important “Comment of the Week.” This week’s winner is xnamkcor, for his/her comment on the PETA post:

The dearth of 3DS games this holiday season has been seen as a weakness, but it’s all part of Nintendo’s grand scheme.
If you ask people what’s holding them back from purchasing a 3DS, one of the common responses you’ll receive is “lack of games.” Since the launch of the device in March, we’ve yet to see any real push to fill the handheld with quality software. Sure, there are a few good titles here and there, but for the most part, we’ve been watching the future and hoping for some real releases. Ocarina of Time and StarFox can’t hold the line by themselves.
While the lack of 3DS titles may seem like a problem to some analysts, it’s actually a purposeful situation created by Nintendo in the hopes of generating more sales in the long haul. Their thought process seems to be, “Sure, we can make a pile of cash in November, or we can wait and release our games with fewer competitors.” Nintendo isn’t merely concerned about how a 3DS game will hold up against Skyrim, but also how each game will fare when released near other 3DS games.
Here’s a quote from Satoru Iwata, president of Nintendo:
“For us to provide software titles one after another, one idea is, “Isn’t it possible for Nintendo to stock some of its software titles instead of launching them as soon as the development is completed?” Video games need to stay fresh, so it is not practical for us to put them on hold for too long, but we think that some of them may be held for a certain amount of time so that there will be a short interval between when they are completed and when they are launched.
“We are taking on this sort of challenge for the Nintendo 3DS. For example, when we look at the software lineup for the year-end sales season, it is so dense that, if we added any more software, the total sales would not increase. Accordingly, we have intentionally delayed the launch of some software titles to early next year.”
It makes sense that Nintendo would want to create a perceived scarcity with their releases. It makes no sense to drop ten new 3DS games in the next month when you look at the ridiculous amount of competition coming in from other consoles. Of course, the holiday season is always good for actual system sales, but we’ll have to see if Nintendo’s gamble pays off.

Nintendo plans a live, online presentation to talk to fans about the future of their 3D handheld system.
The Nintendo 3DS got off to a rocky start, with far less demand from players than the company expected. After a pretty big price drop (and a few good title releases), the console finally started to get a little traction from the industry – but not much. The 3DS still sits on the edge of failure, with the upcoming holiday season likely deciding the fate of the system.
Hoping to build buzz for the system and address player concerns, Nintendo has scheduled a live online presentation for Friday, October 21st. It will occur at 8pm Japan time – 12-14 hours ahead of North America, depending on your time zone (7am Eastern time).
Satoru Iwata, the president of Nintendo, is currently slated to host the event and viewers can expect to learn about the new 3DS firmware. Also on the table is the upcoming Mario Kart 7, though it’s unclear exactly what will or won’t be discussed. While you can certainly watch clips from the presentation later in the day (while you’re pretending to work), if you want to stream it live you’ll be able to pick it up on Ustream and Nico Nico Live.
The new 3DS firmware update is supposed to feature an updated version of the handheld’s Mii Plaza function in addition to giving gamers access to the 3DS’s 3D camera so they can make their own 3D videos. There will also be some minor tweaks and fixes to the system, but nothing major as the 3DS hasn’t really suffered from hacks and exploits. As always, think twice before upgrading your system if you use a flash card or homebrew software – you never know when it might get patched up.
It’s currently scheduled for November, but we may get an official date this Friday.

For the first time since it was announced, we will now be getting to see a glimpse of what awaits us in the final three years of Harry Potter and the gang's Lego-fied adventure, thanks to this very first trailer for the LEGO Harry Potter: Years 5-
Of course we all know how the story went. A lot of important characters died in the book, and shown in the movie as well, of course, such as Dumbledore and Snape. Heck, even Harry died. But he did go back to life and in the end defeeated Voldemort.
Oh, you didn't finish all the way to the end of the series? Come on, even the movie is finished already, and that's after the book came out some couple of years back! I suggest you go finish it before this game version comes out.
Not that it's going to matter in how you play the game, but am guessing it's just going to be more fun seeing the words from the book, and the scenes from the movie, transformed into these adorable building blocks.
LEGO Harry Potter: Years 5-7 comes out for all platforms conceivable (really!). As in, for the PS3, Xbox 360, PC, Wii, PS Vita, PSP, NDS and 3DS later this holiday season.

The hip grandmas of Japan thoroughly enjoyed their fill of DSi XL. Now, North American fans will have another color to go gaga over.
Nintendo announced earlier today that the region will finally be getting a piece of the Metallic Rose action beginning September 18th. What's a Metallic Rose shade exactly? According to Nintendo, it's "an eye-catching shade of pink with a luminous modern sheen."
Furthermore, it's not only for hip American grannies, but also for "kids eager to head back to school in style or busy adults wiht an appetite for on-the-go entertainment."
If pink is your thing, then get ready to whip out some US$ 169.99, and this variant of the DSi XL shall be yours. At the rate Nintendo whipped out their DS handhelds, I can't help but wonder how much more they need really before they saturate the market. Maybe they had to amp up the presence of the DS since the 3DS isn't doing all so hot in North America right now.
The DSi XL bundles entered NA just last year.
