Remember that time Infinity Ward exploded and everyone was super pissed? Well, the legal aspect of that boondoggle is still happening.
The year was 2009. Activision, riding high on the insanely profitable Modern Warfare 2, was looking for ways to keep the profits rolling in and the games rolling out. Infinity Ward, the company behind the massive hit, was looking for ways in which to keep a larger share of those profits. The end result? A massive controversy that resulted in the ousting of two prominent devs.
Vince Zampella and Jason West, co-founders of Infinity Ward and the creative minds behind the Modern Warfare franchise, were either fired from Activision, or they quit. It depends on who you ask. The actions were apparently the result of serious contractual problems, with Activision claiming the devs were up to no good with other studios, while the devs claim Activision was holding back enormous royalty payments to them and the rest of the IW crew.
The whole thing has been rolled up into a lawsuit, which was scheduled to go before a judge on May 7. However, the case is now set for May 29, thanks to a delay request on the part of Activision. The company isn’t yet talking about why it elected to push the trial back, but we’re keeping an eye out for official statements.
There are several big things at stake in this court case. Number one, the enormous royalty payments Zampella and West claim that Activision owes them. Number two, damages ordered by the court. Oh, and number three: Ownership of the Modern Warfare brand.
If West and Zampella win partial ownership of the franchise, they’ll be able to make their own Modern Warfare games. Seriously. Games that would more than likely be published by EA. Activision is naturally fighting hard, so we’ll just have to wait and see where this whole thing goes.

EA clarifies statements about SimCity’s online requirements. The news? Not exactly good.
Yesterday we reported on SimCity and its apparently always-on DRM. In the story, we noted that an EA rep had confirmed that the game would demand a persistent internet connection in order to run. According to Maxis, the online requirement is the result of the increased connectivity of SimCity and its focus on multi-player regions. However, recent information has been made available that further clarifies what players can expect from SimCity and its always-on DRM.
EA has released a bit more information regarding SimCity and online play, and it turns out that you won’t have to be on the internet in order to keep your game running. However, you will need to be on the internet to start the game, and you’ll still need to log into an Origin account to get the game to launch.
So, to summarize: If you want to play SimCity, you have to be connected to the internet and signed into Origin. Once the game is running, you can keep playing even if your internet connection shuts off. It’s better than the type of DRM protection we’ve seen with companies like Ubisoft, but it’s still far from great.

Well, that didn’t take long. In just over a week, we’ve gone from rumors of Assassin’s Creed III being set in colonial America to a full-blown announcement trailer showcasing just that. It all seems a little too perfect, if you ask me.
But hey, you didn’t ask me. In fact, you just came here to watch the trailer. So I’ll get out of your way, and let you get right to it:
I have to admit, the tree-jumping thing looks exceptionally cool. And it’s a welcome refresh on a franchise that has relied on the same basic formula in basically every game under the banner. Still, we’ll have to wait until in-game footage surfaces to make any big judgments—in the meantime, I think we can all agree that the game seems very, very interesting.

Apple celebrates 25 billion apps downloaded through its iTunes Store.
Today is a very special day for Apple, and for Apple lovers across the globe. The company has just reported that as of today, over 25 billion apps have been downloaded through the app marketplace built into the iTunes Store.
So what was the lucky 25 billionth app? Why, a game, of course! The free version of Where’s My Water, a puzzle title developed by Disney, took the honors. The downloader? An anonymous user in China. Apple should at least send the dude an iTunes gift card.
Since the creation of the iTunes Store, Apple has paid over $4 billion to iOS developers. Not too shabby.

Microsoft confirms the rumors we’ve all been reading about.
Microsoft has done quite well with its Xbox-specific Forza franchise. The last entry in the series, Forza Motorsport 4, launched to high critical praise and strong sales worldwide. So it should come as no surprise that Microsoft is already hard at work on a new Forza game, this one tentatively titled Forza Horizon.
Horizon is being developed by PlayGround Games in conjunction with Forza creator Turn 10. The game is rumored to be a shift from the traditional Forza format, with a bigger focus on open world racing. Microsoft is currently aiming for a release in fall of 2012. Essentially, this is a confirmation of the rumors we discussed over the weekend, which in turn were spurred by a leaked trailer for the game.
Details are still scarce on Forza Horizon, but with Turn 10 onboard the franchise is at least in good hands. We’ll keep you updated as information rolls out.

PS3 owners and EVE Online fans rejoice, for CCP’s new MMOFPS won’t cost you a dime.
DUST 514 is still months away from release, but that hasn’t stopped CCP from dropping tons of details regarding the upcoming MMOFPS. DUST 514 is set in the EVE Online universe, and while CCP has seen great success with EVE’s subscription model, the company will be skipping payments for DUST 514.
DUST 514 has always been free-to-play by design, but the original plan called for a small $10 upfront purchase in order to download the game. Once you had DUST installed on your PS3, you’d be able to take advantage of all of its spacey, first-person goodness without paying a monthly subscription.
Now, however, it looks like CCP has altered the deal. DUST 514 will be completely free to download, as well as free-to-play. CCP is looking toward in-game microtransactions to fill the gaps.
Eurogamer’s interview with executive producer Brandon Laurino has tons of information on how EVE Online’s ISK and DUST’s in-game currency, AUR, will interact, and how those two currencies work with your real-life dollars. Check it out if you’re curious.

Valve could be announcing Steam Box at GDC
What in the hell is Valve doing?
GDC is going on at the moment and I have a few friends checking it out, pitching games and showing off their work but with all the rumours flying around at the San Fran convention, I'd hate  to be a Valve employee right now.
The great big PC developer and probably one of the only game studios who I respect and will follow till they release Half Life 3 and with the idea of making a console, looks like I better start saving up.
Steam Box is the tentative title that everyone is dubbing it on the interwebs but i tlooks like Valve may throw their hat into the console ring and I think that the only way it will sell is if they make Half Life 3 exclusive to PC and their console...it will be the highest selling console ever.
The rumours were fueled that the company have been toying with the idea of creating a proper set-top console that could pose a threat to not only current-gen but next-gen consoles. Valve co-founder recently told the guys at Penny Arcade that if they had to sell hardware, they will. This could easily just have meant Valve branded graphics cards or just some cool memorabilia like keyboards, mice or even headphones but if they make Steam Box...the world of video games may change forever.

Minecraft patch 1.2 is now officially live, and with it comes a whole slew of new features. You can build higher, investigate menacing jungles, collect cats and find new items and blocks, for starters. But why would you want to read about these new features, when you could simply see them in action?

The changing games market makes Live Arcade a redundancy.
Microsoft’s Xbox Live Arcade has long been a bastion for independent developers and young startups to push their games to the masses. Dozens of enormously popular independent games may have never existed if not for the Arcade platform. However, XBLA simply doesn’t represent the future of gaming, and Microsoft seems to know it.
Microsoft’s Michael Wolf recently went on the record regarding the future of XBLA. His take is simple: there isn’t a future of XBLA. This isn’t to say that Microsoft will stop hosting indie games, just that the increasing prominence of digital distribution, especially on AAA titles, indicates that the “Arcade” distinction will soon be unfitting for service’s titles.
Here’s Wolf’s full quote on whether XBLA will be phased out, for the sake of clarity:
“Personally, I'd say absolutely, yes. I think digital distribution has to be like that. I don't think XBLA will be leaving soon. It is an incredible platform. We have XBLA fans, I don't think it's going to be announced anytime soon. One thing Microsoft has proven is that we continue to try and adapt and innovate in experiences.”
Essentially, Wolf is saying that as the market shifts to digital distribution, Live Arcade will just be one more facet of game delivery instead of a separate, targeted service.

Adios, World of Warcraft Game Masters!
World of Warcraft is still the industry’s leading paid MMO, but the title has been steadily losing subscribers for the better part of two years. Though the holiday season treated WoW well (the MMO lost only 100,000 players), it’s clear that Blizzard needs to do some serious re-shuffling in order to keep the game profitable for the long term.
And re-shuffling is exactly what the company plans to do. Blizzard has just announced that it is laying off 600 employees, most of which work in customer support. According to the company, 90 percent of the layoffs are occurring in non-development departments of the company. 600 is no small sum—it represents a pretty large chunk of Blizzard-Activision’s total employee number of around 7,300.
Blizzard CEO Mike Morhaime had this to say on the topic:
“In order to keep making epic game content while serving players effectively, we have to be smart about how we manage our resources. This means we sometimes have to make difficult decisions about how to best maintain the health of the company. We’re in the process of making some of those hard decisions now.”
In the face of these layoffs, there is still hope for aspiring developers. Blizzard is currently recruiting dev talent for some of its upcoming titles. And the layoffs don’t necessarily mean that Blizz is in financial trouble, just that World of Warcraft is no longer the money-printing machine it once was.

Sometimes the best thing you can do for a game is pull the plug.
Battlefield is one of EA’s biggest brands, so it makes sense that the company would look to cash in on its popularity in any way possible. The most recent tie-in came in the form of an iOS game released for the iPad, known as Battlefield 3: Aftershock. There was only one problem: the game sucked.
Battlefield 3: Aftershock stayed live for only 15 days. Launched on February 7, the game was almost unplayable due to serious connection issues and an unresponsive control scheme. EA pulled the title from the iTunes store on February 22 so that it could tweak the title based on customer feedback.
So how did that tweaking manifest? EA is deleting the game, of course! In a statement issued earlier this week, EA confirmed that development on the game has been shut down completely, and that the servers will be pulled offline March 31.
Battlefield 3: Aftershock was free-to-play, so it’s not like anyone is really getting hurt by the game being taken offline. Anyone, of course, besides EA, who likely sank a large sum of money into the title before realizing it was a lost cause.

Why the innovative games company is headed for failure.
Nintendo is, by most accounts, one of the most innovative forces in the world of gaming. The company lays claim to breakthroughs like force-feedback technology, motion control, z-targeting and a whole host of other now-standard gaming mechanics. Unfortunately, Nintendo’s days of leading the pack are quickly coming to a close.
Nintendo has always performed well in the games marketplace because of its exclusive titles and accessible technologies. However, games aren’t really the future of the games industry. In 2012 and beyond, it’s not games that sell devices, but their multimedia capabilities. One of the fastest-growing groups of console owners is made up of people who primarily use their devices to watch Netflix, listen to music or rent movies.
Nintendo has failed to keep pace with its competitors in the realm of multimedia. And it has also failed to keep pace when it comes to online gaming (friend codes, seriously?). If the Wii U can’t make some major improvements to the way Nintendo delivers multimedia content and online gameplay, it’s simply not going to be the console of choice.
Consumers always flock to the device that provides them the most value. A large number of PS3 sales can be chalked up to Blu-Ray support, just as a large number of Wii sales can be chalked up to the initial hype concerning motion control. In the next console generation, the device with the most utility wins.
If Nintendo fails to recognize this trend, it’s going to find itself toppled from the throne faster than it can say “3DS Lite.”

The Legend of Dead Kel brings new foes and new lands—some of which you own.
Kingdoms of Amalur would best be described as a hack and slash RPG—the familiar questing, leveling and equipping mechanisms are present, but combat is fluid and fast-paced. Basically, the best of both worlds. And if you’ve hit a point where you’re out of fun stuff to do in Kingdoms of Amalur (doubtful), more content is coming your way.
The game’s upcoming DLC pack, titled The Legend of Dead Kel, brings new monsters to fight and increases the land mass of the game’s world by a whopping 15%. Included in this new land is Gravehal Keep, a personal estate owned by you, the player. The keep will contain a number of characters, each with quests, perks and everything you’d expect from a generic RPG NPC.
The Legend of Dead Kel will also include 18 new weapons, eight new armor sets and eight new shields. All in all, not too shabby in terms of DLC, especially when compared with some of the more anemic downloadable add-ons we’ve seen in recent months.

Just when you thought the company couldn’t possibly be sleazier.
For many gamers, Zynga is one of those companies that represent everything that’s wrong with the industry. Their aggressive targeting of casual gamers and obvious theft of original concepts makes them an easy enemy for anyone who feels like a good rant. In short, Zynga’s reputation isn’t necessarily a good one.
Reputation aside, Zynga makes huge piles of money. And CEO Mark Pincus thinks he has an idea of how the company could make even more—online gambling. Speaking at the Morgan Stanley Technology, Media and Telecom event, Pincus talked about Zynga Poker’s 30 million users and how its success primes the company for its next big step:
“I think it's a good natural fit. I think, philosophically, the part people haven't noticed yet, [is that] real-money gaming is perfect with virtual goods and social games.”
This isn’t the first we’ve heard of Zynga’s plan to go into the online gambling business—its latest project, Zynga Bingo, is running in closed beta and operates on a real-money basis.

It’s been almost four months since a Call of Duty game came out. Time to start talking about a new one!
Most people agree that the next entry in the Call of Duty franchise will be Black Ops 2. It’s Treyarch’s turn to develop a CoD title, and the original Black Ops broke pretty much every record set by Infinity Ward’s Modern Warfare 2. And since Activision isn’t one for originality or risk-taking, a straight sequel is all but guaranteed.
Of course, Activision still likes to pretend like it can keep a secret. So even though Black Ops 2 was outed by a retailer last month and everyone pretty much knows it’s coming, the company has gone out of its way to pretend that isn’t the case. Well, add another retailer leak to the pile.
Spanish retailer Fnac not only has Black Ops 2 in its currently video game roster, but has a release window for the still-unannounced title as well: November 2012. Once again, this is less than news—a new Call of Duty game has come out in October or November of every year since 2003.
Seriously, Activision, just announce the game (and the accompanying Black Ops ELITE paid service) already.

Because without new Angry Birds levels, the games industry would surely collapse.
If you ask any serious game about the one thing they wish they had, chances are good they’d say, “More Angry Birds stuff.” Angry Birds is, in many ways, the best game ever made, and it’s ridiculous that anyone would play any other game. The immense depth, completely original concept and truly marketable characters set it above and beyond pretty much any other title.
If you, like the rest of the world, simply can’t wait to get your hands on new Angry Birds content, today’s your day. Or, well, March 7 is your day. Rovio, the luminaries behind Angry Birds have confirmed that the next groundbreaking update for Angry Birds Seasons hits digital stores on that date.
The new update, titled Cherry Blossoms, borrows a few themes from Asian culture. Beyond that, there aren’t many details available. But this is Rovio we’re talking about, so the new content is sure to be incredible.
I’m rapt with anticipation for yet another mind-blowing entry in what I would hands-down describe as the most compelling experience any gaming platform has to offer.

There’s no question that piracy is a major concern in the games industry. While some pirates do turn into customers and there’s something to be said for how much DRM sucks, it doesn’t change the fact that pirating a game is, on some level of the word, theft. However, game developers tend to take different approaches to the pirate community—some declare war and some, like Starbreeze Studios, hold out an olive branch.
If you download and install the company’s latest game, Syndicate, via Origin or any other legitimate means, you’ll notice an .nfo file hidden in the game’s directory. .nfo files are usually found in pirated software—they tell you how to go about setting up the illicit copy and who is responsible for the hack, crack or upload.
But this .nfo file is different, in that it was placed there by Starbreeze devs. The .nfo file contains a description of the game and some install directions. They even made an ASCII logo. And at the bottom, the devs dropped this message:
“Over a hundred people spent several years of their lives making this game.
If you like what you play, please consider purchasing it if you haven't
The studio also reached out to gamers with talents in game design, art, programming and sound design—perhaps some gifted game pirates will take the opportunity to switch sides to the development side of things. You can see the full file here.

Nintendo apparently doesn’t want to risk offending its customers.
Indie Dev Edmund McMillen confirmed via Twitter earlier today that the Nintendo 3DS eShop would officially be declining to host his latest game, The Binding of Isaac. Citing “questionable religious content,” Nintendo has elected to dump the game from its eShop lineup.
Here’s McMillen’s tweet in full:
“Attention: After a long internal debate Nintendo has decided NOT to allow the Binding of Isaac on the 3ds. :(“
He continued, quite hilariously:
“As many assumed the reasons were due to the games "questionable religious content". Thank GOD Steam exists!”
The Binding of Isaac has moved over 450,000 copies on PC, and this silly controversy will likely spur more sales than the game would have gained with a quiet eShop release. Still, it’s an odd decision on the part of Nintendo and a bad precedent to set in terms of censorship.

Game Group’s financial troubles don’t appear to be getting better.
Game Group, the company behind the UK’s massive Game retail chain, has been in dire financial straits for some time now. Game Group has been struggling to regain its market position and turn the tides, but so far, things aren’t looking too hot. The company has already lost Nintendo support due to financial woes, and it looks like EA is next in line.
In a memo to employees, the company explained that it held negotiations with a number of distributors in the interest of protecting its business. In the meeting, Game Group explained to its industry partners that it was having a few problems, and needed more manageable credit terms while the company worked through its issues. Apparently, EA didn’t agree.
This means that after SSX comes out on Friday, no new EA games will hit Game store shelves—including Mass Effect 3. Players who pre-ordered ME3 at Game will be given £5 extra for their trouble. No word on how this affects players who pre-ordered the very limited Collector’s Edition.
In recent weeks, Game has missed The Last Story, Tekken 3D Prime Edition and all of Ubisoft’s Vita launch games. It’s sort of a self-fulfilling prophecy—Game’s sales tank, so it can’t get new games. It doesn’t have new games, so it’s sales continue to tank. Any way you cut it, Game is in a tough spot.
