Xbox game designer sues Microsoft for homophobic discrimination |

Nicknamed "Fag Boy Jim" by his officemates, he says emails started spreading around the office in January last year, with headings such as "I'm Jim and I'm Gay" and "Me and My Favourite Men."
He went to their HR to talk about his situation, but agreed not to raise a formal grievance 'cause he didn't want any uneasiness in the office. Uneasy would be putting it lightly. He then said that he was asked to sign a document agreeing not to file a formal complaint and that he was okay with the way the problem is being handled. Naturally, he refused. After that, he found another abusive message put up in the staff kitchen. That was the last straw.
Durrant said the HR managers "blatantly disregarded" his complaint. They offered him counseling, but he said, "They're making out that I'm the one with the problem." Now Durrant is slapping them with a £ 45,000 (about US$ 66,000) lawsuit. Microsoft denies his claims and declined to comment.

Someone just took things a bit too far.
As the orchestrator of several email based pranks at my work I know never to cross the line into critisising a person's sexuality. It's probably worse here because the guy really is gay, it could be passed as humour if he wasn't.
I'm not sure what the hell they were thinking here, that was never going to end well. I wonder what games he was writing for MS.

I don't understand why he's going to sue the company, though. If he wants to get to the source of the problem, sue the people who are harassing him, not his own employer. He's going to screw himself in the long run if he does win this bogus case; once he's eventually laid off from Microsoft no one will want to hire him because they'll probably see that he sued the people who helped him pay his bills because of his co-workers being *****s. Out of fear of not wanting to this to possibly happen to them, they won't hire him. Just blowing ***** out my ass, but it's still retarded that he's suing MS.
the source of the problem is M$. No the whole company but the HR department. Harassment in any form should get you fired. If a girl keeps on getting he but grabbed by a guy in an office, he would get fired pretty quick. If HR said that the next gay joke made would get you fired, i'm pretty sure anyone who valued their job would have shut up. If he gets fired for this, then he can sue for discrimination, which will make him rich fast. M$ would probably not fire him, even if they had a good reason too, just to not get sued. That's politics for you.
What if it was because he had a big nose or red hair? or gets joked about for going with an ugly fat woman wouldnt matter then would it, he would have to ignore it or laugh along
So how about he should have kept his sexuality to himself, then no-one would know to take the piss out of him, especially if hes not comfortable enough with it himself to be able to take a few jokes
this is what being treated equally feels like but what these type of people (the trouble makers) want is special treatment because you have a breeding handicap.

that he's suing the employer because the employer is responsible for the employees it hires? and if he complained and nothing was done, then more responsibility (or lack of thereof) is on them too.. This happened in my area, a nurse was being sexually harassed by her supervisor, and her boss boss didn't do anything .. so she sued the place. And won.
so has he been taking crap for eleven years from these people or what? I guess now is the right time to cash in on it, maybe if he didn't go around wanting to stick a rubber fist in a man's anus then there wouldn't be a problem?

And you cant even grasp the idea of the EMPLOYER being responsible for its employees. You dont sue your co worker, you sue the company for not doing anything about it, after you have brought it to their attention. Its always been that way.

I say this because we have a guy at work who takes off all the time, citing that he has 'personal problems'. When I say all the time, I mean at least 4 times a month on average, which is every sick and vacation day he gets. On top of this, he claims that he is gay (no one harasses him or even mentions it, btw). Anyway, he's said before that if they ever tried to fire him for his attendance, he'd file a grievance for discrimination. Not that this is what happened here, but it immediately made me think of that guy. So remember, the news isn't always the truth.
