Second lawsuit against Microsoft for scratched discs

Xbox 360 disc scratch - Image 1Microsoft is getting quite a beating. A lawsuit was filed in California against the Xbox 360 for scratching its discs. Earlier this month, they were hit with a lawsuit in Florida claiming the same thing.

This time around, the lawsuit was filed by two people: Christine Moskowitz, who bought an Xbox 360 for her son on March last year, and David Wood, who purchased an Xbox last December. They claim that "during regular use, the Xbox 360 scratches the surface of the game discs, often to the point that they will no longer play in the console" and that "Microsoft improperly and/or negligently manufactured the Xbox 360 console in a manner that causes the expensive game discs ... to be scratched, rendering the games unusable."

The lawsuit cited a Dutch report which claimed that 1 out of every 9 Xbox 360 units scratched discs to give their case more ground to stand on.
Microsoft's response to the lawsuit was the same as in the Florida ruling and refused to refund the price or replace the discs, and did not give any further comments.

The events follow a series of unfortunate events for Microsoft, after the US$ 1 billion bill for extension warranties for the 360, and Peter Moore leaving for EA.

I can't ever remember the PS2 scratching discs. This is a 10 fold worst problem on the 360. Wonder if they're cover DVDrom drive failure due to the overheating, in there extended 3 year warranty. Even though it's not a 270 ring of death it's caused by the same manufacturing and design fault.

Ring of death, that was a PS2 problem with the dvd drive. Do you not remember after the first week of owning a PS2 the horrible grinding noise when the DVD drive was opened ?.

Why do M$ keep releasing Xbox's with faulty drives etc after Two years. DVD drives are old technology surely they must be able to install these without any problems. They deserve all they get. Any one else would have recalled and fixed the issue by now. Why is M$ being so cheap when they have all that money, an extended warrenty isn't good enough. I have 3 buddies that currently own 360's and 2 have had to return them (they both had ROD), unfortunately their warrenies had just ran out so they had to pay but why are they not entitled to a refund now? Still at least my other buddies and me haven't had any problems (we own PS3s).

Actually to add Sony did acknowledge there system being defected in one part and they fixed it, It took MS 1 month and 6 months to deny it than finally they admitted it 2 weeks ago. So that goes to show you that MS xbox has been poorly made.



Oh and b4 anyone think other wise Bill gates has nothing to do with the xbox problems, he doesn't even make the system.
