Microsoft rolling out permabans for illegit Forza 3 and Borderlands play

Those who managed to snag illegitimate early copies of Forza Motorsport 3 or Borderlands and played them online via Xbox Live are now facing the wrath of the mighty banhammer. Microsoft maintains its crusade against offenders and those they find guilty will be (or have already been) permabanned.

Both titles, expected to hit store shelves later this month, have already been leaked in illegal channels. For those who got their copy via broken street dates, though, you're in the clear. "Don't worry folks, anyone who bought a copy early is ok. In general, if you got a receipt, play away. These are illegit copies we're hitting," said Stephen Toulouse through Twitter.

Image above was sent to Kotaku by its reader, SK, who reveals that the ban is only limited to the account - not console-specific. "I called another friend who went in on wednesday to pick up a copy and get his box done too, and he also received a ban for the same reason," SK said. ""I made a new XBL account and was back up and running (minus playing f3, of course) within an hour."

I mean I propably spent around 50,000 gamer points on mappacks,addons , and other stuff I would probably never play Xbox agian. but I'm also not stupid to play games early I use a Old 2005 banned xbox for that.

they are banning everyone and just pretending they aren't banning people who bought it legally. If the game is stealth there is no way Microsoft can tell if the copy was illegally obtained or broken street date.

look at the email sent it says the violation is pre-release title play which translates to playing a game that has not been released yet. Meaning if you do get it early it is not released and you will most likely get a ban so I have no idea wtf this Stephen Toulouse is saying.

They cant ban you for being lucky enough to snag a game early (assuming its a retail copy you payed for)

I dont know about some places, but I know Target, Best Buy, Walmart, and all the gamestops in my area (metro atlanta) /can't/ break steeet date, because their systems refuse to ring the item up. Maybe its different elsewhere, or maybe a lot of these people are using some small time stores, but the primary users of 'early release software' tend to be... pirates.



I know, shocking. still, if you have a receipe, you can contact customer service and explain it and forward the receipe and they can check the purchase and unban your account.

I'm guessing BryanNitro's copy is not legit. Well if it is then he should show the reciept and they SHOULD unban him.

The biggest losers of a banned gamertag will be those that have DLed a lot of DRM off of XBL. That money is GONE and you'll never be able to get it back. So if you get a tag ban, you better make sure you keep that Xbox in good condition because if it dies, all that content dies with it because you need to log onto XBL to verify DRM on a console different from the one you downloaded it on. And since you can't logon because your banned and you can't transfer licenses because you account has ceased to exist...

also once you get into a game, the last thing on your mind is the minor differences.

i have all three consoles and the only one that doesnt get play time is the wii.

but in the end the truth is he will ban everyone that goes on Live with Forza before release date as pointed out in the e-mail. Stephen has no idea what he is saying. If Microsoft can tell a legitimate copy from a pirated copy every person that has ever put a pirated game in his Xbox 360 would have been banned now and we all know that's note the case.

To Sony, developers come to them. Microsoft needs to buy their devs. A relationship built on money doesn't last.



The only reason why we don't have expansion packs and DLC is cause when the good things come out for multiplatform games like GTA IV, Microsoft goes and buys them off. e.g. GTA IV, MW2, and more.



Its a tactic they are using its called buy everything so they crawl to us. And then charge a crazy fee and a incrediably tight terms and conditions. And you got your DLC.

If Sony really cared about their customers they would buy some exclusives as well, but they don't.



MS buys off the good exclusives and DLC for me to play, and I'm happy with that, more power to MS.

Is it illegal? Probably not. Is it against the ToS? Probably. That is, if you got the game legally, it may still be against ToS to play it. If you're pirating it then obviously its against the law and ToS.



I know its technically not legal to sell games early, and companies get fined about a thousand dollars per broken street date if it can be tracked back to them.

You don't need to connect to xbl to play your downloaded games, as long as you are using the gamertag that bought them.



Basically it means if you want to play online anymore you need to buy a new 360.



Also, you are dumb if you play pirated games while connected to xbl anyways.....

If that console goes t**s up, then all that content is GONE because to use XBLA and additional content on another console, you need to login to XBL to verify the DRM use. And since you can't login with that GT anymore then it's all useless. You can't even transfer licenses to another console because of this.
