Looks like Nintendo isn't the only one getting a class-action lawsuit
for Christmas.A new lawsuit (with an old tune) is claiming that Microsoft knew about the Xbox 360's disc-scratching problem way before the console was released.
The lawsuit goes on to say that Microsoft had several solutions at hand to fix the problem, but they chose not to take any of them.
One solution was to slow down the speed of the drive, but this would have increased load times. Another solution was to install small bumpers, but this would have cost Microsoft US$ 35 million to US$ 75 million. With the amount of trouble they got into with the whole disc-scratching thing, either solution sounds like a better alternative.
A disc replacement program was introduced last year when Microsoft finally admitted to the problem, and then warning labels were issued instructing gamers not to move the console. The lawsuit lampoons this as well, saying that even Microsoft employees didn't find this warning sufficient.

Yes im mad, im so sick of microsoft riping the consumer off and lying to them yet people keep giving them money and taking up for them. I hope all you 360 flamers go broke because microsoft stole all ur money.
Ive been thru 3 of them crappers and ill never buy another gaming console from that company again. What a sad sad time we live in when everyone says they are getting a bargain with that console. Flame on.

1. Unplug your Xbox 360.
2. Place it outside on the ground.
3. Get in your vehicle.
4. Drive to GameStop.
5. Purchase a real game console (PS3).
6. Hook it up.
7. Realize you now have a console with free online gaming, Blu-Ray media, and a non rainbow GUI and cheer.
8. Take the empty PS3 box outside to the ground where you placed your Xbox 360 (your 360 should still be here if you've been following these instructions correctly).
8. Beat the ***** out of it with the PS3 box.
9. Recycle it for the plastics.
10. Prey every night that Microsoft gets out of the gaming industry.

People will call it the greatest system ever. Even tho just about every system has to be replaced or repaired and it has a major issue with scratching your games. Heck its not far off saying this country went into recession having to keep buying a new 360 because its the worst piece of hardware ever made and we say were saving money buying the 360. Yet all the flamers out there will say its the best system ever and complain how much the ps3, but stand in line getting their 3rd 1.

I couldn't agree more. I've gone through 4 360's. That's the trashiest piece of hardware. M$ enjoys giving the public half done pieces of trash. Just take a look at Vista. They already scraped that and has Windows 7 coming soon. I know that shiznit is already all over the net in beta form but damn you gotta question the BS. I won't sit here and act as if I never had fun on the 360. But it's the worst made device to cost what it cost. People enjoy defending shiznitty people and companies. Sony isn't any better even though I do love my PS3. All big corporations cut corners but M$ steals more ideas and never complete them in their products. If your gonna steal shiznit do it right and make sure yours is better than everybody elses. They knew about the scratch thing that wasn't a surprise. Oh and as someone already said, their cheap DVD rom is the second worst product in the gaming market. If you can make portable cd players and DVD players have anti-skip and non-scratching buffers. WHY THE FUZNUCK CAN'T THAT BE DONE ON A AT THE TIME $480 SYSTEM and COUNTING!!!!!!?

Keep your 360 flat if you can't handle not molesting your console while playing a game. It's that simple Touch it all day if you want.
For those claming a relative or friend had a game that got scratched "just because"... you're either full of it or are telling the truth and yea, it can happen. Again, it happened to a LOT of PS2 customers as well. I guarentee it will happen to PS3 owners in the near future. As soon as you start mass producing a product, you'll start to see more and more flaws in the machinery.
First PS3's were burning down people's houses. Ah, thought I forgot about those stories, eh? Well, I didn't. That was Sony's fault. But Microsoft Steering Wheels also caught fire and some people's homes burned down... or at least singed the shag carpeting. Microsoft's fault.
Idiots touching the XBOX 360, Wii or PS3 while a game is spinning deserve to get their game scratched, Danny boy. If you don't believe me, just try it on your console. Put a game in and start rubbing up on your system of choice. Don't want to? Nah, don't blame you. But you see my point. Stop being a drippy nosed kid and again, take responsibility for your actions. This is in no way Microsoft's fault and 360 continues to sell more and more than the PS3. Microsoft isn't going anywhere. They have more money than Sony and could trade them like poker chips if they ever wanted to sell. Blu-Ray is a joke and will be dropped in a hole once digital downloads and streaming rentals become the viewing of choice for family entertainment.
Sorry it sucks to be a Sony fan right now and while I don't want to see them go, the competition is great and I want to see where the industry takes us because Nintendo is more taking a step backwards than forwards... I just wish Sony fans could see how silly and ironic things turned out. The 360 is the new PS2. More popular, lots of games, more JRPG's, more support from Square Enix, better EA Sales, better 3rd Party support overall, more exclusives, better price, mass produced so we see more of the flaws. (And believe me, PS2's were the crappiest system ever made, people used to buy 3-4 consoles because they'd break within a year or so. I returned over 1000 systems myself)
The PS3 is the new XBOX. Came out a year later, has better tech, better first party support, more artistic freedom for devs. Comes with a wireless adaptor. That's where it ends though. Free online doesn't mean better. I've seen video of Home and it blows. I'm glad NXE is just a better Mii-Too and an easier navagation system. I don't want to run to the "Games" room just to play games.
Free online play is like saying basic T.V. is better than Cable because it's free. No, it isn't... it's just free. I'd rather pay for a quality service that's $50. I'm not so broke paying for a PS3 that I can afford it.
But I digress. People should have to buy the disc again for bumping into their 360 while it's playing a game. Too bad, so sad, their fault.
