Lawsuit filed against Microsoft for scratched discs

Xbox 360 - Image 1Microsoft seems to be getting a lot on their plate lately. First it was the massive failure rate of their consoles, then the red ring of death which led them to extend their warranties and repair damaged consoles for free. Jorge Brouwer from Florida is suing Microsoft demanding US$ 5 million in damages after his XBox 360 scratched his discs.

5 million dollars is a hefty sum, but Jorge Brouwer seems to believe is the cost of his beloved Gears of War and Madden NFL 07. The Hodkin Kopelowitz Ostrow Firm's Jeffrey M. Ostrow, the attorney who filed the class-action lawsuit, said he wanted Microsoft to reimburse everyone for their damaged disks.

Microsoft has agreed to replace the discs for a US$ 20 fee, but it appears Brouwer isn't satisfied. Bouwer's lawsuit stated that Microsoft is "well aware that the Xbox 360 console has been defective since its introduction to the marketplace."

A spokesman from the Redmond giant said that there were no widespread reports on scratched game discs, although the definition of "widespread" or an equivalent number of reports was not ascertained. Microsoft has yet to review the lawsuit, claimed the spokesman, since they've only learned about it recently.

sue-happy

For every 1 person who has a scratched disk supposedly due to the console there is 100 people who have no problem. These people just dont know how to take care of a console, and probably cant even work their stereo cd player without causing it to eat their cds. I have played over 100 different games and not one of them have even the slightest scratch on them. These people are just dumb.
by - 2007-07-10 19:38:54
he is right....

I take care of everygame i ever own.. the 360 does scratch the discs over time...
by - 2007-07-10 19:53:12
scratches?

my 360 has never ate my disks before, but my friend's copy of halo 2 was scratched (small scratches) beyond being playable. we easily fixed them with some good old toothpaste, so it's not a problem.
by - 2007-07-10 19:58:50
lol, I don't really care for the box

but this guy is obviously trying the take advantage of the box's minor flaw. Two 40-50 games for $5 million dollars? pfft, this guy is going to get eaten and *****ted out alive in that case. MS already offered replacements for 20 bucks.

FYI...JORGE

dude...all game consoles scratch your game discs over time...the optic eye is 90% of the cause...if the belt that rotates the disc slips it bumps the eye therefore scatching the disc and the optic eye...Maybe it was your own carelessness that maybe so called "scratched" your beloved once great game GOW and that Piece of ***** game Madden 07 there was never once a good madden...5 million ur trying to take from microsoft...you know why the discs are scratched cuz u bought a faulty xbox that prolly got damaged during shipping so its not microsofts fault its ur own numb nuts
by - 2007-07-10 20:04:30
I have a friend

My friend's Xbox scratched his call of duty disk up really badly. It was in the vertical position and it started making a really loud noise. We turned the xbox off really quick and looked at the disk and there was a PERFECT circle on the disk where it got scraped. The game works still but one level gives an error when you try to play it. So we just cant play that level anymore.

wankers

AoxomamoxoA u are a true knob, rushed machines always overheat and scratch disks

by - 2007-07-10 20:52:32
It true..............

i have a friend and he went thru i think 2-3 Gears of War game causses by the game case the xbox360 game case or bad really i noe it easy but like gears being soo cheap wit the cd it cracks easy............ I love Gears of War............
by - 2007-07-10 21:04:33
..

Its not really about the scratching. It's why the scratching occurs. Simply changing position = dead disc. This shouldn't be an issue at all and it's a horrible defect that Microsoft needs to address regardless of the users responsibility or handling.
by - 2007-07-10 21:13:55
Microsoft at it again

I really hope the guy wins because he really knows how it feels to own a faulty device that a certain company says its a very good piece of technology. This proplem wouldnt have happened if Microsoft didnt make a faulty product and went to early into the market. It gose to show you how patience is a virtue, and thats what Sony has and unfortunatly Microsoft dose not.
by - 2007-07-10 21:26:15
read owners manuals

the reason people are probably getting scratched discs is not because the system is in a vertical or horizontal position it's probably because they are moving the console with a disc inside. if you read your manual it always says before moving your console you should remove the disc first. I have two 360's and i haven't had a problem with any scratching. I have never had any problems with scratching on any consoles except when i moved my ps2 and the disc moved out of position and when it started it made a strange noise and my disc got scratched. that's probably what's happening to these people because nobody reads thier instruction manuals before operating thier consoles
by - 2007-07-10 21:51:39
definite grooves

We didn't move the xbox console while the disc was in use, we take care of our games and we spent a wack of dough buying a system to play the games. I don't want $ from any company, but I really get annoyed when the $ my son and I saved to purchase the system and accompanying games is faulty and resurfacing is unable to solve the problem. The game scratched by our console was Call of Duty 3, no strange noises, just scratched rings. We tried to trade it in but the game stores won't take it due to the scratches. It seems to be a problem with the consoles according to the stores.
by - 2007-07-11 00:51:22
Scratched

I have only had one issue with a scratched disk. I heard a noise albeit a brief one but i noticed a huge chunk of the level i was playing missing when i turned Fenix around. i moved on to the next area and i got a disk read error. so i took out the disk and there was a complete circle gouged into the disk. I didnt touch the 360 i didnt have a fan on, I dont live in an appartment hell i didnt even sneeze. there was no reason it should have gouged it but it did. SO i took the game back to Hollywood video and told them what happened. Good thing i got the $0.25 insurance thing.

Scratching maybe, but MS takes care off it

When my first 360 died, they sent me a brand new one as a replacement. That one scratched the first disk I put in (having not had this problem ever with the old one). A quick phonecall to MS and Ubisoft (the disk was SCDA) had both the Xbox and the disk replaced free of charge. I don't know how some people approach the Customer Service, but I say being nice to them goes a long way towards having your problem taken care of.
by - 2007-07-11 03:19:19
... No. Don't.

Because it's just a regular lawsuit right now. "The suit by Jorge Brouwer seeks class-action status." (Google'd) That means it's not class action yet.
by - 2007-07-11 03:21:10
READ THE FARKING ARTICLE.

It's NOT FREE. It's $20 to fix a disc damaged by a defect.
by - 2007-07-11 04:13:57
FreePlay is a jag

" » ... No. Don't. Because it's just a regular lawsuit right now. "The suit by Jorge Brouwer seeks class-action status." (Google'd) That means it's not class action yet." Okay, so the ignorant user above my post can go about believing that the plaintiff wants 5 million dollars for two damaged games. I guess what you're saying is that knowing what a class action suit entails is utterly unimportant right now since they're only seeking that status. Silly me, how could I ever make tha mistake. Oh wait, I guess it is pretty important to know what a class action lawsuit is and why they're attempted. Nice try, jag.
by - 2007-07-11 04:38:54
Why not blame MS for everything?

Sure give this idiot 5 million dollars (him and his lawyer will get most of it) for 2 games that could have gotten scratched for any reason. 3 red lights is a real life defect, but disc drive defects are so rare I would say there's no basis for this BS. I don't know anyone who has any games scratched by an XBOX 360 console. Some people don't know basic console care, like don't move it while a disc is inside. Is everyone stupid? Go away stealth
by - 2007-07-11 05:47:12
well...

Overpriced blu ray trojan horse consoles are failures and never have decent games. The fanboys for said systems are the biggest retards around.
by - 2007-07-11 06:53:27
doesn't have to be in use

the console doesn't have to be on, if the console is moved while a disc is inside on or off can cause damage to the disc. i'm sure there are cases out there that are legit when it comes to the console scratching the system but i bet the majority is from moving the console while a game disc is still inside the console then turning on the system without opening the tray to make sure the disc is in it's proper place.
by - 2007-07-11 07:00:17
looking at it from a diff. perspective

Listen, I don't want to come off as a fanboy or whatever because I own all three "next-gen" systems and I enjoy the 360 and the PS3 (not so much the wii) very much but I come on QJ a lot and I can honestly say I've seen a lot more Xbox error and failure stories than PS3 ones. I think it's sad because microsoft is a good company (and so is sony) and they do promise to build a good system and it's quite horrible that many dedicated gamers out there have their systems fail and break. No, the one guy doesn't deserve 5 million for it but for the class-action? then yeah, that's a definite possibility.
by - 2007-07-11 07:44:57
...

My game actually cracked inside the 360. One minute it worked the next it didnt. Checked the disk and there was a barely visible crack. Anyway I think its ridiculous to sue for that amount of money. But then again microsoft is trying to sue everybody themselves.
by - 2007-07-11 07:47:11
Migrate to the Playstation 3

This is why are competitors are failing because they rush their consoles out without thinking first. We as a whole are just waiting for the right moment, as so is Nintendo.
by - 2007-07-11 09:20:23
Microsoft

The thing is, is that Microsoft isnt a hardware company so I dont think they would have come up with anything not faulty is they actually put up a different design. Its in the name Micro-Soft(software :D). Maybe in the future they will learn from this and create a better one.
by Mister Common Sense - 2007-07-11 11:29:50
.

Even if the XBOX 360 scratches discs on some consoles that weren't abused, moved with the disc inside, etc. it seems to me Microsoft is pretty good about taking care of the problem. I mean, has any other company offered any kind of disc replacment program before? This guy and his lawyer are just after money. Wahh 2 games scratched. $40 in damages, now he is looking for 5 million? All my games still look perfect. I bought a used PS2 on ebay, and it ruined an irreplacable copy of Final Fantasy 7 for me. Did I start some class action lawsuit against sony? This whole thing reeks BS.
by - 2007-07-11 12:35:05
Xbox360

I've had a 360 for about a month.Within the first week my 360 demolished my gears.at the end of the month i had the rings of "death".
by - 2007-07-11 12:40:08
WTF

this guy aint gona get 5 million. for 2 cds worth $50 each. The games are worth $120 total after taxes , its just like that guy who sued 5 million because the dry cleaners lost his pants.
by - 2007-07-11 12:58:31
Common

can you explain how ur modded ur xbox to not scratch any discs and overheat? u know...the laser swap and dvd drive thing.... I want to know cuz i just bought a 360 on ebay and want to be safe from it failing or scratching discs like ur system.
by - 2007-07-11 13:02:24
haaaaa

got caught lying.
by - 2007-07-11 13:12:40
about time

its about time microsoft has to fess up for their shoddy cheap design of dvd drives. my beloved COD2 fell victim to this crap, i hope that guy wins, no other game console destroys games like the 360.
by - 2007-07-11 13:25:42
wow

Sorry, dude. No problems with my PS3 though :) P.S. And the games are coming.
by - 2007-07-11 16:00:49
This guy is screwed

I don't think this guy knows what he's in for. if he follows through with this lawsuit he's likely to end up like Roy Pearson. who sued a dry cleaners for damaging his "prized" pants. he sued for $67 million because of "mental suffering, inconvenience and discomfort." well, the judge ruled against Roy and is making HIM pay for over $100,000 in court costs and reimbursements to the defendants. In short, Jorge shot off his nose despite his face.
by - 2007-07-11 17:54:14
C'mon people

Ive had my 360 since launch day. Ive never had the red rings, obviously. All my disks look brand new, because I dont move my xbox while its running, and I keep them in a round Multi-CD case with a felt backing. I can't seem to understand why people are having problems. Keep your XBOX well ventilated, ive had the fan stand and intercooler since they came out, and be responsible. The thing cost $400 bucks with a lot more for games and accessories, 4 controllers= Wii, LOL! As for that guy whos sueing, get a *****ing life you whiney *****!

This guys got as much common sense as charlie manson

Sure this guys probably a scumbag and his lawyer is definitly a blood sucking vampire. nonethelessn its not important that this jerkoff is getting rich for no reason, whats important is that Xbox is getting clipped for 5 million. If you make a $hitty F*ckin console that scratches peoples disks and breaks within a year 30% of the time, you deserve to be sued!!! More of us should be comming forward to sue. These checks and balances are what keeps greedy mega corporations like MS and Sony for that matter in check.
by - 2007-07-11 21:58:08
your drviing me bananas, seriously are you happy with yourself? i

After reading all of your moronic posts I see I have to repost this brilliant comment I made. In conclusion AoxomamoxoA , zeromatrix , Hi, ochoaman, Rayn389 ( your comment was especially retarded) Hellraiser ect. ect. You are all so F*ckin ridiculous, your crying that a multibillion dollard company is getting sued over somthing there obviously guilty of. God you are fanboy homo's. THIS COMPANY HAS FAR MORE MONEY THAN MANY SMALL COUNTRYS!!!! YOU IDIOTS!!! GOD IM GONNA MURDER MYSELF...TO IMAGINE PEOPLE ARE ACTUALLY BRINGING CHILDREN INTO A WORLD POPULATED BY YOU PEOPLE. CHRIST ON A BIKE!!!! im gonna go take my blood pressure meds. yikes.
by - 2007-07-11 22:23:52
lol

Wow this is great, i can't believe that MS is getting sued 5 million for 2 games that cost $140 combined.
by Mister Common Sense - 2007-07-12 05:03:30
madness!

IF it was crap hardware (mine at least), or Microsoft didn't stand behind their products, I wouldn't defend it! I hate frivilous lawsuits, and people that whine and get lawyers over $40! Why doesn't this moron get a PS2 and sue them for disc read errors! Everyone knows about that, but why havent there been any lawsuits yet?
by - 2007-07-12 11:06:10
agree

yes i agree theres worse things to lose sleep over than Xbox losing 5 million. they spend more on stocking there vending machines at corporate headquarters...bill gates spends that much just to get from manhatten to the hamptons every weekend.
by - 2007-07-12 11:15:37
^^^

I have to explain this again dont I. well okay Mr, but try to think real hard because this concept might be hard to grasp for you...JUST BECAUSE YOUR CONSOLE WORKS FINE DOESNT MEAN EVERYONES DOES. you see most of us learn when were toddlers that the world doesnt revolve around us but you seem to think that anything your experiencing must be happening to the rest of the world. JUST BECAUSE YOUR 360 WORKS GREAT DOESNT MEAN OTHER PEOPLE ARE LYING! and lastly his $40 dollars times the other 5 million people who have scratches discs due to there 360 is alot more than 5 million. and im sure there have been lawsuits against ps2, stop making this about MS vs Sony, the fact is wether your ms or sony if you make a faulty console you should own it and pay up. why dont you go and defend enron.
by - 2007-07-12 11:19:27
gggg

$140 X the 1 million people this has affected is alot more than 5 million. Get this through your thick F@ggety brain. WHATS IMPORTANT IS THAT MS LEARNS FROM THIS MISTAKE! not that this kid and his weasely lawyer and getting 5 mil.

Xbox 360 Litigation

If you have an Xbox 360 Console that has scratched your discs and you would like more information about the proposed class action lawsuit filed, please visit the Plaintiff’s attorneys’ website at www.Xbox360Litigation.com. In the lawsuit, the Plaintiff is asking the Court to certify a nationwide class and create a fund for all individuals that have had discs damaged by an Xbox 360. The Plaintiff has alleged that the total minimum amount of damages incurred by all of the individuals combined is at least $5,000,000.00. To be clear, the Plaintiff is not alleging that he or any individual member of the class is entitled to that amount of money. The sum recovered by individual class members will be significantly less than the total damages incurred by the proposed class as a whole.
