European Commissioner asks Microsoft to explain Xbox 360 disc scratching

Dutch website, Vara, reports that a Dutch TV show called Kassa aired a segment that claims that Microsoft's Xbox 360 damages media. More importantly, it was noted that the European Commissioner for Consumer Affairs, Maglena Kunevam, want Microsoft to explain themselves - fast.

Microsoft has noted that they will look into the problem of the Xbox 360 scratching disks. However, it seems that this isn't enough for the European Commissioner for Consumer Affairs. She has ordered Microsoft to detail how they have handled that DVD scratching problem in the Netherlands and, more importantly, how widespread the problem is in other regions.

The Dutch site notes that this is what can be found in the website of Commissioner Maglena Kuneva:

During her visit to the Netherlands Commissioner Kuneva spoke with the Dutch Radio Consumer Programme "KASSA". Following concerns raised by the KASSA programme in relation to the use of the Microsoft X-Box by Dutch consumers, Commissioner Kuneva confirmed that she had written to Microsoft to ask for more information concerning:

(1) details of the actions Microsoft has taken in The Netherlands to resolve the problems relating to the use of the X-Box there;
(2) details of whether the same problem has occurred on other markets.

The Inquirer reports that there are already around 1,000 complaints in the Netherlands alone. Consequently, the Commissioner wants a response from Microsoft in a week's time.

As for the disc scratching, since that isn't a surprising phenomenon to any long-time Xbox 360 gamer, perhaps this old article could help enlighten the uninitiated.

I call BS on that (by my own experience) My Condemned, Kameo and Road to FIFA world cup(which have been playd like crazy) have no trase of scratches on them, and i got those games at launch.

and thats the same for many other people i know.

I think the people getting those problems really don't clean/take care of the disc's, or they live in a dirty environment.

I do agree that the original messed up the discs, but so far all of my 360 games don't have even 1 scratch on them

and if they do they must be pretty damn hard to notice/find

The tests were performed in a laboratory for the consumers program "Kassa".

Some dvddrives were faulty (it seemed that a particular brand was responsible).

Please dont mention anything about being irresponsible or not taking care of my discs.

Im an adult who takes great care while using all my consoles/games.

well after doing 2 min worth of research and personal experience, you cannot turn your xbox 360 from horizontal to vertical or vice versa without your disk getting scratched. You hear a weird nose and you get a complete ring around your disk with every drive. It happened to my Perfect Dark Zero and Saints Row.

i have 2 X360's & my cousin has 1 - and both of us have not had any problems with disc scratching [one of my console's is a launch] - as some1 else stated, the only way u can scratch/ruin the disc is by switching the console from horizontal-vertical visa versa [i havn't tried this but have seen a video of it on youtube]

Happened to a Gears of War disc while I was playing. My xbox was in the horizontal position on my glass HDTV stand when it made a noise like something was rubbing against another, then the disc is dirty message, when I opened it, the disk itself had a perfect circle of scratches about mid way through the disc. Called Microsoft to tell them and they asked me if I had it too close to a subwoofer or if someone had bumped the console.

Scratching can be caused in more ways then just moving the console.

If a disk is out of balance, it's possible that the disk can get to an angle during the spin up or slow down causing the surface to contact something in the drive. This problem is more likely is a drive is vertical.

Optical drives were not designed to operate vertically but that doesn't stop manufacturers from trying. It's the gyroscope effect that happens when a disk is spinning and when placed vertically, gravity will want to force it into a horizontal position.

It is a problem with Xbox360s. But, it's only a problem with a certain model of DVD drives.

Very true Vietone.

Ive never placed any of my consoles in a vert position because of the simple fact that Vietone stated. You decrease the chances of any number of disc damaging malfunctions if you just put your console in the horizontal position.

Im sure there are some consoles out there with the disc scratching problem, but I dont think it is widespread enough for some team of people to probe MS about it. Its just like the Red Ring Of Death problem, it gets spread all over the internet and is made out to be a much larger problem than it really is by people trying to defame a rival console. Oh well, what can you do? Fanboys will be fanboys...

ur an idi,ot! my first xbox did have the 3 red light problem, my second xbox did scracth the disks even though i did not move the console at all, i have the wireless controller, so c'mon! NOTHING moves the console! my third xbox is the elite version, which is also crap, i thought it would not have the overheating problem and be so loud, and boy was i wrong! im never gonna buy microcrap stuff agan! dont get me wrong, the 360 has great games, but the console it self is crap. Anyway, I had no problem with my launch unit which I kept vertical until I got an Elite, which is also vertical, but I have heard people say their vertical unit scratched discs and they didn't move it. No clue if they're telling the truth, but whatever

And yeah, anybody who is stupid enough to move anything with moving parts that is as expensive as an Xbox 360 while it's operating deserves to have their discs scratched. Maybe it'll teach em a lesson

my friend (who has a 360) brung it over to play gears (which was ok...i just liked chainsawing) the halo 3 beta (way more fun) and a lil dead rising, but when we tryed lord of the rings game, it wouldnt work... i of course looked at the disk, and it showed a ring of scatches on the corners...his name on xbox live id el cinco...just tell him matt or my username, he should know

I'm still on my first 360. I haven't had any problems with it but I can tell you that the xbox 360 will occasionally scratch games. My oblivion game was scratched to *****. I had it repaired and now no oblivion game will work on my 360. When it gets to the start screen I push start and if freezes. If I clear the cache and delete the updates for it, it loads oblivion without trees, people, towns, cities, maps, roads, it just looks like a *****ed up beta version. I dont know whats up with that but everyone I know has had problems with their system in one way or another. Microsoft, and Sony are not perfect. I've had like 7 ps2s. PS2S, PS3S, AND XBOXS AND XBOX 360S ARE NOTHING MORE THAN GEO METROS IN A BOX. Throw away machines. Good luck to anyone who decides to purchase a system that plays anything in disk form. - XBOX 360 OWNER
