Class action suit filed against MS for XBL's holiday connection issues

Xbox Live - Image 1The interruptions in Microsoft's Xbox Live online service during 2007's holiday season were a source of frustration for many subscribers who wanted to go online but couldn't play because of "server errors." Three Texans found this very hard to swallow and filed a class action lawsuit against Microsoft for breach of contract.

This is despite Microsoft's effort to appease its customers by offering free downloads over at Xbox Live. The complainants remained firm in their stand to hold Microsoft liable for the outages.

The plaintiffs say that what happened was a clear violation of the subscription contract that Microsoft issues when a new account is created. The complainants say that features included for US$ 30 and US$ 50 were not served when subscribers needed to access them.

The complaint says that the Microsoft service prevented "accessing online play for several weeks. ... Xbox Live continues to deny subscribers access and has even issued apologies for their failure to correct server problems."

Microsoft was recently contacted for a reaction, but a representative only stated "Microsoft only recently learned of the lawsuit, so we are not in a position to comment at this time."

This is overexagerated, several weeks ? No, try a 4-5 days of problems....durring which time many people were able to use the service as usual.



I had problems, but even durring the timespan of 5 days I could still get in a couple hours of halo 3 a day.



This is f'ing ridiculous, freaking americans will sue for anything.



At best these people can expect to get refunded the money they paid durring the time of the problems.....so I hope they are happy spending hundreds of dollars in legal fees and wasting who knows how much of their time to get refunded 5 dollars or so.....

Its not like there was any pain and suffering because live was down. SO basically they're creating a lawsuit for well about a fraction of a dollar by my calculations. 50 bucks a year,



1 Year =365 days



365-6 = 359 days of live working great.

@Shatterdome - please try to understand what a class action lawsuit attempts: even though the alleged damages to each individual were slight, as a collective the amount of service PAID FOR and NOT RECEIVED amounts to quite a bit



it is a measure where the consumers can alter the behavior of companies deemed unacceptable



you know what, just look up what a class action lawsuit is

1 or 2 days I can forgive, but 2 weeks. No. I agree with the class action lawsuit. MS should have has there system upgraded way ahead of the season. It is not like MS does not have the money to do that. Between the Gold and Silver members paying MS, Gold with $50 a year, and Silver with MS points for uses in the Marketplace. They had the money to update the system so there would be no down time.
