Nintendo sues Nyko over Kama - Image 1Nyko's Kama Wireless Nunchuks certainly remind us of the good old Wii nunchuks, but do they infringe on Nintendo's patents? That's exactly what Nintendo is trying to get across, as they have sued Nyko for infringing on their patent designs and trademarks.

According to their federal complaint, Nintendo said that Nyko's Kama "wholly appropriates the novel shape, design, overall appearance and even the color and materials used in the Nintendo Nunchuk controller." The company asked the court to order Nyko to stop selling the Kama, and has requested cash compensation.

Nyko spokesperson C.C. Swiney responded to the accusation of Nintendo, saying, "We have not knowingly violated anyone's intellectual property and we're still examining this." Let's just hope this lawsuit doesn't get too bloody for both companies involved.

That's what you get for thinking you can be completely unoriginal.

» Bloody Hell

This is one time when I'm actually rooting for Nyko. I love my Kama controller, and will be ever so pissed off if I can't get any more.

» I know, lol, hurrrrr....

I know, I'd rather get an official Ninten...

oh, wait, nintendo DON'T do wireless nunchucks, do they? Kama have provided a product that gamers want, that nobody else provided. that's how business works, and seeing as there's only one other brand of wireless nunchucks on the market, they are being quite original if you ask me original. Nintendo are bawwwing over broken copyrights when they themselves were sued for stolen technology IN the wii remote. To be honest, I feel that they're doing what I've expected of them in recent years; Being *****s

» Trying to get some money back

Well didn't nintendo just get sued and lost something like 200Mil $ for the same reason?

They just want to get some money back from other, smaller companies.

» *****gotry.

***** you Nintendo. We happen to like the Kama. God forbid you forgo a bit of cash to make the consumers happy. What now? Steal the idea for the wireless nunchuck and sell your own at three to four times the price? Go for it. You're slipping, and it's a steep slope. Pretty soon you're going fall to the ever-strengthening Sony and Microsoft. Focus on the people you rely on so strongly to mean ***** in this world and not on your beloved cash cows.

» Classic greedy Nintendo!

"Nintendo Co., maker of the Wii video-game system, sued accessory seller Nyko Technologies Inc. over what it says is a knock-off of the Nunchuk remote controller used with the popular system."

"Nyko sells a wireless Kama Nunchuk designed to work with the Wii system. Nintendo contends the Nyko product copies its patented designs and infringes its trademarks for the Nunchuk name and packaging. The word ``nunchuk'' refers to a martial-arts weapon made from two sticks connected with a chain."

"The Nyko product ``wholly appropriates the novel shape, design, overall appearance and even the color and materials used in the Nintendo Nunchuk controller,'' Nintendo said in the federal court complaint, filed June 10 in Seattle."

"We have not knowingly violated anyone's intellectual property and we're still examining this,'' Nyko spokesman C.C. Swiney said yesterday in a telephone interview."

"Closely held Nyko, based in Los Angeles, makes other accessories for use with the Wii, including a charging station for the remotes, carrying case for the console, and adapters. The accessories for the Wii and other game consoles are sold online and at retailers such as GameStop Corp. stores."

"The Kama Nunchuk, which is advertised as avoiding the restrictive wires'' of the Nintendo Nunchuk, sells for $33.99 on Amazon.com Inc.'s Web site. Nintendo's Wii Nunchuk sells for $19.99."

"Nintendo, based in Kyoto with U.S. offices in Redmond, Washington, accuses Nyko of infringing two design patents and its trademarks. The company asked the court to order Nyko to stop selling the wireless controller, and seeks cash compensation."

Same thing as with the Game Genie on the original NES. An aftermarket company makes a great accessory and Nintendo sues them to stop it. Nintendo loves selling wiimotes and 10 different add ons that plug into it that they want all controller sales. Not only can they make massive profit on overpriced hardware, but also exclusive sales of their controller attachments.

Uh oh, then Nyko comes along and makes something better than Nintendo, better sue them, even if there is no case. With all the money Nintendo makes, they can just delay release of Karma if nothing else.

Hopefully Nyko will show Nintendo what Karma means by kicking their arrogant asses in the courtroom!

» Agree

I totally agree, Nintendo are just being greedy bastĀards, I hope this case is lost

» WTF!?!?!?!?!

"even if there is no case"

I understand you can't read very well so it needs to be explained to you.

THERE IS A CASE. It's called patent infringement.

Had Nyko made the controller from their OWN DESIGN there wouldn't be a problem. So all the ignorant comments of this being a matter of Nintendo suing over a better product are unfounded.

"wholly appropriates the novel shape, design, overall appearance and even the color and materials used in the Nintendo Nunchuk controller."

That's called patent infringement!

You might not LIKE IT but those are the facts.

Most likely the end result will be Nyko making the same thing only with their OWN design.

» The hell?

"Uh oh, then Nyko comes along and makes something better than Nintendo, better sue them, even if there is no case. With all the money Nintendo makes, they can just delay release of Karma if nothing else."

Dude, are you kidding me? Delay the release of Karma? I'm presuming you mean Kama, in which case it's been out for a little while now, probably two months. And if you actually meant Karma, I wasn't aware that Nyko held the patent on intangible spiritual concepts.

» @ISOHaven

I'm actually hoping that Nyko can come to a licensing agreement with Nintendo. One of my favorite things about the Kama is that the shape and design is so close to the Nunchuk, which makes it a very comfortable design in the palm, as well as utilizing the same thumbstick design. I mean, the overall design isn't *identical* by any stretch, a disappointment I discovered when trying to lock it into my Zapper attachment. But ah well, right? I doubt Nyko will become the officially sponsored source for the wireless nunchuk, but a guy can hope. I mean, as long as it doesn't look like that train wreck of an aftermarket nunchuck design from Datel. That thing is really unattractive to me.

by Project D - 2008-06-19 10:11
» But...

Nintendo doesn't have their own model of wireless nunchuk, and the Kama is more expensive than the Nunchuk.

» WTF!?!?!?!?!

I hear ya!

I've been meaning to pick one up to see how well it works. Now I better before they run out!
