Nintendo - Image 1Nintendo of America Ltd.has been ordered to pay US$ 21 million to Texas-based Anascape Ltd. for infringing on a patent with the design of the Wii Classic, the WaveBird, and the Gamecube controller. This marks the resolution of a case which was originally filed in 2006.

Charlie Scibetta, a spokesman for Nintendo, said that they were going to seek an appeal to reduce the payment by a significant amount. Interestingly enough, he also pointed out that Nintendo was very pleased when no infringement was found for the motion-sensing technology of the Wiimote and Nunchuk controller.

Previously, Anascape also sued Microsoft for patent infringement over game controllers although the two settled out of court even before the trial took place.  Details on this settlement weren't revealed though, so we can't say how much the company paid Anascape Ltd.

» Ha!

When Sony got sued by Immersion for "copying" rumble, Nintendo claimed it was proof Sony only copies. It's nice to see Nintendo being forced to admit they too, copied.

» funny thing is

Nintendo isn't even trying to fight it anymore, they just want the amount reduced.

Good thing Nintendo properly licensed the Wii mote technology. Can you imagine the embarassment if that was illegally copied? Can you imagine if Nintendo had to create their own controller (the main selling point?) Miamoto would have Wii fit be the main controller and it would SUCK! Either that or the N64 controller (the last one Nintendo actually came up with.)

» anybody?

Before anybody starts their Nintendo hate trolling, does anybody actually know the patent that was being infringed on? None of these news articles doesn't have any of this information. Does anybody know why Nintendo and Microsoft were the only ones targeted?

» Tch.

Sounds to me like a company trying to bull***** its way into some big money. There's been tons of patent lawsuits over video games over time, what makes these any different? Let's see "Anascape" pull out some cold, hard evidence against Nintendo and Microsoft. Put up or shut up, Texas ranger.

» Wrong as always...

MCS is an idiot.

Companies like Immersion and Anascape don't try to make money selling products--They sell patents, and the reap the rewards of big companies making mistakes. Mad Catz doesn't make their own controllers, they purchase patent licenses from the correct holder.

Companies like Anascape and Immersion file literally thousands upon thousands of patents for which they never produce even prototype product, yet somehow they are allowed to rape Sony, Ninty, MS, etc. when they partially infringe upon a patent.

There should be laws against it. Total legal bull*****. I mean hell, I should patent a teleporter and hope it comes out soon--too bad it's already been done. Lol.

» Patent Purchasing

Because other companies did research, and purchased rights to the proper patents, or researched enough to find ways to tweak their product so as to avoid the patent. It's not that nintendo, ms, and sony are stupid, there are just hundreds of thousands of patents to dodge, unless you want to pay up front.

» WTF!?!?!?!?!

muramasa655 is right! About Mr. Common Douche Bag being an idiot and about the patents.

As for Mr. Common Douche Bags comment, it wouldn't be any more embarassing then when SONY did the same thing.

With millions of patents out there this kind of thing is bound to happen and only the rich get nailed AND dragged through the media.

» *Sigh*

I always wonder why some people take something and shove it someone else's face: as if the other person cares.

Here, Mr. Lack of Common Sense, otherwise known to nearly everyone WITH common sense as a fanboy, was quick to criticize Nintendo with something so insignificant that we don't care.

Mister Lack of Common Sense, you'll be seeing more of me these days. For some reason I feel obliged to address stupidity where I see it, so I think that I'll be here for a while ;). I think the world would be a better place if people thought twice about what they say.

And would you stop posing hypothetical questions? Could you imagine if Hitler lived? Could you imagine if we didn't have the internet? Could you imagine if we all died in a massive explosion???

Answer: I could, but why would I? If it isn't true, why worry about it? Thus, NO ONE CARES!

I couldn't agree more! Just look up any of isohaven's posts for the stupidity you seek.
