Sony gets sued again - this time over PS3 Cell processors

Sony Cell - Image 1Sony, oh Sony, when will you launch a gaming console that won't get slapped with yet another lawsuit? Parallel Processing Corporation (PPC), a California-based company, sued Sony and accused the creators of the PlayStation for infringing on its patent of Synchronized Parallel Processing with Shared Memory (Patent no. 5,056,000), and using the said patent on its Cell processors.

The five-page complaint that PPC filed against Sony claims that Sony's powerful Cell processors used the company's patented technology, enabling Sony's Cell chips to breakdown processes into smaller ones, all running at the same time and in different parallel processors for faster computing.

The patent was signed and approved on October 8, 1991, and was awarded to International Parallel Machines. Parallel Processing Corporation claims to be the exclusive licensee of the patent, and is seeking damages and attorney's fees. But the scarier part? Impounding and destruction of all Sony products that infringe on the same patent.

With past lawsuits ranging from rumble controllers, LAN technology, and even employees demanding for overtime pay, we certainly hope that Sony and the PlayStation 3 come out of this mess unscathed. We still have Metal Gear Solid 4 and Final Fantasy XIII to look forward to after all.

Cell isn't just made by Sony. It was developed with IBM and Toshiba. To me it seems just anither company trying to gain in on the next-gen wave. The patent is more than 15 years old and it appears they haven't done anything with it. Let them first prove Sony/IBM stole the patented design.

But i do often pray when i play it i dont see the ring of death. I suppose that is one thing i enjoy about my Wii and ps3.. i dont have to worry about the system dieing. But as for the lawsuit... I think I shall patent holographic TV technology, so when it comes out 50 years from now some big corporation will owe me tons of money. Nice to see this company did so much with its patent from '91. IBM is using it, Toshiba wants to use it in their TVs, and numerous other companies are using the cell processor. I do not believe the cell processor is the only parallel processor out there. I agree fully. The proof is'nt always in the figures. Its the consumers choice. Xbox is high because it does have a fail rate. so people do often end up buying more than one per household. Wii well that brought a whole new concept to the word gaming, ten years ago who would have that today you could actually get some fat kid to do some exercise whilst playing games. And the PS3 again it chose to use bluray to its advantage.

Little companies will never be happy, because they didnt push their product in to the market as hard as the other companies have, its their own fault for not bein good business men/women they should have seen how good their product was back in 91, instead of just patenting it they should have used it properly.

Well, Microsoft did not design Xbox 360's processor. It was also designed by IBM.



Not that I am a 360 fan, but the Xenon is a different technology than the Cell Processor. True that both chips may have the same function but it all differs in buffer, I/O, pipelining, register handling, as well as multi-threading. So the company, Parallel Processing Corporation, is suing Sony because their so called "PATENT" matched the technology of the Cell Processor, not how the processor functions.



It's like the rumble function of Nintendo. Wondered why it was not sued by any lawsuits? because Nintendo did not use the same technology as the Sony and Microsoft did.



Although it really feels that this whole lawsuit thing is a crap. STI developed the Cell Processor, so basically, yeah, Toshiba and IBM should also be mentioned.

-- Sony announces it publicaly, no legal threats against it. "Okay let's move according to plan then" and they decide to release the PS3.



-- 2 or so years after the CELL had been announced they decide to take court action against sony (I doubt the law system takes THIS long.)



Now ... -- Microsoft started losing the HD-DVD vs Blu-Ray battle in a quick change of the tide of the battle.



-- Lots of hype created at the PS3 E3 Events, not so much at the Microsoft's.



-- The lawsuit followed all this, by weeks.



Call me Conspiracy-Man, but this seriously smells fishy and a low-blow attempt against Sony by IBM.



Now go on 360s, Flame me, but do so if you can back up your facts and not random trolling against the PS3. (Because I just don't care lol)

XOtriangle is you fear the red ring... keep your 360 in a open area or for a precaution buy an innercooler.... the cooling system on the 360 doesn't work so well under the disc drive and also due the the design when it heats up the mother board underneath begins to flex... which your end result is a ring of death... im not a fan of 360... personally i love the ps3 and i have been content with sony's products over the years... also the wii is pretty fun but i wouldnt want to own one... im not a hater but i do have my opinion... so all you other fan boys talking *****... just stfu of and the 360 failer rate went up to 35% and the 360 is at an alarming 50%.... well have fun... keep ur 360 cool if u wanna keep it... However, this time around, I would agree that there is a definite possibility of Microsoft somehow being at the back of this. I say this for the following reasons:

(1) Sony, IBM and Toshiba have never hid the technology involved from the public eye. If anything, Sony and IBM have done their best to publicize this. That implies that they don't have anything to hide.

(2) The timing of this lawsuit. This lawsuit could have been made before the PS3 was released, when it was released, or while it was struggling in the market. However, they chose to sue Sony now, when Sony is slowly getting a foothold in the Console market. (Also, co-incidentally, MS is having issues with its sales AT THE MOMENT).

(3) Usually, whenever there is a lawsuit by another Company (the Immersion Rumble case, for example), they are interested in the proceeds or royalties from the sales at the least (if they hold the patent). They will NEVER ask for the product to be IMPOUNDED or DESTROYED. This particular demand reeks of trying to discourage people from buying a PS3 by implying that they may lose their PS3 at any time.



Just my two cents/pence/paise. What do you guys/girls think?

This is me playing Devil's Advocate:

(1) To my point 1 above:

The patent may have been filed long back. The company (or person) may have thought of that long back, I think it was 1991.

(2) To point 2 above:

It may have just occurred to the person/Company that IBM/Sony's product might infringe on their patent. Or they might have been biding their time until Sony starts to approach something like a good position.

(3) To my point 3 above:

I don't have any answer for this. For this, I can only say that the only Companies that benefit from this particular demand (IMPOUNDING and/or DESTRUCTION, and thus discouraging sales of PS3) are Microsoft and Nintendo. Again, Nintendo is in a VERY strong position and has nothing to fear from Sony, which leads me to the conclusion that the only Company benefiting from the FUD regarding the PS3 created by this lawsuit is Microsoft (Business history is evidence that Microsoft rarely, if ever, plays fair in the world of business).



On the other hand, I might be mistaken. Any counters?

As I understand it, this patent system is currently broken. Just a few examples:

(1) Indian Ayurveda has been using Aloe Vera, Turmeric, etc for medicinal purposes since more than a thousand years Before Christ. Even so, some years back, some American companies went ahead and patented the SAME USE of these products that Indian practitioners has been making for thousands of years, so that now Indian Ayurvedic companies have to pay royalty to these companies.



(2) Some unscrupulous American individuals (Companies) have also sought to patent certain Indian Yogic practices: I'm referring to Indian Hatha-Yoga practices i.e the Yogic exercises which most Western nations think of when someone mentions Yoga (actually, Yoga is a way of life, encompassing several disciplines of Yoga - Jnana Yoga, Raja Yoga, Bhakti Yoga, Karma Yoga, etc). These Yogic practices are stated to be at least 6000 years old in Indian religious texts.



When the American legal system allows such unethical patents, I would say that the American patent system is all about allowing thieves to get to the Court and stamp their name on an idea FIRST.

I looked up the SCO fiasco. Yes, it does seem as if Microsoft has done something extremely similar in the past.



In 2003, Microsoft financed the SCO group in suing IBM and demanding that Linux users pay license fees and their claim was that - Linux was an unauthorized derivative of UNIX and contained code from SCO's UNIX System V Source Code. Note that this did not concern MS directly. They just tried to kill off competition by financing people to sue them. For this, MS financed them and helped them set up SCOSource to license the claimed intellectual property.



2007: An unknown, International Parallel Machines, which has a generic, vague-sounding, patent for MIMD (Multiple Instruction Multiple Data) processing, creates a new division called Parallel Processing, for licensing said patent and then goes ahead and sues - not IBM, the company central to building this, but Sony. And they don't just ask for licensing fees or royalty, they actually ask for the product to be "impounded and destroyed". Again, who stands to benefit most from this move?

In both those cases it should be possible to get the patents struck. If you have th resources to file a case and can show prior art it is relatively easy to get a patent stuck down. There are other limits to patents and ways to reverse them.



I think the two biggest problems are an inability of the patent office to evaluate a claim correctly, and the cost of fighting a patent suit is very high.



The EFF (www.eff.org) has a very interesting section on patent abuse and helping to fight it. Most large corporations are as prone to abuse as any patent troll.

It's already been leaked that M$ financed a group of Patent attorneys on this. What M$ Mega Bucks Monkey Man Balmer forgot was it could eventually come on them.



But it already came partially back as this case was tossed over a month ago when on the 5th day in court it got thrown out by the judge.



First of all the lawsuit states (and so called patent documents as no records have been found to back this up). Parallel Processing Corporation does not exist in any form in any state or jurisdiction of this country. They have no proof any attempt was ever made to develop such a device and it's described as "synchronous" not "Asynchronous" which is what the Cell processor is!



Top that off with the fact the told told them they were going after the wrong Corporate Entity. They should be instead going after the patent holder of the Cell BE, which is IBM. But that would be if they had a valid claim which it was deemed they do not! Done! Gone! Wasted M$ Dollars just like on their Xbox 360 RROD Console! ;)
