These patent infringement lawsuits really are getting out of hand. This latest fiasco was started by Texas-based Wall Wireless LLC, who is suing Sony, Nintendo, and Nokia.They claim that these three companies are infringing on their patent, named: "Method and Apparatus for Creating and Distributing Real-Time Interactive Media Content Through Wireless Communication Networks and the Internet."
The patent explains that the invention will "allow an operator to distribute messages having aural or visual content that is generated by the operator using handheld apparatuses such as mobile telephones."
Wall Wireless claims that the PSP and the DS, and several of Nokia's phones, are infringing on this genius of a patent. I'm wondering why they only chose to sue these three companies. Why stop there? Sue Apple for the iPhone. Sue every major electronics company. Sue the government. Sue my grandmother.
They filed for the patent back in 2001, which the US Patent Office issued in 2003. They sent a notice of the patent to the defendants "at least as early as October 2008," but they have yet to take a license. They further add that:
Unless a permanent injunction is issued enjoining Defendants from infringing the ‘086 patent, Wall Wireless will be irreparably harmed.
As a result of Defendants’ infringement of the ‘086 patent, Wall Wireless has suffered monetary damages that are compensable ... by no less than a reasonable royalty.
Sony recently lost a patent suit and was fined US$ 18.5 million for it. Nintendo also lost a patent suit over the Wiimote tech late last year, and was fined US$ 21 million. Coincidink? Strike while the iron is hot.

Someday Japan is going to abandon the US for all these B$. People in the US(yes I live here) want easy money. $h!t they should get rid of this suing b$.

It's because of the flawed copyright system that is in place. Basically I can just go up to a patent office and put a patent on the World and they would probably do it. Once it has been issued to me I can probably sue everyone in the world for living off my invention and I would probably win the case.
We need to change the copyright system because the way it is now its ridiculous. Anyone can go up and file a patent for a make believe thing, never work on it and once someone makes something that infringes on their patented idea they can sue them for royalties. This in my opinion inhibits the growth of new inventions because these people don't pursue to make their copyrighted product and no one else can pursue this ingenious idea they probably actually thought of themselves and want to pursue it. It's not like they went to a patent office and find out what's patented and is a good idea. If they want to pursue the invention of the idea that is patented then they would have to end up paying royalties to patent holder which most business would just look away because they could use their money to make more profit in another way.
Also clearly this did not affect them in anyway and as a company themselves, they are looking for easy money to ride out the recession. This is clearly shown by the lawsuit only being filed now and that the PSP, DS have been around for about 4 years and the Nokia has been around for ages.
In short TLDR: We need to change our copyright system to allow companies to make great inventions/ideas without getting sued for it.
Sorry for my essay. Just needed to rant on the stupidity of the copyright system.
Sony should make a new psp model with a better and newer of their design with N Draft in it same with PS3.
If companies keep making these "patents", then in the future no one is not gonna be able to invent something without getting into some trouble first...

Suing over some B Crap like that, come on people. Pretty soon, we'll just stop getting all this wonderful tech, because they will be afraid to sell it in the US, which I would not blame them (ie Sony, Nintendo, Nokia). At such time, Ill give up my citizenship and go live in Japan. Yeah, Tokyo... or maybe just on the outskirts. That'd be nice.

that it's just a money grab there is another part of this that is important. You see, if you don't protect your patents, you will lose them. It's one of the stupid parts of the law. Use and Defend them or else. I doubt they have any choice, but of course, the money couldn't hurt.
