PSJailbreak legalized in Spain

psjbRushing to protect the PS3 from hacks, Sony had taken the fight to different courts, trying to outlaw the PSJailbreak and the other PS3 hacking tools. Their movement scored a victory in Australia, where such devices have now been classified illegal. For Spain, it's a different story.

 

One argument that decided this case was the premise that the PS3 simply isn't restricted to use with games and PlayStation-related services. The user is basically allowed to do whatever he wanted with the console that he/she purchased, and that includes tampering with its features as well as its insides. The issue of the Other OS removal was also brought up, indicating that Sony has refused features from their product that was available during the time of sale.

 

As a result, Court No 8 Mercantil de Barcelona, ruled that the PSJailbreak and other related devices are now all legal in Spain. Sony will also have to pay damages to the shops and retailers that were affected by Sony's legal actions.

homebrew, in essense, was never illegal in the first place. there are just those who use them illegally.

HB in itself was never illegal however in many countries it's illegal to circumvent DRM. The problem many people are facing now is that manufactures are DRMing their OS or firmware if you will. So that created a grey line.

Apple is the only company that proved hands down that DRM is simply not needed in this case. Anyone can jack OSX. All you do is copy it. Absolutely no security protecting it. Problem is, in their case, you need to actually make money off the hardware.

So what's the solution? Charge more for the hardware and let people do what they want.

We all know what people use PS JAILBREAK for, playing PS3 pirate games.

It shouldn't been legalized but Sony is only giving crappy features, or none at all.

Yes I'm looking at their half-hearted attempt at a backward-compatible (they even advertise PS3 early on it would be but removed it). If there's ever one reason for me to get Jailbreak, it will definitely be the ability to play PS2 games.

And how exactly is that supposed to work? Jailbreak won't bring the hardware Emotion-Engine chip back into your PS3...

People who still have one of the first-gen PS3s with hardware emulation support can still play PS2 games, so that's not a firmware issue. Jailbreak won't be much of a help here.

Port what? PCSX2, that is heavily PC optimized and only runs minimally fine on windows (linux version isn't even half as stable, and the windows version IS quite unstable itself)? We're talking about something that's fully architecture and OS dependant and even so, you still need a beast of a powerful PC to run it at full speed all the time. At this point, it will take a major rewrite if anyone wants to port it to other platforms, an effort almost as great as if it was written from scratch (I'd like to be proved wrong about this, but probably I won't any time soon).

Or is there another PS2 emu around that I'm missing?

Don't count on a PS2 emu for PS3 very soon. It'll take much work and seriously hard working and talented devs to do it, but it seems to me the PS3 homebrew development won't be mature enough to do it for a while (if you doubt, take a look on what's been developed so far... emulators for consoles that are 20 or more years old, exception made for a PSone emulator that's not even half stable, and very basic a-bit-better-than-pong-like games).

I'd like to share your optimism, but you'll have to admit that what I wrote is closer to reality for now.

Anyone care to rebate this (on purpose) pessimism with valid arguments? :D

TONS of games work just fine with the EMU's. Of course not all of them. Hell, not ALL games worked on the PS3 as it was.

Something is better then nothing.

this isn't entirely true. i recently jb'd a ps3 2 days ago and after snooping around the system files a few files and folders caught my attention. mainly folders named ps1emu, ps2emu, and pspemu. this leads me to believe that there's software emulation files on the system already that aren't being used when they should be. so what i want to know is, why are these on the system and not useable?

Happens all the time. Didn't the PS3 already switch from hardware emu to software emu? Before killing off PS2? Why spend the time (which = money) to remove them completely when they can just be turned off. In case they ever want to turn it back on.

I believe they turned it off because of compatibility issues.

However, PS2 aside....can't all PS3s play PS1 games? I thought all PS1 emulation was done through software and that's always been left on? Can anyone confirm that? I have no PS1 discs.

You need to correct that statement. Put a percentage behind it but don't do it until you have the facts.

I use mine to boot MY games off the HDD. Soon I hope to be messing around with the memory space. That's it.

Allot was lost in the translation of that wasn't it, you poor fools really do think that Sony lost this case.

Tell you what, instead of me explaining it to all you little ones out in hacking land, I will give it a few days for the real translated version to come down the pipe.

P.S.
This whole Writeup is wrong, it's not even close in the meanning of this case.

I guess allot can be said for trure translation, or even beter a hacker that will write anything negitive about Sony that they can even without vetting first.

This is another step that may make Sony even more strict. Maybe their next console they will not sell in Spain or they may make it where you can not play your console unless you are online all the time or something. This worries me that they may also get the Onlive ideas to protect content or something. :sad:

Sony wouldn't miss out on revenue from consoles because of this, you forget even Jailbreakers are customers (the jailbreaking of the PS3 will without a doubt have sent sales of the console up) - I for one bought a PS3 very recently because it had been jailbroken and am very excited to see what can be done with it, and since buying i've bought extra controllers, the ps move starter kit and games which is all money to sony.
