Banned Resistance player appeals, sues for even bigger money

Judge - Image 1Some guys just don't get it. Remember Erik Estavillo? He was banned from playing Resistance: Fall of Man and the PlayStation Network earlier this year, prompting him to sue Sony for "pain and suffering" caused by the ban, as well as for the money he still had in his PSN account that he can no longer access.

His case was dismissed last September 22nd since there was no plausible claim for relief via First Amendment.

The case, however, isn't closed just yet folks.

Estavillo filed an appeal via the United States Court of Appeals for the Ninth Circuit on October 19th. That's not all. On October 14th, he also filed a civil lawsuit against SCEA in the Superior Court of California, County of Santa Clara for US$ 180,000 - that's more than three times larger than the US$ 55,000 he wanted from his previous lawsuit. Nothing else seems to have changed from his last attempt.

With his PSN account banned, Estavillo told GamePolitics that he's currently playing Metroid Trilogy on his Wii and MK vs. DC on his Xbox 360, adding that he enjoys playing as The Joker and that he may be "a bit obsessed" with the character. "“I plan to wear a purple suit during my court trials. No joke!” he said.

With no lawyer to take his case, Estavillo will be representing himself, and in a purple suit no less. By this time, not only would he be challenging the might of the Sony banhammer, but the patience of the judge's hammer as well.
