Two years after shooting four people and killing one of them, Jonquel
Brooks, now 21, has been sentenced, and now he will be spending the
rest of his life in prison all because of a dispute rooted from an
allegedly stolen PlayStation 2. Violent video games again? Not this
time.Prosecutor Burton Francis said that Brooks liked to flash a gun, deal drugs, and act like "a wannabe gangster." The prosecutor, however, believes that Brooks has shown true remorse for what happened.
It was May 7, 2007, when Roderick Buycks Jr. along with three other friends came to Brooks' apartment just west of the California State University, Fresno, campus. The four were looking for Buyck's stolen PS2, which Brooks insisted that he didn't nick, but the four kept arguing with him. Brooks went back to his bedroom, grabbed his .22-caliber revolver, shooting Buyck in the neck, the two others, but Buyck's friend Brant Daniels was killed in the incident.
Brooks testified that he feared for his life and fired in self-defense because he thought that the four, who were much larger than he is, were going to attack him. According to his testimony, after firing a warning shot into the floor, the four kept advancing on him, leaving him no choice but to pull the trigger. Brooks ran from the scene, but later turned himself in. Police did not find the PS2 in question at Brooks' place.
Fresno County Superior Court Judge Gary Orozco sentenced Brooks to 25 years for the murder of Daniels, another 59 years for three counts of attempted murder on Buyck and company, and yet another 25 for using a gun, bringing the total to a kiss-your-life-goodbye of 109 years.

this system is jacked up to the point of no return. sentences shouldn't even reach 60 years.
If what he said is true, that's messed up. 109 years, seriously? They could have killed him, yet he's the one who gets 109 years. Makes perfect sense.
I'm pretty sure that if that happened here, he would have gotten done for manslaughter instead of murder. The dude freaked out. He didn't *want* to kill anyone, just felt like he had to.
Now, ignoring the fact that guns are illegal here, there's no way this dude would have gotten more than 10 years.
10 years is a LONG time. More than enough to rehabilitate.
Now I'm not trying to say that our system is perfect, but what happened to prison being about rehabilitation? How the hell can that happen if you're expected to die in prison?

I donno I'd have to read into this, because it doesn't sound right the man was in his home and a growing majority have a castle doctrine. There has to be something missing in this post. He technically has a right to defend himself as soon as they cross the threshold of his home. Especially with the numbers they had, with the intent to invade his home.

well Jonquel do have some mistakes, gun should always not be an answer for that kind of argument, and shooting all those people just to say its a self defense, i think its not right... remember that thing happened in Jonquel's house right so, he has the right to say stay away from his house, because his friends are tresspassing (that is one way to be legal),and if we say he was been beaten up but if he did not show up his gun i think as of now he has no problems and no one would be killed to that incident, and its ok for me to be beaten up, as long as after that i'll go to police as say the incident happen...
well i think that time he was so aggressive too, that he really wanted to scare his friends with his gun, so i'd say he must really suffer the consequence what he have done, and thats good for him and a lesson for us all ...
It's the state of California. They do not fall under the constitution, apparently they are a different country down there.
If this was any other state he wouldn't be charged with anything. Hell in fact in some states the police can not even hold/arrest you in this situation.
California has no castle doctrine, he was required to run as per their law. He is not allowed to use deadly force unless he is being hit and attacked in his own home (meaning if your on the street, tough take the death and move on, oh wait...no extra lives).
His fate sadly was sealed by the state he lives in.
I like that, you know some people get beaten to death. Exactly how do you go to the police? What if you crippled for the rest of your life, move on too? The only lesson here is don't live in Cali.
He had the constitutional right to defend himself. Something that California takes away from people and allow them to deal with the gangs without protection.
They came to his house and invade his house, he had every right to kill every single one of them. You do not go to someones house and say I want to check your house I think you stole something.
Yes, he could have ran to his room and called the police. However a majority of states, reasonably believe your house is your castle and you have every right to defend it.
The moment they entered his apartment without his permission (as I am led to believe) or refused to leave when he asked/ordered them to do so, their lives were forfeit.
I have no sympathy for the "victims".

Your basing everything off of assumption. If 3-4 people come to your house, and try to get in are you going to HOPE that you only going to get a beating? Are you really going to let them decide your fate?

California puts just as many innocent people in jail as guilty because a lot of their laws are political rather than rational.

Other than in Cali, if you used something other then a gun like a s***** or a brick, then he wouldn't be charged with anything if it was in the house and not on the porch.
If what he said is true then it was obvious self-defense especially that they were "advancing" on him in his OWN apt. Well maybe not his own but still counts as he is a resident of it
I'm sure that all of the news hasn't been released, he was a drug dealer, flashed his gun around enough to grab the attention of more people than he anticipated I'm guessing, and he took another person's life. If he was THAT scared, he should have ran out of the room. He obviously had enough time to grab the gun, he could have just ran out.
The reason for the 109yrs is so that when parole comes up it won't be within a few years of his sentence starting. Instead, because he is likely to get paroled, he will more than likely to spend maybe thirty to forty years at most, depending on his behavior.
Not all people here are *****ed up but a lot of people I know think that if someone comes on your property to threaten you, you should have the right to defend yourself. The thing I wonder is why did he kill them instead of just shooting the legs or arms?
It's not easy to hit a specific body part with any weapon let alone a handgun with all of your faculties. He could have been drunk or high or scared out of his mind.
Man. I dont agree with people getting away with murder... but this case seems so obviously self defense... that I question the judge.
It's not easy under stressful situations you need experience, military or police training to be able to pull something like that off.

Actually quite a few states have that rule. I'm from New York and if you shoot someone that is unarmed and they are in your house you will go to jail. In new York unless you are in immediate danger and it can be proven, you are not allowed to fire at the person. IDK if I'm saying it right, but basically if I was in my house in NYC and someone broke in and tried to steal my money and I chased him and put 2 in his head. I'd go to jail. Is it ridiculous? yes completely, but that's the law here.

Theres definately more to this then we can see in this short post. So I cant be positive of anything. But why would a 19 year old own a gun unless hes expecting to get into some trouble. Maybe its cause I live in a country where guns are illegal but I think maybe this guy was askin for trouble.
I would like to clear one things. You don't sum up the years of the sentence. Brooks is going to be a maximum of 59 years in prison. When 25 years of that sentence pass he will be 34 more years for shooting at three people.
Prison's purpose is not rehabilitation but removal. You remove the destructive elements of society so they can do no harm unto it.
You can't rehabilitate child molesters.
If the story is true then this should be classified as manslaughter instead of murder.
With a history of dealing drugs, I have my doubts. The PS2 was either irrelevant or the final straw. Either the 4 people were vigilantes, rival drug dealers, or drug users in need of a fix.

I think the problem is, they didn't actually enter his apartment. It just says they came to it. He then went back to his room to grab the gun.
The problem is, he could have retreated into his apartment and called the police. Instead he took the law into his own hands.
Also, the comment about someone being unarmed is complete BS. Everyone is armed with their own strength and many people can kill with it. Everyone is armed. You can shoot and kill anyone who poses a threat to your life in your own home. Are you trying to explain to us that if someone breaks into a home, grabs a woman by the back of the neck, rips off her cloths and starts raping her, she doesn't have the right to shoot him until he brandishes his own gun? You don't know what you are talking about.
Now, if they were in his apartment then how did they get in? If he LET THEM IN then ultimately shot them, that's a different story.
So doesn't that technically mean his friends could've been after him for another reason? Like it was said above, it sounds more like his friends were after him not his PS2. Wow, our system "is" corrupt.. Lol. Kudos to him for turning himself in, that means he knew what he did and wanted to make ammends. I'm hoping he's out much sooner than later because 109yrs is simply put "Death Sentence".
nah, on a serious tip, it was a .22, those don't do much damage and don't have a lot of recoil... pretty much anyone can aim one... and there's a lot of space between your neck and your legs, he was obviously aiming for it. but, like orlyeh said, "He could have been drunk or high or scared out of his mind".
We don't have the same laws as a lot of other states but we do get to use medical marijuana legally. that makes up for a few effed' up laws. ^_^

Chances are the sentences will run concurrently and not consecutively. That means that he will serve time on all of his convictions at the same time and if he serves one year, it counts as one year against all of his charges.
That is because you "chased him and put 2 in his head."
You have the option of calling the police, you know.
His friends accused him of having possession of the PS2. Even if he told them that he didn't have it, they would still attack him.

....what if it was a ps2 full of crack cocaine??? it would be worth a lot more than a ps3 and it'd be hella easy to walk down the street with a ps2 full of drugs instead of zip-lock bag... just a thought.
