UK totally bans all DS flashcarts

r4-ds-logo-01Nintendo's effort to further eradicate the rampant software piracy on the DS seems to have paid off again this week as the London's High Court has ruled that the sale, advertising and import of any DS copying devices such as flashcarts is now totally illegal in the UK. Acording to UK gaming site Develop, "the high court set a new precedent by adjudging that it is illegal for the R4 card to circumvent Nintendo’s security systems in order to play content on the DS. This ruling impacts on emulator owners who have hitherto insisted that playing homebrew games on the DS is not piracy."

After the ruling, Nintendo released an official statement regarding the matter and said:

“Nintendo promotes and fosters game development and creativity, and strongly supports the game developers who legitimately create new and innovative applications. Nintendo initiates these actions not only on its own behalf, but also on behalf of over 1,400 video game-development companies that depend on legitimate sales of games for their survival”.

Nintendo claims they've seized over 100,000 game copying devices in the UK alone since 2009.

Nintendo makes some of my favorite games, but maybe if they actually made more good games instead of all the crap they've been putting out lately, maybe, just maybe the sales would go back up.

To be fair, (although it's definately no excuse), I think every platforms lineup these days is full of shovelware.

i agree that nintendo's sales have been lacking due to bad content underworked games and all that jazz. but really? people have already deduced that those people who use flash cartridges wouldn't have bought those games to begin with. C'mon Nintendo your not the only ones being hacked do you hear the competition bitching about it.

Interesting that within a week of the Library of Congress deciding that Jailbreaking an Iphone is legal in the US the UK decides that any flash card that circumvents the DS's security measures is illegal.

Perhaps it is different in the legal sense, but jailbreaking and flash cards are practically 100% the same in the "functionality" they give consumers.

Not really. The reason jailbreaking was made legal is because it's required to UNLOCK the iphone and they made it legal to unlock any cell phone. Because it creates a monopoly.

For example. You buy the first iphone in a contract for two years. Contract states you have to use it with ATT. Ok fine. That's the price for paying close to nothing for the phone. But after the 2 year contract is over you own the phone outright. 100%. So you get to go to whatever carrier you want right? NOPE! That right there is the monopoly. Apple and ATT got sued over this.

So, unlocking is now legal. But in order to unlock you have to jailbreak. The fact that you can steal software is beside the point.

Huh. Y'know, the DSi (hell, the DS itself!) can be capable of NES, GB/GBC/GBA, SMS, Genesis / MegaDrive and other such emulators. We could just buy the games if we had the store for it...
And for the GB/GBC/GBA games? They could still be in the second slot, if you ask me. /minidsirant
