The 3DS has a feature called the SpotPass - with this, the handheld automatically sniffs out WiFi hotspots and downloads updates, rankings, and 3D videos. For the 3D videos, Nintendo has found various partners in Japan and Europe to providesuch content.
In Japan, Nintendo partnered up with Nippon Television Network Corporation and Fuji Television Network to handle the distribution of experimental 3D video content to the 3DS users. Nintendo of America hasn't announced their partners just yet, but Europe has.
Nintendo of Europe has announced that they will be partnering with Eurosport, one of the region's leading sports entertainment companies, to provide 3D sports videos for the 3DS. For animated shorts, SpotPass will also receive support from Aardman Animations, the guys behind Shaun The Sheep.
To make sure that there's enough WiFi coverage across the continent, Nintendo of Europe also made arrangements with various service providers, such as TMN, METEOR, Guglielmo, Linkem, KPN, Deutsche Telekom, and BTFON. For the UK, Sky Broadcasting will be pitching in 3D content from Sky 3D.

Can the auto update "feature" be disabled? I mean, how can nintendo force you to do updates without consent?
If nintendo would add useful features to firmware (like 3d video recording) with each update, people would want to update.
