Apple files patent to disable jailbroken iPhones

Although Apple recently lost its bid to make jailbreaking illegal, the company seems pretty determined to squash down the jailbreaking community as it files a new patent to detect jailbreaks. Titled “Systems and Methods for Identifying Unauthorized Users of an Electronic Device”, the new application will not only protect device owners from thieves and other unauthorized users, it will also allow theCupertino based tech company to remotely disable jailbroken iPhones and iPads. The application reads:

"An unauthorized user can be detected by comparing the identity of the current user to the identities of authorized users of the electronic device. For example, a photograph of the current user can be taken, a recording of the current user's voice can be recorded, the heartbeat of the current user can be recorded, or any combination of the above. The photograph, recording, or heartbeat can be compared, respectively, to a photograph, recording, or heartbeat of authorized users of the electronic device to determine whether they match. If they do not match, the current user can be detected as an unauthorized user.

“Access to sensitive information such as credit card information, social security numbers, banking information, home addresses, or any other delicate information can be prohibited. In some embodiments, the sensitive information can be erased from the electronic device. For example, the sensitive information can be erased directly after an unauthorized user is detected.”

The patent then continues:

“An activity that can detect an unauthorized user can be any action that may indicate the electronic device is being tampered with by being, for example, hacked, jailbroken, or unlocked. For example, a sudden increase in memory usage of the electronic device can indicate that a hacking program is being run and that an unauthorized user may be using the electronic device."

“'Jailbreaking' of an electronic device can generally refer to tampering with the device to allow a user to gain access to digital resources that are normally hidden and protected from users. 'Unlocking' of a cellular phone can generally refer to removing a restriction that 'locks' a cellular phone so it may only be used in specific countries or with specific network providers. Thus, in some embodiments, an unauthorized user can be detected if it is determined that the electronic device is being jailbroken or unlocked.”

You should be because it's fake. Apple and ATT got slammed with a monopoly lawsuit specifically because the iPhone could not legally be unlocked.

That is the main reason JBing was deemed legal. It is unlawful to lock a user out from unlocking a cellphone device (now).

For Apple to disable these devices would be a direct action against the ruling and would only be met with serious punishment.

The only thing Apple could possibly do is lock them out of Apples own services such as iTunes.

I doubt that it will succeed in a legal sense. the courts have already stipulated that people with jailbroken phones are authorised users meaning that they are within the legal parameters to jailbreak their phones and ipads. All apple are doing now is trying to exact retributive justice.

Well apple is known as one of those companies that only wants what THEY want on their phone, original legal terms and everything. hopefully it doesn't to light, i'm going to get (if mentioned) iPod touch, and, well i want to have the chance to choose to jailbreak it.

Looks like apples gonna lose again. Don't be surprised to hear about Jailbreakers v. Apple.

If it's legal, you obviously have no right to disable someones device for using it. ToS are not above the law.

One Sentence the Lawyer would say user buy the phone they can do any thing they want to their phone and that the user right, what is the right tat u pay for the phone and apple disable it... it totally a unsuccessful law suit

It's not about freedom. It's about protecting their platform. Their money like Sony and Microsoft, comes from the software. They're not building the IOS platform to compete on it against other stores Like Cydia or Installous. Every time someone buys an aleternative app on Cydia or downloads free through Installous, Apple loses a potential sale.

Imagine running XBox games on a PS3. Microsoft would have a fit as you did not pay for their platform or network service, whereas Sony would not like promoting usage of their competitors software on their platform. Apple is essentially trying to protect the ownership of their platform by controlling it and how much freedom they allow on it. Itunes Store and App Store are the breadwinners. Replace those with Netflix, Hulu, Cydia, and Ares Galaxy and you have no revenue going into their own stream. Everyone getting rich off their platform but them. That's what they're combating, not Freedom!

Did you know that the cydia app store allows many people who were turned away by apple to distrube there apps to people as they work very hard. You don't see Microsoft's windows mobile shutting its platform from other developers do you. In fact I know many alternatives to the microsoft appstore which are all legit. I suggest you stick your head down the toilet and flush it!

While I'm usually all for someone protecting their product....there has to be limits.

As we all know (or should) DRM only hurts paying customers. Apples closed eco system is actually much better then DRM so that's one major plus.

Either way, there's a way around it so what are you people bitching about?

As for your comment about people working hard for nothing because apple turned them down...BOO HOO! Maybe those idiots should have read the guide lines before making an INVALID product.

Why do they insist on wasting their money on these lawsuits? Why don't they just invest it in to making their products better?

And maybe if they weren't retarded enough to lock down their products to authorised content only, people wouldn't need to jailbreak them.

Seriously. Symbian OS is finally becoming a mature platform and you can run almost any app on it that's made, as long as it's compatible with the phone.

It may be legal to jailbreak but they can still block you from using their services, in this case 3G obviously since this doesn't seem to apply to iPod touches. I'm guessing it will just block the device from using the 3G network similar to how MS blocks hacked consoles on Live. They have the right to do so since you agree to their TOS to activate the phone.

apple doesnt provide the 3g service the telephone network does. the only thing they can do is stop you using itunes.

They can disable the 3G chip though, they can probably do a lot of things with it that people don't even know about. If they can lock down the whole phone if it's stolen surely they can disable individual parts of it as well.

I see some basic human rights infringements here if they try to implement anything taking photos or voice recordings, because how many times have people innocently bought a stolen phone from Ebay only to be reported stolen and network locked? Or someone sells the phone and just decides it's fun to report it stolen, if this technology is put in a phone then it can only be used by the police after they done the basic checks and Apple won't be allowed access to the information, and i expect it would have to become industry standard on all phones before it could be enforced anyway.

I'm glad someone had the sense to notice the immediately insane part of that post! The thought of Apple remotely using the camera and mic to track and monitor who's using the phone at any particular moment to verify who's in posession or using the phone... I doubt Apple would recind access and provide such a tool to a third party as the police but it's a nice provacy protection if they implemented it that way.

That is something Apple is working on FOR OUR PROTECTION from thieves. It's called facial recognition. I'm sure you've heard of it. Same with voice and heartbeat. Apple is playing with those techs for us to log onto our iDevices and if someone is capable of bypassing the initial login (like taking your phone after you log in, which is becoming more and more of a problem) then the Apple service can remote disable the phone after the phone calls home and says, HELP!

THAT HAS NOTHING TO DO WITH JAILBREAKING!!! !

Jesus Ryan, check your facts before regurgitating this crap!

The only way jailbreaking comes into the picture is because once the phone is jailbroken, by default, it's open to external attack. So unauthorized use is possible without you even knowing it.

Ok. yes the Iphone and all other iDevices are able to be jailbroken and if for instance apple does try to get a patient for something to disable or lock our phones and it goes thru that will be illegal because its going against a law already in effect that says a user may jailbreak their phone and apple cant do anything about that. This is gonna be the saddest battle in court for apple.

So I hope it came as no surprise to anybody when the Supreme Court told apple to go Fu#$ themselves.
The metaphor one judge used was "that would be like car dealers welding the hoods of cars shut and not letting you work on them. You guys are insane."
It's your property, you can do what you want with it. All they can do is refuse to cover your warranty if you're stupid enough to walk into the Apple store without restoring your phone first.
FYI
They can't actually check to see if you have jailbroken. The only way they can tell is by spotting jailbroken behavior or apps. I've already gotten my jailbroken iPhone replaced under Applecare when the wifi was bugging out, and they even plugged it into their computer to trouble shoot it. Plus if you restore before you go, your phone will no longer be jailbroken and you can redo it later. Walking in with a working jailbroken phone and asking them to check it out is like jumping up and down and screaming "hey i'm a dumbazz please void my warranty for me will you?" So it's your own fault if you do something that silly.
