Certicom sues Sony for patent violation: much ado over Blu-ray content protection |

Our previous report on legal actions against Sony involved Target Technology and their claim that Sony's Blu-ray infringes on their patent. While that one was more about the more on the materials in the Blu-ray disc, this new lawsuit, this time from Certicom Corp, claims that Sony Corp's Blu-ray infringed on two US patents on digital content protection.
The suit claims that Sony is using Certicom licensed digital encryption technology (AACS) in Sony Blu-ray HD products. Certicom also claims that a digital transmission patent (Digital Transmission Content Protection or DTCP) was also infringed by Sony as it is being used without a license in wireless and audio devices.
Sony products affected by this suit include: the Playstation 3, various Sony DVD players, VAIO personal computers, and some Sony HDTV models and audio equipment.
The suit was filed in the Eastern District of Texas, Marshall Division. Certicom Corp is represented by the Fish & Neave Intellectual Property Group of U.S.-based law firm Ropes & Gray.
With two lawsuits regarding a format that could arguable be Sony's biggest ace, it seems that other people's sentiments that folks are just trying to "cash-in" are starting to gain credence, but that's just one way of looking at it. What do you folks think?

Patents suck, anyone can file one. I know what ill do, ill file patents for lots of cool imaginative things, and when someone developes them, BWAM ! sue their asses off !

Its never going to happen but it would be sweet if Blue-Ray and HD-DVD just dumped AACS entirely to solve the issue.

Also the encryption transmission can be avoided easily because a lot companies uses encryption to transmit like Microsoft with XBLA and other things.
These can be fought and won easily unless the companies ask for a small settlement and if thats the case, Sony may just settle.

Let’s compare the most sold X360 game and the most sold PS3 game (HEAD TO HEAD DEATHMATCH); then talk about which console is superior to another at the end. Each category is worth 100 points unless mentioned. If it’s drawn, both get half points.

[Epic’s Gears of War Vs. Insomniac’s Resistance: Fall of Man]
- Gameplay (300 pts): Resistance is a generic and mindless run & gunner. Epic adopted and improved Resident Evil 4’s point of view; then GoW’s over-the-shoulder revolutionized the gaming industry. Now, Sony’s best future games Uncharted Drake’s Fortune and Ratchet and Clank Future (when using weapons) both totally copied GoW’s point of view. Winner: GoW
- Graphics (300): GoW wins by a land-slide. No need to discuss more. Winner: GoW
- Awards: Many gamers bought GoW because it won so many awards. Winner: GoW
- Main character (200): Epic did a very good job on this. Marcus Fenix is as memorable as Halo’s Master Chief. Resistance’s Nathan is simply too boring to control. Winner: GoW
- Average review score: GoW got 94 from 172 different game related publications; Resistance got 89 from 164 publications; many gamers bought GoW because it got extremely high review scores.
Winner: GoW
- Level of Appealing (Fun Factor) (200): Resistance is all about run and gun like Halo 3 or Unreal Tournament 3. GoW has deep tactical play. Winner: GoW
- Online Modes (Multiplayer) (300): Resistance offers much more game types, but all of them are mindless run and gunner. GoW should have supported at least 8 versus 8 multiplay (4 Vs. 4 is just sub-standard). Winner: Drawn
- Single-player (SP): Resistance’s developers spent so much time, budget, and effort on this (Resistance’s SP is much longer); the thing is that Resistance’s SP is plainly boring and not even fun. Winner: GoW
- Weapons (200): Resistance has technically extremely advanced weapons, but these weapons are not balanced for multiplay. GoW has much less number of weapons; the thing is that lancer (the gun with chainsaw) alone is better (the powerful feeling; sound, lighting, and decal effects) than all weapons in Resistance combined. Torque bow and boomshot are extremely well made, too. Winner: GoW
- Music & Sound Effects (300): Resistance’s sound is on average; GoW’s sound is superb (especially guns and explosion sounds are mind-blowing). Winner: GoW
- Longevity (Replay Value) (300): Resistance’s run and gun gets old extremely quickly. Winner: GoW
- Technical Advancement (200): Resistance’s extremely huge maps + 42-player online + Resistance’s bull’s eye and sapper guns. Winner: Resistance
- General Concept & Originality: Resistance is a copycat of Half Life, Call of Duty, and Unreal Tourney. Winner: GoW
- Character Animation: Both games offer silky smooth movement of units. Winner: Drawn
- (NPC’s) A.I.: GoW’s AI is better made. Epic did a very good job here. If you kill one enemy in GoW, you feel satisfied and rewarded; if you kill one (or ten) enemy in Resistance, you feel bored and lame (LOL). Winner: GoW
- Atmosphere (Presentation) (200): GoW’s sci-fi movie like mood is all over the places. Winner: GoW
- Interface (attention to detail, how polished is the final game?): Winner: Drawn
- Overall Impressiveness (300): In general, GoW even deeply impresses diehard Sony fanboys. Winner: GoW
Finally, GoW won by f+cking huge margin.

- GoW’s total score: 3,050 points

2) No one in this thread said anything about PS3 being better than 360. You were the one who started going on about Sony stealing. You forgot that Microsoft steals as well (possibly more than Sony) and thus you were pwned.

on sony side these allegations are somewhat outrageous and should not be the fault of sony but by the Copyright Patent System.

You know nothing about the suit, technology involved, company suing, anything. No, sony wouldn't do that you think. Let's just see what happens maybe?
Any company in a disc producing business could find out if they were infringing on patents without difficulty if they wanted to. It's also unlikely they would independently develop something nearly identical.
What has MS stolen? As I recall with controller rumble, it was MS that paid immersion to settle out of court and it was sony that chose to fight it. Sure there was some controversey over Windows' GUI borrowed from Apple but that was 22 years ago. A company like MS doesn't need to steal, a company losing 2 billion dollars last year does.
Why do you try so hard and so desperately to defend the actions of a company like sony that used you for blu ray ginea pigs and won't make games for your console?

Then you can sue sony if you want.
The second lawsuit deals with blu ray's copy protection only because it is has a little extra protection over HD-DVD.
Who knows if these are credible, but I truly believe sony will be guilty in at least one of the cases. They always try to fight everything.
