SCEA slaps lawsuit against PSP pirates on Craigslist

Via GamePolitics, we hear that, last August, SCEA filed a lawsuit against some PSP pirates hawking their wares and services on Craigslist. The two alleged culprits are both from San Jose, California: Timothy Joey Zoucha Jr. and Gabriel Garcia. A court hearing is scheduled for late October.

The preliminary statement of the filed complaint (see Via link below) reads that the two of them:

[...] brazenly offer their services on Craigslist.org to "mod" or "unbrick" PSP consoles so as to allow illegal unauthorized copies of SCEA's video game software to operate on the unlawfully modified PSP console.

The rest of the complaint talks of how investigators were sent to check out how these two guys operate. Much to say, they were caught red-handed.

The story goes that the culprits modified the investigators' PSP units and loaded illegally copied games (Patapon, God of War, and Crisis Core just to name a few) as a package deal. One of the investigators was even sold a bundle of 11 DVDs containing more games and a tutorial on how to load games from the PC to the PSP. (Which brings to mind an age-old article where we exposed the piracy situation in the Philippines)

O wow. All this, right after hearing about the new anti-piracy law yesterday? Yeouch. Looks like these two guys in Cali just got a golden ticket to a life of misery.

wow

These craiglists guys are such tremendous idiots. Who the heck is stupid enough to advertise physical piracy, on-location, and probably for chump change? "Joey Zoucha Jr", "Garcia" man they even have greasy douchebag names...

by Apeaggedon - 2008-10-15 11:59:55
everyone is man....

its awsome IMO. thats how i got my psp modded,i found some dude that does it thru a craigs list add. they stopped like wut? 2? there's freakin thousands on craigs list about the psp mod services.... you cant stop it,piracy is HUGE over here in CALI.

by akadewboy - 2008-10-15 12:01:19
Those idiots

They would have probably been fine if they didn't give the undercover guys ISOs...

by Jookycola - 2008-10-15 12:47:51
True that

I've modded PSP's but i refuse to offer .iso (free games) files, or movies. That's illegal period. I tell people you can find all the info for free games and movie all over the net...all i do is unlock the psp. Unbricking or installing custom firmware IS NOT illegal. It's YOUR psp and Sony can't tell you how you use it.

by cory1492 - 2008-10-15 13:41:04
...

That really, really depends where you are Jookycola - and keep in mind in this case it is about what someone else is doing for a fee and not what you are doing to your own hardware.

by Foolmonkey - 2008-10-15 13:53:35
CFW is NOT illegal

Even if you pay someone to do it. They won't get in trouble for that, but they WILL get pwnd for including ISO's with it.

by 73N5H1 - 2008-10-15 15:41:36
D U M B

it wasn't modding the PSPs to CFW that got them in trouble... it was giving out pirated ISOs. What a bunch of idiots. They deserve being busted for being so stupid.

by digicron - 2008-10-15 15:44:58
@cory1492

you are wrong. if you purchase the hardware, you are allowed to do whatever you want with it, wether that is physical/software mod. now if you offer pirated software with your mod's then that is where it becomes illegal. or if you play pirated games on your soft/hard mod, that is illegal. BUT any hard/soft mod is legal, its what you do with it that can be illegal. and this is for multiple countries (US, Can, Brit and some Euro countries).

by FreePlay - 2008-10-15 16:29:00
LOL

digicron, you are very very wrong.

by Neko Kyu - 2008-10-15 19:26:38
I like sail boats :D

That's is the one kind of piracy i DO disapprove of very much D: Selling someones creation that's you STOLE for profit is the worst :/ and as for modding a PSP... While it is not illegal, it IS against the terms of service to modify the firmware and use the PSP for any other use other than intended, and they have the right to file a class action lawsuit against you :/ and unfortunately for most people, they cannot afford a lawyer to compete against a corporate giant such as Sony.... so whether you are "right" or "wrong" doesn't matter, in the long run its whoever has the bigger pocket book D: but yes, technically it is not violating any law (that I'm aware of) ((( Sorry for rambling D: )))

by Neko Kyu - 2008-10-15 19:35:34
on a side note >_>

those guys are idiots XD ((sorry had to continue haha)) What better way to paint a target on your head than to advertise that you sell pirated games on a puplic site?? OMG...

Wow this is serious!! I have to delete some of my videos on youtube because of this. OH Snap!...

by houaruto - 2008-10-15 21:59:43
for crying out loud

It would be smarter to head to the Police station and confess what you do with iso and how many people you handed it out to ........that way you get a less jail time/money striped

by smittastical - 2008-10-15 22:19:40
lol

whats funny is as long as you delete the iso or cso or what-have-you in a 24 hour period then its totally legal to be in possession of them. there are only a small handful of companies that will go after you if you even posses a rom or iso image of there software such as Nintendo with the mario series , sony i doubt could hold much water so long as the "culprits" would have offered all the iso files as 24 hour demos. how do you think the thousands of sites hosting the files from nes-snes-sega- up to the ps3 ...100% )and i don't care who tries to argue for hours or throw a fit and claim its not them cause there so faithful to sony) of the people with modded psps have used an iso or some sort of illegal firmware that's been reverse engineered and not totally made 100% from them . its sickening to hear all the people act like there not... i dont condone it or tell people were or how to get them personally but its sickening to listen to people act like there ***** dont stink when i can smell it from here!

by tinjastin - 2008-10-15 23:08:52
nah its very common to our country!

here in our Country (Philippines) those kind of store a very very common, i mean its very rampant malls you go any small shops can offer psp upgrades and psp games... but nothing can stop them as in nothing! you know why? because there are syndicates running the place and some are muslims too, so i dare those SCEA come to Manila and see the piracy here you will be suprise to what you will see in our country!.. well sorry SCEA but i think you are lousy enough the get all the culprits around the world and YOU CANNOT STOP IT EVEN YOU PUT ALL YOUR DAMN MONEYS IN COURTS!... Haha, Piracy Wins! ... SCEA are Bunch of Losers

by PT-X - 2008-10-15 23:50:30

Congratulations!

You have just won the prize for "The Most Idiotic Comment on QJ This Month". Be proud of yourself. Especially this sentence: "whats funny is as long as you delete the iso or cso or what-have-you in a 24 hour period then its totally legal to be in possession of them." The dumbest thing I've EVER heard.

by Raijin-oh - 2008-10-16 07:36:55
PSP-3000 are sold anywhere, even in the philippine islands

you see,the PSP-3000 has a lot of piracy-deterrent mechanisims w/c can be impossible to downgrade, unless i still have my two-year old PSP phat.

by _YOUR_MOM_ - 2008-10-16 08:02:12
OMFG

How come that one can assume that modding a psp could be illegal in any way? (im not talking about pirating (Harrr!) Its YOUR PSP - u bought it - u alone choose what to do with it. if you use CFW - thats legal, coz there come no SE -files with the installroutine. The needed files are extracted from legally obtained OFW-updates. SE could of course void your warranty for that, but not more. Dont believe it when SE or some dumbballs try to scare you and tell you otherwise. CFW IS NOT ILLEGAL. Period. it seems the brainwashing industry get to you people... I challenge all who disagree to show me a sentence/conviction on the sole charge for operating a CFW or stfu already

by DSpider - 2008-10-17 00:39:24
pfff

You my friend, are an idiot. If Sony sues the crap out of them modders, pirates and "ISO sellers", even if they spend a couple dimes on lawyers and court sessions, they would get as much as 50 times in return. Someone modds PSP's for $10 ? They sue him/her for a 10 grand. Someone retails ISO's for five bucks a pop ? They sue for $5.000. There's a article on Qj stating that the PlayStation brand benched 4.03 BILLION $$$ from January to September (this year alone !). Do you even know how many zeros are in a billion ? They have the finances, my friend... They're not suckers if they act upon it, they're suckers if they don't.

by Mister Common Sense - 2008-10-17 21:02:32
to houaruto

you should to confess to police you're a moron.

by _JG_ - 2008-10-20 23:40:40
so..

did these guys get into trouble for charging money for the iso that they downloaded, cos i thought if you found a link, and share'd it thats not your upload/fault. (i don't care what you think of me, so ***** away)
