GTA: Vice City blamed for New Mexico '04 killings |

Remember that incident on newsman Sam Donaldson's New Mexico ranch a couple of years back, where a 14-year-old shot his father, stepmother and stepsister? Well, Cody Posey is now 16 years old, sentenced early this year to state custody until he is 21, and is yet again involved in another lawsuit, this time, alongside corporate bigwigs.Surviving family members of Posey's victims filed a US$ 600 million lawsuit, naming Posey, Sony Corporation of America, Take-Two Interactive Software, Inc. and its subsidiary Rockstar Games as defendants. According to the suit, the companies are just as liable as Posey himself for the killings because they were in on a "civil conspiracy', creating entertainment that 'would spawn such copycat violence'.
The violent entertainment being referred to here is the video game Grand Theft Auto: Vice City, developed by Rockstar Games. The GTA Series depict police killings and other acts of violence. The lawsuit also tags the various editions of the game 'virtual reality murder simulators'. Said the plaintiffs, the game trained Posey 'how to point and shoot a gun in a fashion making him an extraordinarily effective killer without teaching him any of the constraints or responsibilities needed to inhibit such a killing capacity'. The lawsuit goes on to claim that if it were not for Posey's use of these products, he would not have killed.
As if to further strengthen this point, it was also stated in the lawsuit that the plaintiffs' lawyer Jack Thompson was told by a sheriff's deputy that the game and a Sony PlayStation 2 were found at the ranch.
On the other hand, Jim Ankner, spokesperson for defendant Take-Two said they believe that the suit is without merit.
And so we see another instance where video games remain to be the only logical answer why a minor would suddenly go on a killing rampage. From the looks of it, it sure seems like the gaming industry has now got its own McDonald's version when it comes to lawsuits relentlessly attempting to pin the blame on factors and events that do not necessarily have a causal relationship.

That someday when parents choose to let video games raise their children that they'll reconsider giving them "M" rated games. I have a dream that someday parents who can't/won't/shouldn't be a part of their offspring's childhood will provide an environment where video games are offered as what they are; entertainment first, education second. I have a dream where kids are taught right from wrong by a father/mother figure and not Claude Speed, Tommy Vercetti, Carl Johnson.
I have this dream... so I'm going back to sleep with the firm knowledge my kid won't kill me in my sleep.

This is total bull*****. Rockstar will not lose this case! If someone is going to commit murder, they dont need a video game to make them do it. Millions, upon millions have played this. Obviousally one of those million will already be screwed up and do something stupid.
I can make a case that If I see a pot smoker watching T.V. that he got the idea straight from the tv, and I can sue them cant I?
I cant believe the court is even tryin this case. How can u compare moving ur fingers and thumbs to training someone to kill. Also video games are sort of a release of anger and hostility. I know people who are pissed and instead of going and hurting people they just play COD2 and shoot some virtual people online. Video games are merely a vent and unless there is some subliminal message sayin kill ur parents, they have no case. Aslo I agree with the first comment. Why buy ur child a game that has a M rating. These family members are just trying to make a huge profit off of their tragedy. If that kid had decent parents, first of all they wouldnt have bought him an "M" rated game, and second of all, they would have been smart enough to know whether or not he was a bad apple. But I guess we cant all have good parents, can we? Its the kids fault that he killed them, he is the one that pulled that trigger and he needs to be punished. But it is not the games fault. Games are no more of a "virtual reality murder simulator" than movies, television, or anything else that someone can view. And that argument the prosecution is pulling out of their crack is faulty and full of crap at the most. Studies have proven that games do not affect how a person acts. Its just an easy out to blame as an excuse, or an easy way to make money. And with a lot of powerful people out there that are against these games, like that witch Hillary Clinton already against Rockstar Games over the San Andreas sex scene, these idiots on this case will probably win. Its pathetic that people would stoop so low to blame a game just because they want to make money, or that they want to avoid being punished for their actions. One more thing. Since people can obviously sue over games, can I sue them for emitting to much stupidity and Carbon Dioxide into the air, and thus lowering my quality of life? Unfortunately, I cant, but if I could I would sue their asses off.
Although I grew up on the "video nasty" era at the same age, even encouraged by my mum who is a horror film fan as well, I'm a normal well-balanced individual (some may disagree :)), so it's just plain retarded to try and blame a game for murder. I've played every type of game, watched lots of banned (at the time) horror films and I've watched more than my fair share of pr0n (I WAS in the Marines :)).
What about people who are drunk when they kill someone? Does the drinks company get sued...oh, don't; PLEASE noone post a link where that actually has happened, because surely it can't have? I think the remaining family members should be locked up for what in my eyes amounts to attempted fraud.

I've played all the GTA games since the first one and despite having a few arguements with my family I've still yet to shoot any of them. I suppose there's still time but I'm not planning anything at the moment.
Who knows, maybe after playing too much Tetris I'll try to stack my family members up side by side to see if they disappear

If games affected people as much as the media say they do, we would be living in a world of Pro Athletes after playing the likes of FIFA, ProEvo & Madden. Or even unbeatable UFC champions after long bouts of Tekken, Virtua Fighter, Street Fighter etc.
The fact that there are not huge numbers of Football greats, UFC Champions, et.al tell us all something. I am 29 years old and I grew up with the start of videogames as well as I used to watch lots of horror shows, violent movies and cartoons as a small child. I used to listen to Black Sabbath, Led Zeppelin and others back in the day with family and friends and now I listen to newer metal and play the newer games and watch movies that show lots of violents and evil stuff on them and I am fine. I have a pretty good full time job, and family. Sure sometimes I get mad at the world but I would not start killing a bunch of people, only maybe in self defense but only if that was the last resort. Some people are destined to kill others by their mentality even if you try to tell them not to have that attitude they still would attempt these types of acts. As far back as the start of life things have always killed other things and that is just how it is no matter what you do about it you can't stop it. So does one sue a spider for killing a fly or a tree for supplying the club to beat something with. Maybe I could sue the Earth for giving me a rock to drop on someone. I think you get my point by now that you can't stupid proof the world.

We got good ol'jack trying to be on TV, the family trying to cash in on the death of their loved on... I mean the death of the other family members. Plain and simply put a parent that would buy a young kid GTA, shows the kind of parenting they have been doing, neglecting their kid, and so on, poor kids grow up with all sorts of problems. Anyone who's ever played any of the GTA games know that the way the games are made completely and utterly does NOT train you to actually use a weapon in real life. The games aren't even in first-person for crying out loud. Now, if they really want to get into a game that trains you, they should sue Nintendo for Duck Hunt. Man, that little toy laser gun gave me the perfect aim I have today.

First, a video game can't train you how to shoot a gun period. Its common sense when you want to kill someone else with a gun you don't need much training. Point and pull the tigger. It's all based around guilt, they feel guilty and as though they are to blame, maybe they are maybe they aint, it could have been the people he was hanging around with or just overly influenced (by games, yes it is possible) What am saying is, they feel guilty, so they just want to pass the blame, so they feel less guilty for letting him get so bad (again despite the fact it may not have been their fault anyway.)

The parents violated their parental duties at least twice. I don't even want to know how much else they diseducated the child. *****ed up families shouldn't get the possibility to sue other for their own faults, especially when it's so *****ing obvious (a game does not train anyone to do things in real life, you just can improve your reactions and intuitivity at specific situations, also the game surely didn't include the weapon, god damn).
The judges at court are also pretty much *****ed up if they give reason like this. I really wonder how stupid people can be and still get into positions where they get to decide over others. And that's not only in America... the courts here in germany aren't much better either

Ok... How can a third person perspective game teach someone how to fire a pistol if the characters in the game can't even hold the damned thing the right way? Being an avid Grand Theft Auto fan, and also a kid just turning fifteen soon, I can say that GTA does not turn you into a cold blooded killer. In fact, I would never kill somebody if I had the chance. And I'd like to wonder how such a game 'teaches you how to point and shoot a gun', turning you into a merciless killing machine. In reality, there's no R1 button that targets a nearby enemy, nor is there a large O button that automatically fires the weapon in a perfect line to the target. These accusations are nothing but crap.
hey, i got an idea. lets ban english books too since they teach us english to understand what is going on is these games which then teach us how to do these violent acts. cut them off at the source =p

I always was against people like Jack Thompson because of their extremist actions but few days ago I realize that when you go to Babagges and Gamstop most of the kids who buy games like GTA are just 9-12 year olds and although I bought GTA 3 when I was 11 , I feel a bit insecure that minors play that games , why? , I know that unlike me there are kids who there parenbts don't spend time with them and there are many kids who act by gropu pressure and there are many kids who have anger issues and there many kids who can hardly dsitinguish truth from reality , some of those kind of kids buy this games and have a capability of causing massacres. And I know the fault is not of the videogame companies but we gotta face that that doesn't change parents will be responsible , with todays many troubles ( especially in America as a whole , not just USA ) many parents don't have time to spend time with their children and parents like those are million so it's a problem that cannot be solved , that's why I think that to some extent we should limit what can be done in violent videogames.

i agree with 31 how does me playing a video game make me able to swing a sword, throw a grenade, steal a tank off a military base(cant wait for someone to try that one). Jack Thompson is the scum of the video game universe. He takes that "lawyer defending his client by any statement necessary" approach. You can see that in all of his bu!!s#!t statements that he tries to use as facts. (He tried that s#!t with Adam Sessler and got chopped the ***** up really quickly) When he has to defend his statements he has to think of more bu!!s#!t on the fly or tries to change the subject. My parents buy me these games, and I will say, there are a lot of people I would like to shoot, but it isn't because I've played the games and think it's okay. Just because I don't like them and would be happy to see their funeral.

No one even knows what happens when someone "dies" The real kicker is that, you can't even define every word to the sentence of "Little Jimmy has died" Because then you would have to define every word to your previous definitions, and it would all repeat on a lot of paper, or in a lot of words. No one knows what these words mean, every word is only made up, sure we "think" we understand them, you think you understand what I am saying..but you don't really, because you didn't make the words up. The kid shouldn't have been playing this title at his age anyway, the "rating system" doesn't allow this game to be bought by someone of his age,Who bought this game for him, who let him play it.This rating system is done as part of the protocol of the release of a title on all Sony , Rockstar and all other Games systems. If this game was being played by the Kid at this young age, what were his gaurdians/ Parents doing. Thats first. Secondly, I'm guessing this kid would've seen 15+ movies so is Holywood to blame? Crap,Im guessing this kid lived in a dysfunctional family and/or has some serious issues. To not know it's wrong to shoot your family is a failure of his parents and guardians when his parents weren't there. It's ridiculous this would even go to trial. Let's hope Sony and Rockstar winand set a precedent (IM not a legal expert) and common sense prevails for a long time to come. What a load of Crap.

to blame GTA for training people on how to use firearms and steal vehicles is too silly to believe. Hell, to steal a vehicle in GTA you stand next to it and push a button. And the guns aren't realistic at all! To blame GTA on crime is silly. It is true that you could easily get M rated games even if you´re underaged. I am fourteen and I can get M rated games in all the nearby stores. Anyway, this is in Sweden, and I don´t know how it is over there. I have seen both Fahrenheit 9/11 and Bowling for Columbine. See them and talk to me in a week.
