Anascape Ltd. Drags Nintendo and Microsoft to Court |
Ó
Anascape Ltd. has just recently claimed that Nintendo and Microsoft have both infringed on their patents for various controller designs. The thing is, it is not just for one supposed infringement, but 12 different ones! We've come up with a list that's a little on the techy side, but that shouldn't be too much of a problem:Patent #5,999,084 "Variable Conductance Sensor"
#6,102,802 "Game Controller with Analog Pressure Sensor"
#6,135,886, "Variable Conductance Sensor with Elastomeric Dome Cap"
#6,208,271 "Remote Controller with Analog Button"
#6,222,525 "Image Controller with Sheet Connected Sensors"
#6,343, 991 "Game Control with Analog Pressure Sensor"
#6,344,791 "Variable Sensor with Tactile Feedback"
#6,347,997 "Analog Controls Housed with Electronic Displays"
#6,351,205 "Variable Conductance Sensor" (A different patent)
#6,400, 303 "Remote Controller with Analog Pressure Sensor" (A different patent)
#6,563,415 "Analog Sensor with Snap Through Tactile Feedback"
#6,906,700 "3D Controller with Vibration"
After Immersion cashed in on the case against Sony on their infringments on 8 different patents, netting over $90 Million, another lawfirm is following suit, though this time it is not against Sony. It looks like after the success of Immersion's lawsuit, others are looking to make a quick buck the same way. It seems that the video game industry has now become so competitive some companies have to go to court instead of just making something better to offer the consumer - at least that's how it's looking these days, more and more.

LOL First of all learn how to *****ing write. They don't have to sell out? They are going bankrupted? That's not even a word you tard. If you read any news articles you'd know that Sony's profits are up this year regardless of costs for anything. So shut up you stupid Xbox Fanboy flamer.

Well, its buisness, if they are competitive companies (And we all know how competitive they are.) They are bound to go on lawsuits for anything, soon well see that nintendo will get sued by sony because they started using two analog sticks on the GC controller, even if the first analong stick was on a nintendo console (as far as i know of course) , then nintendo will have to sue microsoft for another minor thing, then microsoft will sue sony for entitlements and on and on, its just predictable buisness, sometimes war seems less elaborate.

This is a competitive market, people are going to do whatevr they can to make thier system #1. Immerson started it with Sony, so in turn they have to make that money up somehow...I don't think these patents are pure speculation...so why not go after a competitor.
Like i said, I could care less what happens, I have somethings from all 3 companys, I enjoy all 3 companies differently...

Also, for this patent:
#6,135,886, "Variable Conductance Sensor with Elastomeric Dome Cap
Thats basically a mini analogue stick, present in the Xbox, PS2 and Cube, but also present in the N64 (Nintendo initially pioneered the mini analogue stick and were the first to have an analogue stick as standard on a controller) but Sega brought one out for the Saturn before that with nights into dreams. so I cant see where sony are coming from with the analogue stick thing. they only brought out their analogue pad cos nintendo & sega both had analogue sticks in their pads, and nintendo had brought out the rumble pak. so im not sure theres much (if any) opportunity for them to patent something they probably made in retaliation.
@ Sparksalot
Im not sure about who patented what first, but your story sounded almost plausible until I reached this line:
"Theres a link somewhere over on the PS UK forums"
Oh right yeah, over there on the 100% neutral playstation forum. Nothing can ever be impartial from a playstation website, same as any other forum which holds people who are brand loyal. Im not sure i wouldnt take anything pro-sony from there with a pinch of salt.

To number 32, those are patents man, there's obviously a difference in technology other wise Sony couldn't patent it. ALSO! Have you ever seen the making of the analogue stick on a n64 controller??? IT is some wacky 2 teir, piviting system that doesn't resemble the normal analogue stick that's in PS2/xbox/gc controllers at all! Don't believe me? Take one apart and see for yourself.

you cant sue some one for copying ideas about somthing if you were making the ideas for it wile you were never supost to have the thing your making ideas for in the the first place.

It's some sort of gun to the head of anyone who wants to make actual progress in technology.
"Hah! You can't make that without paying us millions and millions cause we got patent!"
I really love all these people going "Hah! suits you right for stealing from sony!" while Sony has nothing to do with this whole article.
Oh well.

ARCADE GAMES have a joystick. Joysticks have...well a joystick. Hey, if you want to get down to the facts, creators of atari or whatever should sue sony, nintendo, microsoft, and everyone else who has a joystick.

gues that just shows that Nintendo and Microsoft fanboys CANT READ.

That's assuming Sony 'is' the first to have patented it.

Sony is just an example.

Looks like all 3 companies will be at everybodys' necks for a long time (well, maybe just Sony vs. Nintendo and Microsoft - haven't seen any quarls between N and MS).

oh and look sony's controller is a knockoff of the super nes pad...
microsoft uses the dreamcast/saturn analog controller...
gamecube's controller was a analog/dpad swap of the ps2 dual shock...
the wii virtual console controller looks exactly like a sony dual shock...
i mean so really you had the joysticks from the pre-nes days, the d-pad from nes on and the analog from n64 on. along with vibration from nintendo...
gameboy color had motion sensors 10 years ago...
kirby's tilt and tumble.

For example, in a copyright case Barnum and Baily circus sued the State of Utah for infringing on their slogan, "The Greatest Show on Earth". For years Utah had been using "The Greatest Snow on Earth" as a slogan and stamping it on all their license plates and other official and promotional materials. When Barnum finally tried to sue, they lost the case. Even though the copyright was still valid, they had gone so long without taking any action that "The Greatest Snow on Earth" had become integrated as an important intellectual property of the State of Utah.
While copyright and patent laws aren't exactly the same, they share most of the same legal principals. There are other cases like this that have to do with real estate law as well--in most states, if you live on and develop a piece of land for seven years, it's yours (you may have to pay back taxes on it, though).
The legal principal is, you can't sit on a patent and wait until everyone in the world has infringed it, and then sue everyone in the world. After a while people have to assume you're not suing because you don't care.
The Immersion case began a long time ago, so it was easily within the "window". It didn't help $ony's case that M$ settled either.
Anyways, long post. . . the point is, this case is a scam. $ony has to be involved on some level if they are not being sued as well. It will cost all parties a lot of money no matter what happens. And nobody wins if everybody loses.
