A few documents containing additional details about the settlement agreement forged between Sony and PS3 hacker George "Geohot" Hotz have recently shown up on the web.
An official statement released by Sony Computer Entertainment America yesterday revealed that "as part of the settlement, Hotz consented to a permanent injunction." The permanent injunction apparently involves Hotz being barred from ever tinkering with any Sony product unless Sony explicitly allows him to.
Here are the things Hotz is barred from ever doing as laid down by the settlement agreement:
- Engaging in any unauthorized access to any SONY PRODUCT under the law
- Engaging in any unauthorized access to any SONY PRODUCT under the terms of any SCEA or SCEA AFFILIATES' license agreement or terms of use applicable to that SONY PRODUCT, whether or not Hotz has accepted such agreement or terms of use, including without limitation:
- reverse engineering, decompiling, or disassembling any portion of the Sony Product
- using any tools to bypass, disable, or circumvent any encryption, security, or authentication mechanism in the Sony Product;
- using any hardware or softare to cause the Sony Product to accept or use unauthorized, illegal or pirated softare or hardware; and
- exploiting any Sony Product to design, develop, update or distribute unauthorized softare or hardware for use with the Sony Product.
- If any term of such SCEA or SCEA Affilates' license agreement or terms of use applicable to that Sony Product shall be determined by Congress or by a court of law in a final non-appealable decision in an action to which SCEA or an SCEA Affiliate is a party to be illegal and unenforceable, then such term shall not be binding on Hotz.
- CIRCUMVENTING any of the TPMs or security in any SONY PRODUCT;
- TRAFFICKING in any technology, product, service, device, component, or part thereof that, at the time of Hotz's trafficking, circumvents any of the TPMs or security in any SONY PRODUCT, including but not limited to the Ellptical Curve Signature Algorithm ("ECDSA") Keys, encryption and/or decryption keys, dePKG firmware decrypter program, Signing Tools, 3.55 Firmware Jailbreak, and/or any other technologies that enable unauthorized access to and/or copying of the PS3 System and/or enable compatibility of unauthorized copies of other copyrighted works with the PS3 System.
- Distributing or posting any SCEA or SCEA Affiliates' confidential or proprietary information relating to any SONY PRODUCT;
- Knowingly assisting or inducing others to engage in any of the conduct set forth in A-E above solely directed at any SONY PRODUCT or that otherwise constitutes contributory liabilty under the law.

If the case continued, it could have(and likely would have) had the same outcome as Phones did in this same situation and made jail-breaking consoles legal. Sony got scared and backed down.
If your pissed at all the cheating on PS3, BLAME SONY. The Xbox 360 has been hacked for years. You don't see any cheaters on Xbox Live. Sony needs to take responsibility, do what Microsoft did, and work on better security.

They settle out of court just before it gets to court.
I've done it twice already and about to do it a 3rd time.

Sony's win won't scare other hackers due to the fact that other hackers remain anonymous in the internet, or might live in a country where sony will not be able to make a move due to different laws of different countries

jailbreaking a phone is legal and it says he cant do anything illegal to $ony products so jailbreaking the $ony phone is something he can do legally.
He probably can jailbreak it but he cant make the jailbreak for it...
Still this is a win for $ony and a lose for us.

Hackers will always be be there and if any rights are being block by these corporations then these people will stand against it even if it just an alibi to pirate software giving these hackers a reason to do even more. Hackers = Winning!
Any intelectual rights will always be scrutinize.

You know what message that would send to people who don't pay their taxes? Ummm... don't pay your taxes because they US government is a bunch of pussies who will not even slap you on your wrist for it.
Geo won't suffer anything for this and has gained tons of fame. He has TOO MANY jobs lined up. Sony, on the other hand, will be sinking in hacks as international hackers laugh at their puny lawsuit.

IMHO, he made a decision to agree to go down as a martyr for Sony in exchange for something(likel y other than not being sued as that is in the public part). What exactly? Yeah, I want know. Then I would decide if I would have made a similar agreement. (Publicly apologize and stop hacking and we'll stop the lawsuit give you this...)
P.S. Something in the docs most people missed... The case is dropped vs ALL defendants not just GeoHot.

Also, if they thought they absolutely would win completely, which would give them and the rest of the industry a valuable precedent, why would they even consider a settlement?
They knew there was a good chance they would win, but it was far from absolute... They chose the less risky route.

modify..paint it....break it? ... and there is nothing on this earth to stop you from doing so... how many people have modified cars and shared the technology through forums etc. you don't see ford or chrysler or vw taking people to court over this, do you?....as long as you are in no breach of copyright..ie selling a similar product for profit you are safe.....in otherwords you can modify your ps3 it belongs to you..Sony only made it.
