We talked previously about Sony's claim that the PlayStation 3 version of Battlefield 3 would come packed with the classic Battlefield 1943, and the subsequent failure to follow through on that promise. While there was never any official advertising regarding the bonus and it was mostly limited to Sony president Jack Tretton’s statement at E3, gamers still took it pretty seriously.
After the game failed to show up on the disc and DICE explained that PS3 owners would get “early” access to DLC instead, people sort of lost their minds.

A group of gamers filed a class-action lawsuit against the gaming giant, though their purported goal was simply to get copies of the game they were originally promised. It looks like the legal method was successful, as EA has folded and announced that they’ll make Battlefield 1943 free of charge. If you live in Europe, you can download it on the 26th. U.S. gamers have to wait until December 10, and Asian markets can access the game on December 17.
If I worked at EA, I’d be pretty pissed at Jack Tretton right now. It was his promise that ended in a lawsuit, as I can’t remember anyone from EA or DICE ever promising the free copy of Battlefield 1943. If someone has a quote, I'd love to see it.
So here’s the question of the day – is a games publisher responsible for the promises of a guy that works at another company? If Shigeru Miyamoto promises that every copy of Halo comes with a free sandwich, can we sue 343 when it doesn’t happen?

In the other article comment section, I said EA would quickly settle this and they did. You can't do what they did and get away with it. Anyone who would support such a thing is a sucker.

So are you just retarded or are you trying to put the blame on Sony here?
Don't you think that Jack Tretton had pretty damn good reason to say that stuff at E3 ? He wouldn't just say that without reason, chances are that Sony and EA did have this agreement at the time of E3 but EA backed out of it.
How can you seriously think that Jack Tretton went on stage and just blurted this out without any backing... Seriously, how can you be so daft, what are you guys getting paid ? My pet monkey needs a job...

If your a rep you cannot make stuff up beyond the fact. It was agreed and put on his que-card, They rehearsed a few times. Com'on, its EA just over there head with the rush to beat mw3.

EA would not let Jack Tretton say they had a deal unless they actually had a deal. It was something they had done the previous year with Medal of Honor (packing the HD mastering of MoH: Frontline in free with the PS3 version of the new MoH game), but I doubt you knew that.
Not only that, but EA even tweeted about the deal, saying it was changed to earlier access to BF3 DLC instead. Obviously they had knowledge of it.
It serves EA right for not making an official press release. A tweet is not going to hold up in court and that's why they caved. It was a BS move to get more pre-orders, and they got what they had coming to them.
