After working on a way to return OtherOS functionality to the PlayStation 3, hacker / developer graf_chokolo was slapped with a lawsuit by Sony. That didn't stop him from continuing to work on OtherOS, but now it seems things are looking rather grim for the hacker.
Graf_chokolo recently posted the following message on his blog:
Hi guys, no money left anymore. Going to jail soon probably because i cannot pay court costs. But i’m ready to stand up for everything i said and go to jail for that too. It’s not important to win, more important is to show them that we are ready to fight, that they cannot scare me off easily. Yeah, i’m ready to go to jail for my believes and my principles.
Most of people probably think that all computer and kernel hackers are weak kids, hiding in a cellar, eating pizza whole day, writing software and looking for attention Maybe, but that’s NOT me. And i will get out eventually and continue my work. My work means very much to me.

The removal of OtherOS has been a sore spot for a number of PS3 owners. One consumer advisory board in Finland even recommended that Sony should pay those affeceted.

If it spews EULA or ToS BEFORE you hand over money for a service or hardware so you know what your paying for before you hand out your cash, then yes it is legally binding.
If i sell you a car or house and the transaction is complete, i cant spew terms and conditions after sale, thats crap, it must come before to be legally binding

not EVERY hacker is out to pirate, the reason there is so much retaliation from these "activists" is cause they are punishing or jailing people who LOVE the PS3 enough to spend hours/days/weeks/months into finding out how to make it even better.
Fuck you sony, your shitty free games are just an attempt to show false care for your customers!

people want homebrew/emulators, linux gave them more use of the system to do those types of things.
Just because you don't use it doesnt mean it is an unused feature, if you're quoting sony, they obviously didnt want to say it was a security reason. If you want proof look at how long it took them to tell people their info was potentially compromised and their systems were hacked.
Sony doesn't care about their customers, just the money flowing in.

reason people wanted linux on their PS3s was to be able to have an extra PC, a lot of people would find it very useful to be able to game on their actual PCs while they can do everyday websurfing and messenger chats.

If you buy a PS3 is because your first priority is gaming or playing Blu-ray, not installing to surf the web and use a PC to play game. Most people, if they want a Linux, they think about PC first, not PS3. And why can't you play game on a PC and surf the web at the same time?

what if you bought a car that had a/c, but the dealer took it out of all of those cars on the next service, because they just didnt feel like fixing something. you paid for that luxury, shouldnt you keep it if you want? then the dealer says, we can fix the a/c but you can't have headlights, so choose one or the other. would you accept that or take measures into your own hands to get both back and working via yourself or someone else that knew how.
granted you may not use the a/c, but other people who purchased the same cars do, so just because you don't use it screw everyone else?

First the PS3 was supposed to be more powerful. You took that away.
Then it was supposed to have BC. You took that away.
It was supposed to allow us to run other OSs. You took that away.
So yeah, hackers are the bad guys. Not you selling a totally different machine than you advertised.

Sony took backwards compatibility away because no one bothered to buy the consoles which had it in them, people wanted a cheaper console, which is what they got. And to be honest, you can buy maybe two second hand PS2's for the money you saved while buying the 40GB version instead of the 60GB.
Want to play PS2 games ? Buy a PS2, they do a better job than most PS3s, want to run Linux ? Install it on your computer, does a better job at running linux than your PS3 ever did with OtherOS

As it says in the first line, Graf is looking at jail time because he can't pay court costs. Usually, "court costs" refers to the money that has to be paid to the court for the use of the courtroom, salaries for the judge, bailiffs, etc. If you're unable to pay your court costs by the time they're do, a bench warrant is issued, and you can be arrested regardless of the outcome of the case. I was in a similar situation over a minor misdemeanor that was dismissed. Even though I was not charged with any wrongdoing, I was still looking at jail time had I not paid the money by the date it was due.
As far as what Graf did development-wise, there is a clause in the DMCA that protects those who want to develop jailbreaks for their devices, and has been in place since the Apple V. Geohot case. If Graf manages to take the case all the way, unlike Hotz who settled out of court, chances are all he'll get stuck answering for is ignoring a court order to not continue work until the case is over.
Sony's tactic has been, and probably always will be, to sue in an attempt to bankrupt devs, not to win cases. It's a scare tactic. The precedent was set with the Apple case, jailbreaking is not a crime.
Hopefully the 5 of you who read all of that feel better informed for doing so.
