This so doesn't help his case in any way, but I guess the guy's gotta run, so he did. The latest in the George Hotz saga is that the 21-year-old PlayStation 3 hacker has now fled the United States for South America. On top of that, SCEA has in its possession the smoking gun: proof of existence of his PSN account, which he has already previously denied.




george-hotzGeoHot's sudden trip to South America was discovered when SCEA made a recent filing to court, stating that it was done in an attempt to curtail the court's orders to surrender his hard drives for inspection.



"Though the evidence establishing personal jurisdiction is already overwhelming, SCEA has little doubt that there ismuch more.

 

However, over the last several weeks, Hotz has engaged in a campaign to thwart jurisdictional discovery at every turn - regardless of whether the court has ordered such discovery or not.



Most seriously, after Magistrate Judge Spero ordered an inspection of Hotz's devices and ordered Hotz to appear at a deposition in California, SCEA learned that Hotz had deliberately removed integral components of his impounded hard drives prior to delivering them to a third party neutral and that Hotz is now in South America, an excuse for why he will not immediately provide the components of his hard drives as requested by the neutral. Hotz's attempts to dodge this Court's authority raise very serious questions."



And indeed, it does look like he's managed to sink himself lower in this pit. It was hard to imagine how it could've been possible, but there you go.

Exactly. This is a civil case, so Geohot never had a reason to flee to begin with. This was never going to end in a jail sentence. Deliberately avoiding financial repercussions by ignoring a court case IS a criminal matter, so it would have been massively stupid if it was true. Geohot has been on holiday, and is in constant touch with Sony and his lawyers to follow the case.

It's not the fact that they want reparation for him hacking the system, it's just that for too long hackers have gone unchecked by the companies that get hacked. Sony had a good case here. If they succeed, it could well enough thwart away any would-be hackers (as it already has done) thus securing the future rights of these companies.

And let's face it, this guy broke the law. Any other criminal would be put behind bars and/or be fined. Why is he so different. I agree, it's your console, do what you want with it, but in order to USE THE SOFTWARE PROVIDED, you must agree to Sony's terms. Thus, the hardware is yours, but they're letting you use the software.

Granted some will anyway and parents aren't the full crux of the blame, but capitalism that promotes taking any advantage at any cost if the outcome is favorable to you is also to blame for both sides of this problem from the companies and the pirates/cheaters. Until we as humanity can move toward a society where hard work and talent are rewarded above crime (see Berney Madoff like mispelled that name) these problems will continue. Hackers (not theives) but as a whole only seek and wish to proliferate knowledge. It's why I personally got into homebrew.

Actually, a contact in which you have no choice, but to agree (a gun to head, etc...) is not allowed, but willing acceptance of reasonable terms is considered legally binding except where it conflicts with laws (A contract to commit an illegal act isn't binding even if both parties agree to it).

The question is about "reasonable" which is what the CAS about OtherOS is going to determine where Sony's ToS is concerned.

I don't blame him for having no respect for a corrupt court/legal system. It will keep him out of this court charade that he would have had no chance of winning. This particular court he was going to be in is known for bending over backwards for companies. This was probably the safest and smartest thing he could have done. A court ruling against you means nothing if you aren't in that country. This way he can limit his financial damage to the seized property and lawyer fees, and not risk having his entire life seized to cover "damages". Will also let him get on with his life and continue his hobby. And messing with the hard drives was a nice touch for spitting in their faces.

He didn't run away. Nothing he's said has been proven false. No evidence was altered and the "missing" components are generic and could be obtained separately and his lawyer already provided them. While it was a bad PR move, it pales in comparison to the actions of Sony.

Wow, I was hoping sony would win this one so the hackers would see that they are criminals like any other criminal. I suppose we can say that it's done. He'll get all charges if he doesn't come back into the US, and if he ever does, he's going to jail (direct flight). I hope Sony can find the others too. I hate that I'm paying while some pirates get the same for free, it's lame for the devs that work all year long for nothing. And it's really bad for us if the hackers start installing online hacks to be better in shooters/etc... PS: We all pay more per games to cut on the hacking price... This isn't nice for us at all. Piracy will stop in the next 5-10 years or almost stop, when more laws will start covering the subject better.

right - in a criminal suit you have to be found guilty "beyond a shadow of a doubt", and in a civil case, it's A LOT easier to prove damage done or failure to fulfil an agreement or contract...like the User Agreement.

up untill about 3 years ago when my storage got busted into i had about every old game system there was (the neo geo was the one that i miss the most)


why cant i emulate my own things anymore ?
why is it ok to do it on my computer,
but not my computer entertainment system ?

when all my shit was stolen, my legal rites to have copies of my things were not stolen, just the physical copies and the hardware to use them.

so yes, IF my ps3 that i paid 700 bucks for, "more then my laptop, none the less"
was working, (fourth time a ps3 has fried on me 3rd time ive had to fix one)

Hacking is meant to add additional functionality or restore features. Geo and modders weren't doing a bad thing, it was Sony that forced them to after taking away features and not giving us anything desirable in return. I still hope Sony somehow loses.

More proof that the guy doesn't know the law real good. Hotz is definitely losing his defensive grounds, going to face exprediation and probably prison time with fines. He did supposably sign a contract with Sony over the "OtherOS" hack back when it was controversial.

Also to David G., you are wrong about the prices going up due to hackers. Prices been increasing for years on videogames. However, Sony does give people the option to either update or lose access to online goodies (multiplayer, PSN, etc..). PC games are the most pirated and the prices rarely change for it.

See the problem here is the fact that they do not open the system up to the home brew community (Nintendo and Microsoft should as well), they could easily have the system open and protect their games via disc based security instead of system based security. All system based security is hacked eventually its inevitable but disc based security is where they will prevent it the longest if done correctly. To be honest they need to create a storage system for console games that is above and beyond Disc and SD memory, something that combines them both would work.

Idiot, read the article. It says he provided the serial number of his console to them. It showed when he bought it and it showed THAT console with THAT serial code registered for a PSN account. So it's a bit more than just a random account in New Jersey dumbass.

His lawyers are saying the serials don't match, but I don't have access to the info from the supposed account and that will be a "sealed" item to compare it for certain. We'll know within days how the future of this is going to play out as his rebuttal to this latest round has been submitted to the courts already.

At the moment, they're just trying to prove that he accepted the TOS and is thus allowed to be tried in California, instead of his home state. The actual case hasn't properly started. Odds are Sony want this so badly because they've got their hooks into California's legal system.

I'm pro-Sony but Sony's action towards Hot isn't justified in this scenario.

Hot was merely a catalyst in the PS3 hacking scene which allowed people to do whatever the hell they want with their consoles by pushing it to the limits.
But (I know you hate this word) the ever-feared effects of pirates on the game industry caused, or rather forced, Sony to sue him for starting this all.

The thing is, shouldn't Sony be spending their money on hunting down pirates than wasting their dollars to bring Hot down? Which doesn't make much difference as his "hacking legacy" would still be continued by others.

They can take away features from the system at the drop of a hat anytime they wish and that's ok? Features they promised you the consumer were going to be standard on the conole.

Heck what if PC's did the same, what if Microsoft did that to everyone here? Windows 7 did have this but were taking it away just because.

It's just sad to see that Sony will sue you if their product is not operating the way THEY want it to.... and you remember piracy or not you paid 600 dollars and your renting from Sony... you don't own it.
