Assassin’s Creed May Be a Rip-Off

Assassin’s Creed is about a guy who uses a device to access his ancestral memories and re-live them. In these memories, the guy in question witnesses historical events, participates in assassinations and deals with a crapload of religious symbolism. Do you know what else has all that stuff in it? John Beiswenger’s 2003 novel, Link.

Now the author is suing Ubisoft, claiming that the company stole concepts from his book and used them to build the Assassin’s Creed franchise. The official complaint is littered with comparisons between the book and the game franchise, and even if Ubisoft didn’t “knowingly” steal concepts, they definitely seem to have borrowed a few (or this is the world’s largest coincidence). 


Highlights from the complaint:


  • In Link, characters experience notable and accurate historical moments through their ancestors’ memories; this is a major plotline of Link. 
     
  • In the Assassin’s Creed video game series, characters experience various historically accurate times in history through their ancestor’s memories; this is a major plotline of the Assassin’s Creed video games and books.

  • Throughout Link, the phrases “ancestral memories,” “link,” “synchronize,” and “assassins,” and similar variations thereof, are used. 
     
  • Throughout the Assassin’s Creed video games, videos, and books, the phrases “genetic memories of ancestors,” “link,” “synchronize,” and “assassins,” and similar variations thereof, are used.

  • A recurring theme in Link is the battle between good and evil; in Link, Med Diagnostics plans to steal and use the Link technology to its benefit; and governmental entities try to get Search International to use the Link device and process to interrogate “assassins” and their families.  
     
  • A recurring theme in the Assassin’s Creed video games and books is a battle between good and evil; in the Assassin’s Creed video game series, Abstergo Industries uses the Animus technology to interrogate Desmond to try and find other assassins.

 

According to the suit, Beiswenger is seeking $1.05 million in damages—unless it’s proven that Ubisoft purposefully lifted details from his book. If so, the cost goes up to $5.25 million, while simultaneously blocking the release of all future Assassin’s Creed products.

Following it, Nintendo is suing Beiswenger for copyright infringement of The Legend of Zelda. The game feature a character, named Link, which can travel in time and relieve specific moments in history, while performing/preventing assassinations, in a battle of good versus evil with biblical tones.


Only two Zelda games heavily features time-travel: "Ocarina of Time" and "link to the Past"
respectfully.

There was no time travel in A link to the Past. Tht title just suggests that the story takes place before the other Zelda games that were released before it. Ocarina of Time worked with traveling between two different time periods, but ALttP dealt with traveling between two dimensions in the same time period.

THe entire lawsuit is without merit, as though the concept of and focus of story are the same, the actual plot and intent of the two works are separate. One is quite adamant about the society changing effects of Genetic memory devices and their connection to religion, while the other is more interested in events in the past being relived on a personal level: the device is not explored as tech breakthrough, but as a medium for the game's story. In other words, in AC genetic memory is an important element of the story, but the story is not explicitly about genetic memory. If a book was made about a new technology that let everyone teleport and the trouble it causes, they couldn't sue Jumper, for example.Secondly, "damages" cannot be completely proven to be incurred if a casual check of "Link" shows that it recieved little fanfare or profit before AC was released, and yet AC made a profit on it's own merit with a majority of it's consumer base (gamers) being unaware of the novel's existence. The lawsuit has to prove that AC prevented purchases of Link, or caused confusion of brand: "I meant to buy that novel about genetic memory and assassins, but instead I found this crummy video game! In a bookstore even, what is this I don't even...", because if in court it can be proven that the average consumer can tell the difference between the two works (and not just because they are in different mediums) then Link failed to profit simply because it was not as successful as AC, not because AC successful.And finally it is not illegal for works to have simlar aspects, or concepts, as long as those concepts are named differently and not 1:1. If Link was about a Miles Desmond who is forcefully abducted from his bar so an evil corporation could use his memories to uncover an ancient war between two equally ancient conspiracies, then there could be cause for idea theft..
I could totally make a book about someone using a device to explore genetic memory during the crusades, and even heavily feature Ḥashshāshīn, but as long as characters, story arc, and descriptory content were entirely original, it would be fine, especialy if I made no attempt to look or sound like Assassin's Creed.
If AC gets hit with a lawsuit and is forced to pay, then that might be trouble for things like S.T.A.L.K.E.R., which I don't know if it received permission from the writers of Roadside Picnic or the movie Stalker.

If he has a work coming out that also used genetic memory as a sequel or what not, he could be afraid that AC would be compared favorably/negatively to his book, and is merely taking a misguided defensive measure. His lawyers may be of the idea that they should sue first, so that Ubi doesn't sue them for writing a book similar to their AC, which isn't too crazy, considering the costs of getting sued vs being sued.

To make a comparison.....

To clarify I'll give an example. The Lion King was a rip off of Kimba the White Lion. We all know this. They took the general outline of the story, changed all the names, and completely rewrote it. Disney was sued for copyright infringement by the company that owned Kimba the White Lion's copyright. Disney was going to lose hard so they purchased licensing rights to Kimba the White Lion and threw a ton of money their way in the process so they would drop their case in court. Copyright doesn't just cover window dressing, it covers even basic concepts as long as they are original.

Yeah... so the description I read on the book is probably nowhere close to what the full story is, but from the sounds of it, Assassin's Creed is only similar in a couple ideas. The book explores the identity of the "soul" through this machine that lets you RECALL ancestral memories in specific moments. Assassin's creed has a machine that lets you LIVE as your ancestor in a fairly strict sense, and as far as we know you can live as the ancestor whenever and the game only has us go through specifics, but it's definitely not for finding the meaning of a "soul". And unless the book has a guild/faction of assassins somewhere his "discusses assassinations" claim can go suck a big one. So, really, the ideas are similar, but in my mind nowhere close enough to bring up a copyright infringement.

There may be similarities... but they are hardly original and copyrighted by the author. There's many other books with similar concepts that pre-date 2009. Given there are books like this that are so old they are out of copyright, I would say the ideas are public domain.
