PoV: What is EA planning?

Electronic Arts recently changed their ToS to prevent potential lawsuits. What exactly are they planning?

Their updated ToS follows:

 

By accepting these terms, you and EA expressly waive the right to a trial by jury or to participate in a class action.

 

YOU UNDERSTAND THAT BY THIS PROVISION, YOU AND EA ARE FOREGOING THE RIGHT TO SUE IN COURT AND HAVE A JURY TRIAL.

 

YOU AND EA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING

 

The last part is interesting. It's almost as if EA is planning on doing something that people might sue them over. My initial reaction is that it has something to with Origin -- news came out some time ago that EA can remove inactive games from users' game lists.

Good thing this shit doesn't hold up in court. This is all bull. If they think that entering a few lines of text to something no one in the world even reads will protect them, they are more foolish than we thought. Legalese is about perception of the written word and as any good lawyer knows, you can skew the perception very easily. These idiots continue to bite the hand that feeds them.

Come on, all these TOS contracts legally mean fuck all til each part has gone through a court at least twice, because obviously all Judges are all just human and one ruling doesn't automatically make a precedent, so all that Judges really do is refer back to that case as a guide then make a proper decision, i mean they just write anything they like in the TOS as nothing more than a scare tactic, and it's no different to if i started giving away £50 notes to people if they just sign their name at the bottom of a sheet, but if there's any realistic doubt that you didn't read or understand a contract then your signature means less than the ink it's signed with.

this is unconstitutiona l, no way it will be allowed in court. you cant just deny someone the right to jury trial. thats fucked up and may get them in alot of trouble. they are probably planing a suiside
