PoV: Should Sony offer compensation after PSN debacle?

We reported earlier today that Sony has launched an online survey asking gamers what they'd like to see to make up for the recent PSN debacle. Is Sony obligated to give its users some sort of compensation?

 

No.

 

PlayStation Network is a free service -- it's not like Xbox Live. If this same scenario was going on with Xbox Live users, Microsoft would have to offer their users additional time of membership; they're paying for it. The only thing Sony is really obligated to do would be to give PlayStation Plus users additional membership time, but how long has PSN been down for? A week or two?

 

In either case, I do see Sony giving PSN users some type of compensation for their service being hacked, just to make some favorable headlines. They wouldn't give out money, but a free download of any first party game on PSN is likely.

They are going to have to give you money so that you can pick out the game you want and it does not make sense business wise. Most likely they'll give a sony studio developed psn game from a couple years back which is fair.

Now that all our info is out, Sony can't do SHIT to keep our info "safe". i bet in a few weeks our email inboxes will be swarmed with gay porn and granny porn....followed by tranny porn. yes, the nasty stuff is going to be there too.

Why keep beating the horse about this topic? If they give, they give. Though I still doubt it.

Yes, its a quasi-free service, but the paying members will be the most annoyed because they paid for a service that went down.

If you pay for let's say... TV SKY fees, and they suddenly stopped working for 'maintenance' for a week, you're going to be VERY annoyed compared to someone with a Freeview box.

they wouldnt charge you for those days and if they did and you point it out to them they'll take it off your next bill.

and its probably safe to say, any remaining time people had left on a + account will still be the same.

so I dont see why + users get to be more annoyed than anyone else considering the biggest part of psn (the gaming part) is the second biggest inconvenience and thats the same for everybody. what are + people really missing out on?

anyone that buys stuff on the store with a cash/credit card are the people that have had the most problems because of this.

Actually, if Freeview went down that would be more annoying than Sky because of the digital switchover (So no TV for anyone without Sky, Cable or internet connection).

Plus we also pay a license fee so you are still paying for it in some way.

note: I live in the UK in case you're talking about a different country with similar systems.

I don't usually post angry-ish responses, but this PoV piece is just....wow. It just plain misses/ignores pretty much every single one of the major issues in this whole thing.

On the paid side of the PSN, while PS+ users will undoubtedly get extra time to compensate for the loss, but then what about people who subscribe to stuff like NHL center ice (or whatever they call it). The playoffs are in full swing, and playoff hockey is the best hockey of the year. Since the PSN went down, half of the first round was played and close to half of the second round could be over by the time it's back. Simply having a subscription extended isn't good enough in cases like that.

Regarding the major issues, 70+ million people now have their personal information compromised. Names, addresses, passwords, purchase history, and possibly their credit card info. I had to cancel my credit card out of caution, and have missed a couple of really killer deals on some stuff I wanted since I have to wait for my new card to show up. That's a major inconvenience that's essentially costing me money, since I'll have to buy the stuff at a higher price now. My personal info, on the other hand, can't be canceled and replaced. Thanks to this data breach, I now have to be extra vigilant to make sure I don't become the victim of identity theft.

Sure the PSN itself is a free service, but not being able to access the PSN isn't even an issue compared to what else has happened. The PSN will likely be back up next week, and we'll all be able to play online again. People who provided their personal info to Sony and now face the possibility of dealing with phishing scams, identity theft and other major problems for possibly months or even years because of the data breach. That's not cool, and I doubt any meager free download of a game or anything like that will come close to providing proper compensation for the blunder.

All I have to say is Sony sure as hell owes PSN users compensation for this whole debacle, and even then it won't nearly be enough to compensate for what people now have to go through thanks to them.

Not for the free service but something for the stolen data would be nice. Also something for the PS+ members.

You also can't forget those with Hulu Plus, Free Trial Vudu credit that expires, and Music Unlimited customers that use the services exclusively on the PS3, they get screwed as well from this.

probably the majority play online games and intended to before buying it. bit expensive for a free service

firstly, the outage was not done out of spite to hurt sony. this has nothing to do with otherOS or geohot or graf or whatever else you think it's linked to. its about people wanting to make easy money.

obviously english is not your first language. "war" is used to describe a high level of fighting usually concerning life. the hacking you are refering to, the geohot/anonymous hacks, that is far from war.

While it may be a "free" service, it is a boasted feature that comes packaged with the PS3 meaning it's NOT free, it's included in the price of the console.

Along with that, the content that you purchase on the PSN is again, NOT free but said to be available any time you want it so that you may download it, delete it and redownload it again at any time. So when PSN goes down, that purchase is gone for the duration.

Related to that is games with online play. Their multiplayer experience is ALSO included in their costs. Consider it a rider with the stuff Warner Brothers and EA are trying to pull with Online Passes. If I buy an online pass, or a game that says it's online multiplayer, and I'm kept from using it, there is a problem.

I'm not saying that everyone should get a free copy of a PSN game, but a good will gesture from Sony that isn't along the lines of "We'll let you pay us more money at half price" would be perfect. I say this because I think one of the proposed compensations is half priced PSN+ subscription.

If you've read the most recent versions of their EULA for the PSN (unfortunately and ironically updated on April 1, 2011), you may notice the section regarding digital content that you purchase through the PSN...
It says something to the effect of 'Sony is not responsible for any content which you purchase and do not download, therefore we recommend that you download any purchased content immediately. Sony is under no obligation to continue to provide content digitally after it is purchased.'

They've got themselves covered.

Found it. Sony Terms of Service and Usage v9 Updated April 1, 2011
Section 6: Purchases and Transactions, Par. 3
"Upon SNEA's confirmation of your purchase, access to the purchased item will be made available to you through your Sony Online Services account that you used to purchase the item, until such time as SNEA removes the item. We encourage you to download or access your purchased item immediately after purchase. You bear all risk of loss for accessing your content, including completing the download of any content, ensuring that you have the necessary capabilities to view your content, including content provided at high resolution/definition, and for any loss of content you have downloaded, including any loss due to a file corruption or hard drive crash. You are solely responsible if you do not choose to download or access the content before it is removed and for ongoing storage and safekeeping of your content. SNEA is not obligated to provide you with replacement copies for any reason. "

PSN maybe "free" but its far from free. Do you think Sony would offer a service if they were not some how making a profit out of it? According to Sony the software on our PS3 does not belong to us and thus is "free" with the hardware, but do you think its okay if they all of a sudden disabled the software on the PS3? Of course not. This is all of course beside the fact that my personal information was in plain text and leaked to a malicious party which can use those details to do what ever they want. I acutally would rather had the hackers steal my CC number than my personal information because i can change my CC number but i cant changed who I am, unless you have a time machine and would like to prevent my birth for another day (which wouldnt be that hard cuase i was born c-section). ANYWAY... my point is, legally, they don't have to give us anything for the PSN downtime, but if they want to leave this debacle with the slightest bit of dignity, i would hope they have something for those that have been patrons of Sony. But then again, how would Sony make up for the fact i have to look over my shoulder all the time to prevent someone stealing my identity. I assure you a free game is not worth the hassle of constantly having that thought in the back of my mind.

Although there maybe a "million" other ways, I am, and many many others, that are that much closer to getting screwed. Furthermore, I always use a fake information when it comes to other things that don't require my true identity. So in all there are probably only a handful of ways my identity can be stolen.

I personally feel that Sony should offer some form of compensation to users whom have had their credit/debit card information stolen thanks to their actions.

Arguing that PSN is a free service does not justify negligence on the security side.

I want ten bucks for the new debit card I ordered because I couldn't take the risk of my card being stolen.

I'd take psn credit (I'll get Xenogears that way).

Off topic but my iPhone recognizes the word "xenogears" and autospells it weird like it will capitalize Sony and Microsoft but not nintendo.

in my bday i received 4 games two of them most important feature are multiplayer and i cant enjoy myself thanks to this BS

In 2008, Microsoft gave away Undertow to "all Xbox Live members", "available to Gold and Silver members at no charge", after a 2007 Xbox Live outage.

Sony should do the same for all members, including free and paid, after its 2011 PSN outage.

Doesn't Sony advertise PSN with a purchase of a PS3? Wouldn't that be considered indirect expectation for a free service to work, as advertised?

From what I hear, sensitive information was compromised on accounts.

For the negligence that caused this, I'd think some compensation is in order.
Even if it was just free game downloads or free Store credit or something.

I'd be happy if they just gave me $100 store credit for the trouble or something.

I'm sure whatever compensation, if any, I'll find adequate.

I'm not saying they should compensate the users, but it'd definitely be a good thing if they did.
