PoV: Notch Can Use Scrolls. Woo.

This a PoV. In other words, this article is my point of view, and while you may disagree with it, learn to embrace it. It's Valentine's Day. Opinions and love are what keep the world going (Probably). Not that this article will be filled with love.


Something about Notch bothers me. An air of arrogance? Maybe.

 

Bethesda aren't happy with his use of the name ‘Scrolls’ on his new game, but instead of changing it, he let things go to court and has indeed won an injunction that will now let him use the name unless/until Bethesda appeal against it.

 

NOTCH

 

 

Hope you’re happy, Notch, as it doesn't feel like a victory to me. I understand he wasn't happy with Bethesda trying to own a word, and I agree with him being upset; you can’t own a common word.

 

But if he had changed his title’s name as soon as Bethesda had complained, it would have worked much more in his favour. Why? Because people would say:

 

‘Why did he change the name?’

 

‘Because Bethesda weren't happy with it because they use the word in The Elder Scrolls.’

 

‘Wow, Bethesda are dicks.’

 

Instead it’s ‘Notch beat Bethesda in that name case. Oh good, after the months and hassle of law suits, he gets to use the world ‘Scrolls’.’

 

And they’d be right. It feels like he’s trying to prove a point to everyone watching, so he’s the big indie man taking down the evil corporations.

 

I’m just not feeling the passion here, it feels primarily about status.

Depends on the demand; change the title of a small title, then yes. Since the company is so large, everyone will know what happened and you'll benefit more from the public eye than going through publicized court battles for one word.
Now it looks like a petty battle with both sides being, well, petty.
If he had changed it, Bethesda would have come across petty, and Notch would have come across as not caring over a simple change.

Didn't Medal of Honor(was it?) get bashed by gamers because they didn't fight for keeping content?

I assume that had Notch given up on the name they would do the same.

Either way, they both would have still looked "petty".

So because someone didn't want to change the title of a game that they were making, and by all rights should be able to call it anything that they so please, and won a court battle, you think he is petty? HIGH-LAIR-E-US!

Wow, you people are stupid. I thought it was established MONTHS ago that if Notch copyrighted the word "Scrolls" that he could then sue Bethesda for every Elder Scrolls game released afterwards. THIS IS JUST LAWYERS BEING LAWYERS, THIS WAS OVER MONTHS AGO. NOTCH IS A MONEY GRUBBING ASSHOLE.

Notch did not even want to go to court. Don't you remember when he asked for a game off between Bethesda & Mojang - whoever won would decide if Scrolls could be used on his next game. Bethesda's lawyers slapped that peaceful idea down hard.

I've been a Bethesda fan for over a decade, but they were crossing the line with this court business. Consumers aren't stupid. Scrolls is abviously unrelated to The Elder Scrolls. I doubt Bethesda will release an ELDER Scrolls game without the word ELDER in it.

Anyone who thinks consumers aren't stupid hasn't worked in retail. I've watched several confused people try to buy those generic Disney movie knockoffs, like Aladdin where the genie is red. A name similarity to someone who is just buying a game based on recommendation may cause them to buy Scrolls thinking it's Elder Scrolls. A lot of knockoff companies bank on the fact that people don't pay attention and there are plenty of lazy consumers.
