Lawyer makes IP argument against piracy |
Listed in: News Tags: DRM, ip spoofing, Pirates, video game piracy

"Game lawyer" Jas Purewal has come out in a recent court case saying that with those who are pirates have no real defense in the eyes of the law. There's no way to go after IP addresses that have downloaded games because most hackers just mask there IP's anyway. But Purewal a London-based lawyer has pointed out that the argument doesn't really stand up.
Purewal says there is really no evidence that most pirates have the desire or technical chops to effectively mask their IP address, and even if some did, that's hardly a reason to give up going up against internet pirates. "There's no empirical evidence," says Purewal, "to support how often IP spoofing is done." Purewal goes on to say that "few pirates actually go to the trouble of disguising themselves."
Purewal has some humility about the situation saying that "piracy might result in an eventual purchase of a game but in the meantime it means a financial loss for the developer...sadly developers are not gamer banks willing to effectively loan gamers money until we decide we like them enough to pay them." Purewal, however says, like Valve, the solution for piracy should come from publishers offering better ways for customers to enjoy games. "If we can reduce piracy through the means of technology and via the market then that's got to be better than getting any lawyers involved.
This comes only days after the figures for the most pirated games of 2011 according to Torrents. The actual evidence of people who DON'T buy games after they pirate them is rarely, if ever, recorded. So while Piracy is still a problem in the industry I don't see Activision complaining after making billions of dollars despite sliding into the Top 5 most pirated games on almost all platforms.

Think about the logic here:
1) In case the game sucks you don't buy it.
2) Game doesn't suck but you're too lazy to go out and buy it, plus you already have it so why bother.
Pirating is a means of convenience, and cheap bastardly-ness.

But the fact that Gamestop is getting fat ass rich off used games only serves to prove that game sales are through the roof so all these companies need to quit bitching and enjoy their riches.

to clarify:
*if you buy a unused game from Gamestop (although I don't know why anyone would do that) Publishers get their cut as usually
*if you buy a second hand game from any game dealer they get all money from it
so used game dealers is as hazardous to the game industry as piracy

Do you have any clue as how much money USED CAR sales bring in every year? That's all money that the car manufactures never get! OMG!!!!
Used "stuff" sells all the time. Been that way for over 200 years. Why the hell should it change now and ONLY when it comes to video games?
"so used game dealers is as hazardous to the game industry as piracy"
100% Grade A bull. It used to be that we sold our used games to the kid down the block for $5 (OR GAVE AWAY FOR FREE). OMG! Game users are as hazardous to the game industry as piracy!!!!
You also utterly failed to understand my comment. If there are so many USED games then there are EVEN MORE NEW game sales (seeing as how not everyone sells there games). You do realize someone has to buy a new game before it becomes a used game right?

1) In case the game sucks you don't buy it
2) Game sucks and you would've traded it into Gamestop eventually anyways (thereby allowing someone else to buy a used copy over a new copy).
This has been the case for me more often than not, tbh.

IMO, I think PC games should be able to be played straight from the disc (like console games) but one needs to type the serial key to install the game.

This exactly. Companies need to get back to making demos so people can try before they buy. Being able to download a demo from the comfort of your home is very helpful. And ideally a demo should come out BEFORE the game is released, not 3 months after.

I remember when you used to be able to rent games... oh wait!

Absolutely...also, even if someone DL a game or movie or music or whatever, doesn't necessarily mean that they actually had time to play it. It could still be sitting on the their HD (still rar'd) or even deleted ?
Where's the proof of anything at all?
PIRACY is THEFT? THEFT is making a copy of sth and selling it as if it was an original - that's THEFT, That's Illegal, That's copyright Fraud! Even if PIRACY was done away with from the Net at least, it still wouldn't encourage buyers because those of us who DL Rips never had the intention of buying it in the first place. Not at that particular moment in time anyway. Like myself for example, I refuse to fork out for Batman:AC & Skyrim because there's just too much extortion DLC coming out that I'd rather wait for an all-in-one GOTY edition (complete package for a nice reasonable price)and in the meantime I'll play the basic standalone DAY 1 release that I DL - LOL. That'll teach' em to get too greedy! The more the publishers try to rip us off the more we'll find ways in which to play for less - and Y not?

What's your point? That I can steal a DVD player from someone but as long as I don't plug it in and use it then I never actually stole it? That's ridiculous!
I hope you realize that someone who downloads a pirated game isn't someone that anyone goes after. They go after the people who have been recorded to have DISTRIBUTED many TB's worth of data.

False.
"as an IP address cannot be physically linked to a person."
You're only "sort of" correct. It can be linked to a specific piece of equipment. The owner of that equipment is then prosecuted. So even if a teenager broadcasted a pirated game for 8TB worth, most likely that kids parents are the one that would get prosecuted.
