Blizzard to sue Valve over DOTA |

I'm not a big fan of Blizzard. Hey, I love their games. Love what they did with the original Starcraft and Warcraft 3 is still one of the best games I've ever played, but it's the company practices that more often than not cause me to shrug and roll my eyes, like the cliched hipster I am. So what are they doing now? Well, it seems they have decided to start suing over the name DOTA, which means Defense of the Ancients. The game which Valve has been making a sequel for.
The game DOTA originally spawned from a Warcraft 3 mod, which despite the game being used, Blizzard don't entirely own the rights to. However, Blizzard did make some unkind remarks in the past and now they've thrown their hat into the proverbial ring to finally fight Valve on the name.
The thing is, neither Valve nor Blizzard officially own the name, but Blizzard claims that the "DOTA mark has become firmly associated in the mind of consumers as Blizzard,"which is kind of true but ultimately not a strong case. Valve has acknoweledged in the past that they do not officially own the name but Blizzard has said "Valve has never used the mark DOTA in connection with any product or service that currently is available to the public. By attempting to register the mark DOTA, Valve seeks to appropriate the more than seven years of goodwill that Blizzard has developed in the mark DOTA and in its Warcraft III computer game and take for itself a name that has come to signify the product of years of time and energy expended by Blizzard and fans of Warcraft III." Talk about a mouthful of DOTA.
So in TL;DR speak, "WAAAA We own the rights to DOTA. Valve just want it for themselves. We made DOTA but we totally didn't because it was fans who made it, but we made Warcraft III and WAAA nobody knows what to do about the legal status of IP's made of existing material such as Source mods WAAAA..."
Blizzard also noted the fact that DOTA mods cannot be played without Blizzard software and that the titles of DOTA is a reference to the characters known as The Ancients, which is a part of the Warcraft lore, such as the Tree of Life, which most DOTA players must attack in the mod..
The conflict is officially a court battle and I'd love to hear the court proceedings from the view of the DOTA creator IceFrog...who actually now officially works for Blizzard and will probably not go against them.
DOTA 2 can be actually called DOTA 2 until July, which is when there is a possible outcome. Blizzard has released a full court statement which outlines the Warcraft III IP argument and leans on Valve and the distinction of DOTA, Dota 2 and the Defense of the Ancients. To be fair, despite the Blizzard written mythology, I've found the title of Defense of the Ancients to be a fairly lame and boring. You'd think Valve would have chosen something more interesting like Fight of the Old People...like you wouldn't play a game that possibly offers geriatric fighting.
To be fair, Valve, they [Blizzard] did have the name first. In fact, when I first heard the fact Valve was making DOTA I thought Valve had picked up some Blizzard titles recently and that Battele.net was going to die other than from how poorly it was managed. But it looks like using the name will steal da moneyz away from the precious Blizzard much like the recent case between Mojang and Bethesda.
Their case was meant to end with Mojang and Bethesda fighting it out like game companies should, in a glorious display of Quake 3. But in the end Bethesda chickened out of both the lawsuit on the word Scrolls and of the Quake 3, leaving the lonely Swedes to happily play with themselves in a world of their own.
I've made fun of the US in the past and I think it's time I turn over a new leaf. We're not so different you and I, he said to the Joker, because you do stuff that we do here in Australia. For example, we have outrageous lawsuits as well. We like to sue people because it makes us look fiscally important, even with any shred of evidence, we will sue the pants off the pantsless and claim those pants hit us in the face and sue for negligent pants wearing. DOTA is for whomever but I am genuinely torn on this case, do you think Valve should get sued or acknowledge who had the name first?
