Lawsuit Filed Against Apple Over Tracking, Jobs Denies It

Since a couple of researchers dropped their bombshell about how Apple mobile devices are tracking their owners’ every move and making the information available to others, many users of iPhones and iPads have gotten pretty peeved. Two parties are sufficiently peeved to file suits in a Tampa, Florida, court against Apple over the snooping. The attorney for the plaintiffs said on Monday, “We take issue specifically with the notion that Apple is now basically tracking people everywhere they go. If you are a federal marshal you have to have a warrant to do this kind of thing, and Apple is doing it without one.” The pair is suing for alleged privacy invasion and computer fraud. While Apple has declined to give an official reply to the suit, CEO Steve Jobs left a cryptic reply to a query from a MacRumors reader. The conversation went like this: Q: “Steve,?Could you please explain the necessity of the passive location-tracking tool embedded in my iPhone? It’s kind of unnerving knowing that my exact location is being recorded at all times. Maybe you could shed some light on this for me before I switch to a Droid. They don’t track me.”?A: “Oh yes they do. We don’t track anyone. The info circulating around is false. Sent from my iPhone.” Uh, thanks for that clarification, Steve. Could you elaborate a bit more?

Apple did reply to questions about tracking last summer and indicated that the location features must be authorized by the user and can be turned off entirely. This claim has been disputed by the Wall Street Journal, which claims the tracking database is still being updated even if the owner turns off location services. This is not the sort of negative publicity that Apple needs right now, with the iPad 2 new on the market and the white iPhone 4 coming this week.
