Disgruntled iPhone 3G Owner Sues Apple

The iPhone 3G was introduced in the summer of 2008, but may already be obsolete if you believe the claims of one user. There have been complaints from owners of the iPhone 3G and 3GS ever since iOS 4 was released in June, alleging that the Apple software upgrade has caused frozen unlock screens, slow keyboard response and drained batteries. One unhappy owner thinks Apple has a devious plan to force her to buy the newer iPhone 4, and is taking the company to court. Bianca Wofford of San Diego has filed a class action suit on behalf of iPhone 3G owners against Apple for violating the Consumer Legal Remedies Act, unfair business practices and false and deceptive advertising. The suit cites “significant and extended loss of functionality, application loss, loss of use, and substantially degraded performance for all owners and consumers of the third-generation of the Apple iPhone.” Wofford says the upgrade to iOS 4 left her phone unusable, and she was offered no help from Apple tech support, leaving her with two choices: buy a new iPhone 4 and pay an early upgrade fee to AT&T, or downgrade her phone to iOS 3. The latter option would require jailbreaking the device, which voids the warranty. Does this sound like an insidious conspiracy by Apple to sell more units of the iPhone 4? The plaintiff thinks so, and the suit states: “Wofford is informed and believes that this whole situation was created to be a consumer catch-22 by Apple in order for the company to promote sales of its just released iPhone 4 and to cause consumers to simply abandon the earlier 3G and 3GS platforms.” Wofford is seeking $5,000 for herself and each of the other class members. Well, “planned obsolescence” has always been a part of American industry.
