iPad News: Judge Kills iPad Overheating Suit

Keeping electronic gadgets out of direct sunlight on a scorching day seems like kind of a no-brainer, but that didn’t occur to three iPad owners who tried to use theirs outside last summer, because “reading on iPad is just like reading a book.” All three experienced overheated iPads and all three took their problem to court. The plaintiffs, named Balthazar, Keller and Browning, filed a class action suit in July charging Apple with fraud and deceptive advertising for not warning them how the iPad could heat up. I hope they didn’t plan to take tropical vacations with the money they expected to score off Apple, since on Monday, U.S. District Court Judge Jeremy Fogel dismissed the lawsuit, writing: “The Court concludes that these allegations are insufficient. At the least, Plaintiffs must identify the particular commercial or advertisement upon which they relied and must describe with the requisite specificity the content of that particular commercial or advertisement.”

So is every Apple commercial supposed to be a crash course in iPads for Dummies? I’ve never seen an ad telling users not to drop the iPad down the toilet or run over it with your car, but most of us have managed to figure those out by ourselves.
