If you were curious about how the whole Guitar Hero III: Legends of Rock (PS3, Xbox 360, Wii, PC) debacle over the Wii version turned out, then here's a timely update: it seems that the class action lawsuit suing Activision has been dismissed, with both parties agreeing to a compromise. All's well that ends well. For those of us not familiar with the case, the lawsuit stemmed from the Wii version of the world-famous rhythm game having quite the ironic glitch: that it boomed out mono sound regardless of your sound system, instead of the Dolby Pro Logic II Surround Sound joy printed on the box. This naturally irked quite a few customers, and prompted Activision to replace the defective games with new, multi-channel-enabled copies. Of course, the replacement program wasn't quite enough to cool down a certain Samuel Livingston from San Diego, and thus the lawsuit was born. And thus it is laid to rest, in light of an agreement made between Activision's and Livingston's lawyers. What made the compromise possible? Pretty much two sides deciding to sit around a table and talk things out, with the premise that neither wanted to spend an absurd amount of time or money arguing a case that could go on for quite a while. Thus, they agreed to simply settle on a mutual agreement. Very nice, indeed. While it's certainly interesting to see litigation in video games, it's also good to know that people aren't as unreasonable as lawsuits make them out to be. Updates as we get them. |

That's because he had no case. A bug was found and replacement discs where sent out. No law was broken and no one suffered from any losses.

I didn't know they got sued over this. Who knows if that prompted the replacment discs or not, but this was another BS class action lawsuit either way.
I'd rather just complain in the forums, as I usually do. It was pretty funny/sad it happened in the first place.
